After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification.Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit(s) 39 when issued by the US Army Corps of Engineers (USAGE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 26 .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non- discharge regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Construction Plans This approval authorizes impacts to wetlands and riparian buffers associated with the installation of the proposed road as depicted on the "Proposed Office Park 7331 ACC Blvd. Site Mass Grading Plan" signed and sealed by Walter E. Credle, PE on July 2, 2003. 2. Diffuse Flow (Review) An additional condition is that stormwater shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re-concentrating. Additionally, a stormwater management plan for this project shall be provided to this Office before any of the impacts approved herein are conducted. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffers as described above will be achieved. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 1506 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1506. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse riparian buffer protection rule as described within 15A NCAC `2B .0233. Please find attached the cross section detail and plan showing no impacts to the stream from the proposed Conspan Bridge. We have indicated on the minimum span distance, the maximum stream width, width of footing from inside span wall and the minimum flood plain width for both sides of the stream as shown on the attached drawing. • Item 2. Please find attached the proposed sanitary sewer to service the future site. The proposed 6 inch sewer extends over top of the Conspan bridge and will not disturb the existing stream. • Item 3. There are no permanent storm water outfalls on site. The site is to be graded only, with no development at this time. • Item 4. We have proposed level spreaders and temporary filter basins during mass grading activities. We are proposing no permanent storm water discharges at this time as we will be grading only and will keep the temporary filter basins and flow spreaders in place until future development of the site. We are proposing to grade the site and then seed the graded area for future development only. • Item 5. The purpose of this road is to provide necessary access to the Owner's property that has its only access from ACC Boulevard. We are seeking your approval for this disturbance since the total channel length to be disturbed exceeds 40 linear feet but is less than 150 feet and is therefore the road crossing is an "allowable" use. The property is bounded by I-540, Sycamore Creek, private property and then ACC Boulevard. To minimize the impact to the NRB, our proposed road alignment follows and old road bed which is already partially cleared. We have done our best to consider all possible alternatives. However, to access the usable part of the property, we must cross a tributary and slightly impact the Neuse River Buffer in the area. We have prepared the attached map for your reference. The property is bounded on the south by I-540; therefore, the only access into the property is from ACC Boulevazd. Because a perennial channel bisects the property, crossing the channel is unavoidable in order to access the site from ACC Boulevard. Impacts, however, are minimized with the use of an arch culvert and headwalls, and the channel will remain undisturbed. The only disturbance proposed for this crossing consists of impacts to zones 1 and 2 of the Neuse River Buffers. Wetland impacts consist of 0.08 acres of lot fill for the purpose of potential future development on the site. However, the wetland impacts aze below the thresholds required for prior approval from the USACE and DWQ. No additional impacts are proposed for the site (i.e. the remaining buffers and stream channels will remain undisturbed). At this stage, no site plans aze available for review. However, the applicant is awaze that any future development must comply with the Neuse Buffer Rules. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed road/driveway is necessary for the owner to access the property for timber harvest and/or future development. Because the applicant has minimized impacts to the maximum extent practicable, and the impacts aze below the notification threshold, S&EC doe not believe mitigation should be required. NC-DWQ's current policy requires written concurrence for Neuse Buffer impacts that exceed 401ineaz feet for a driveway crossing. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance. with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
