After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit 39 and 18 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 26 .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this-project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Stormwater Management An additional condition is that the final, written stormwater management plan submitted to this Office on March 11, 2003 shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented before any permanent building is occupied at the subject site. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Additionally, you must submit plans that provide diffuse flow of stormwater through a vegetative filter strip to remove nitrogen or that provide diffuse flow through the protected buffer for the discharge from flared end section C. No additional written approval is needed if the flow-spreading device is designed according to the Level Spreader Design Guidance at hfp://h2o.ehnr.state.nc.us/ncwetlands/level.pdf . 2. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. The attached report is divided into five major sections: 1. Nitrogen loading calculations 2. Hydrograph and reservoir routing (2, 25 & 100 year storms) 3. Storm drain piping (25 and 100 year frequency design) 4. Supporting 11 x 17 exhibits 5. Storm water maintenance plan 6. Erosion control calculations 1. Nitrogen Loading The calculations show that this site has less than 10.00 LB/Ac/Yr of nitrogen load without any BMP treatment measures. However, due to the requirement to reduce post Q2 peaks to pre Q2 peak conditions, some detention is required. We have elected to install bioretention basins that will reduce the Q2 peak and will also reduce the nitrogen load. There are two bioretention basins proposed and they are set up for sequential treatment of a portion of the site watersheds. The watersheds that drain through these basins also drain through an undisturbed 100' riparian buffer. Hydrograph and Reservoir Routing For storm water entering the bioretention basins, a triangular hydrograph was developed whose peak and time of concentration match the calculations for the storm drain piping. Multiple inputs resulted into combined hydrographs with the total volume of the two input hydrographs and a new combined peak. Storage - discharge - volume curves were established based on the characteristics of the basins. The 2, 25, and 100 year storms were calculated to confirm basin performance. For the two year frequency storm, the calculations indicate,an existing peak of 30.00 cfs (hydrograph #12) has been reduced to a peak of 11.00 cfs (Hydrograph #11) from the proposed development. The existing hydrograph is based on a comparative watershed of the same area undeveloped. 3. Storm Piping Design Wake County Public Schools require all piped storm drainage to be designed for the Q25 peak capacity. You will find in this report all HGL calculations for the 25 and 100 year frequency storms. Calculations are based on the rational formula and the IDF curves developed by Dr. Rooney Malcolm (published in Raleigh's storm water management manual) for the Raleigh area. Although the proposed bioretention basins significantly reduce the Q25 peaks, the basin storm drain pipe outlets have been sized for the full Q25 peak without regard to detention. This is an additional safeguard, should there be any failures of the basin systems. All pipe outlets are to be protected with rip-rap at flared end sections to prevent erosion problems. 4. The procedures and schedule described herein are required by the Town of Cary and must be strictly adhered to. Documentation of compliance must be maintained in writing at the school site at all times. As a minimum, the maintenance record must include a description of the activity or procedure performed, the date completed, and the printed name and signature of the responsible person in charge. Description of Systems The storm water management system on this site is comprised of a conventional subsurface piped collection system designed for the 25 year frequency peak flow. Roof water and all surface runoff is collected in the pipe system and then directed through two bioretention basins on the site. In addition, the storm water is also directed through a 100' permanent riparian buffer. This manual covers the maintenance and operation of the pipe collection system, bioretention basins, and riparian buffer. Schedule of Required Maintenance Activities Frequency Activi As required Any pipe inlets, curb inlets, or drain inlets partially blocked by tree limbs or other debris, shall be cleared immediately. Any damaged or missing grates or frames shall be repaired or replaced immediately. ' Frequency Activity ' Any concrete flared end section which becomes damaged more than 30% shall be replaced within 60 calendar days. ' b li s, m When storm damage occurs, trim hazardous repair stream bank, and maintain a healthy vegetative ' buffer within all riparian buffers. Annually All storm drain inlet structures shall be inspected for ' debris or sediment in the bottom of the box. Any sediment greater than 1/4 the outlet pipe diameter in ' depth shall be removed. Repair or replace all rip-rap at all flared end sections ' to original dimensions on approved site plans. Visually inspect all flow lines of storm drain piping. ' Remove any obstructions. Flush pipe clean if sediment is greater than 1/4 of pipe diameter in depth. ' Visually inspect all piping locations for joint failures that result in surface cave-ins or depressions. ' Once per 5 Years Through clean-outs provided on corrugated subsurface drains with water to confirm positive flow with no blockages. If positive flow cannot be ' confirmed, identify point of obstruction and excavate to repair. ' Once per 20 Years Replace any dead or aging plant material in the Bioretention basins. ' i il x, m Evaluate selected excavations of planting so non-woven filter fabric, and sand filter for sediment or ' excessive fines contamination. If filter fabric or sand filter appear clogged or ineffective, replace all the ' planting soil mix, filter fabric, sand filter and lants ciated . p asso No additional impervious area may be added to this site without revising nitrogen calculations to the Town of Cary, and if necessary, paying appropriate fees and nitrogen buy down fees. We have arranged a meeting with Todd St. John of your office for 3/11/03 to be sure these issues are addressed to your satisfaction. As far as Item 3 goes, the plan is to drain the pond for safety reasons (which does not require a 401) and place a pipe through the old dam so that the pond remains drained. To avoid downstream erosion the engineer plans to place a rip rap energy dissipater at the outlet shown on the previously submitted plan. Currently the pond is not breached. The attached site photos show the current site conditions downstream and upstream of the dam. The old dam will also serve as a cross-country running/walking trail. The emergency spillway is currently functioning as the primary spillway since the old pipe through the dam is clogged. The previous consultant considered this spillway jurisdictional which would not be true if the pipe through the dam functioned properly. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
