THIS DEED made this YSl day of July, 2008, by and between Garry Silivanch and
wife, Bernadette Silivanch, hereinafter called Grantor, and Garry Silivanch and wife, Bernadette
Silivanch, whose mailing address is 290 Goose Neck Rd., Rocky Point, NC, 28457 hereinafter
called Grantee;
The designation Grantor and Grantee as used herein shall include said parties, their heirs,
successors, and assigns, and shall include singular, plural, masculine, feminine or neuter as
required by context.
The sole purpose of this General Warranty Deed is to add the Restriction referenced
below as required by the North Carolina Department of Environment and Natural Resources,
Division of Water Quality.
WITNESSETH
That the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is
hereby acknowledged, has and by these presents does grant, bargain, sell and convey unto the
Grantee in fee simple, all that certain lot or parcel of land situated in Pender County., North
Carolina and more particularly described as follows:
BEING ALL OF LOT 15, as shown on a map of Swann Plantation prepared by
Robert H. Goslee and Associates, dated January 1982, and recorded in Map Book
20, at Page 10 in the Office of the Register of Deeds, Pender County, North
Carolina.
Together with rights of ingress and egress over a sixty (60') foot right of way as
shown on a map prepared by Robert H. Goslee and Associates recorded in Map
Book 17 at Page 14 in the Office of the Register of Deeds, Pender County, North
Carolina and further together with rights ingress and egress over and to Lot #23 as
shown on said map recorded in Map Book 20 at Page 10 in said registry, as
further access to the water.

Also Subject to the following Restriction as set forth by the North Carolina
Department of Environment and Natural Resources, Division of Water Quality:
"A portion of this lot has been determined to meet the requirements for designation as a wetland,
stream or protected stream buffer. Any subsequent fill or alteration of this area shall conform to
the requirements of the state rules adopted by the State of North Carolina in force at the time of
the proposed alteration. The intent of this provision is to prevent additional wetland, stream or
buffer filling or draining, so the property owner should not assume that a future application for
filling or draining would be approved. The property owner shall report the name of the
subdivision and lot # in any application pertaining to said rules. This covenant is intended to
ensure continued compliance with all rules adopted by the State of North Carolina and therefore
the State of North Carolina may enforce benefits.
This covenant is to run with the land and shall be binding on all Parties and all persons claiming
under them".
The property herein described was acquired by the Grantor in Book 2297, Page 50
of the New Hanover County Registry.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor is seized of the premises in fee
simple, has the right to convey the same in fee simple, that title is marketable and free and clear
of all encumbrances, and that Grantor will warrant and defend the title against the lawful claims
of all persons whomsoever except for the exceptions hereinafter stated.
Title to the property hereinabove described is subject to the following exceptions:
Restrictive covenants, easements and rights of way as may appear of record in the
aforesaid registry, 2008 ad valorem taxes and all applicable zoning and land use ordinances.
IN WITNESS WHEREOF, the Grantor has hereunto set his hand and seal, or if
corporate, has caused this instrument to be signed in the corporate name by its duly authorized
officers and its seal to be hereunto affixed by authority of its Board of Directors, the day and
year first above written.
