PROJECT DESCRIPTION: The project site is located at 1911- 1939 Kings Landing Drive, adjacent to a canal off the AIWW, in Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Country Club Road. Turn right onto Country Club Road, and travel approximately 1 mile to Kings Landing Road. Turn right onto Kings Landing Road and follow it approximately 2 miles. The property is located on the left. The project area consists of three separate lots, each measuring approximately 0.4 acres in area. The application states the highground portion of the property is elevated approximately 0-15 feet above Normal High Water. Vegetation consists of lawn grasses, ornamental trees and shrubs on the highground. Existing man-made features on the property include two single-family residences, a boat ramp and two docking facilities. The entire length of the shoreline is stabilized with a bulkhead and a small boat basin exists on the westernmost lot. Coastal wetlands consist of Salt Meadow Hay (Spartina patens), which border the western side of the boat basin immediately landward of the bulkhead, Salt Marsh Cordgrass (Spartina alterniflora) growing waterward of the bulkhead along the western side of the boat basin and two Glasswort plants (Salicornia sp.) growing along the eastern side of the boat basin, immediately landward of the bulkhead. Sea oxeye (Borrichia frutescens) is also growing at the edge of the basin landward of the bulkhead. It appears that due to the low height of the bulkhead adjacent to the boat basin (approximately 1.5' above normal high water), it is likely that the vegetation landward of the bulkhead floods at least irregularly with a wind-driven or lunar high tide. A canal runs north/south from the AIWW to the boat basin, then turns east past the boat basin, at which point it narrows and is running parallel to the AIWW (roughly east/west). At this point, the canal measures approximately 27' in average width. A marsh island separates the canal from the AIWW, vegetated primarily with Salt Marsh Cordgrass (Spartina alterniflora). The width of the canal at it entrance is wider, measuring approximately 60 feet in width, which narrow to approximately 17' in width at its turn. State Permit 55-78 was issued to Charles Rogers, at that time the owner of 1925 Kings Landing Road, on April 4, 1978 for the maintenance dredging of an existing channel, which originated east of the current project boundary and terminated near the center of Mr. Roger's lot. An application for a new state permit was submitted to the Division of Coastal Management in 1979 for the excavation of approximately 1,500 square feet of marsh between Mr. Jenkin's property to the west and this maintained channel to the east. The application was denied on May 9, 1979 based on significant adverse impacts to marsh and the resulting inconsistency with Pender County's Land Use Plan. The permit decision was appealed, the proposed project was modified and approved on September 7, 1979. The permitted dimensions allowed the excavation of a channel measuring 50 feet in length by 15 feet in width connecting to another section of channel measuring 30 feet in length by 20 feet in width. Both sections were approved to be excavated to a final project depth of -5 feet at Normal Low Water (NLW). A State General Permit (433563-D) was issued to Melza Rooks on April 28, 1997 for the maintenance dredging of the channel, measuring 150' in length by 15' in width and to a final project depth of -4' at NLW. The waters of the AIWW adjacent to the project site are classified as SA by the North Carolina Division of Water Quality. The bulkhead to be replaced would measure approximately 25 feet in length east of the basin, approximately 30 feet in length to the north, and approximately 34 linear feet of bulkhead would be replaced along the western side of the boat basin. The north and eastern walls of the basin would be replaced two feet waterward of the existing bulkhead and the section to the west would be replaced within the existing footprint to avoid impacts to the Spartina alterniflora growing waterward of the bulkhead in this area. The applicant is also proposing to reconfigure the private docking facility within the basin. The access pier would be shifted approximately 7' to the west and would extend an additional 4' from the bulkhead. The floating dock would be replaced and would remain in alignment with the pier, as it is currently configured. A boatlift, measuring 12' in length by 12' in width, would be installed on the eastern side of the floating dock. Two mooring pilings are proposed waterward of the floating dock, which would allow for a boat to tie up to the end of the floating dock. The reconfigured docking facility would allow for the docking of two vessels. The existing water depth in the proposed docking location is approximately 18" at NLW. The applicants are also proposing to perform maintenance dredging along the existing canal. An access channel, measuring 175' in length by 20' in width, is proposed from the AIWW to the boat basin. From this point, the excavation would narrow to 15' in width and would extend 50' in length. As proposed, the channel excavation would then continue east along the canal, parallel to the AIWW, which would measure 175' in length by 20' in width. All maintenance dredging would be performed to a final project depth of -5' at NLW. Material would be excavated using a bucket to barge and the spoil would be placed on the highground portion of the property behind silt fence and outside of the 30' buffer. The narrative states the channel would be excavated in two separate passes, with the intention of reducing the impacts of sloughing on coastal wetlands. The spoil site would measure 100' in length by 225' in width. Approximately 870 cubic yards of material would be excavated. Once dewatered, the dredged material would then be used as backfill behind the bulkhead and spread out on highground. 10. ANTICIPATED IMPACTS The maintenance dredging would disturb approximately 6,750 ft.z of shallow bottom. The dredging operation would likely result in a temporary increase in turbidity. Due the proximity of the proposed excavation to marsh vegetation, subsequent sloughing may result in undetermined impacts to coastal wetlands. The proposed bulkhead would result in the filling of approximately 50 square feet of Coastal Wetlands, vegetated with Salt Meadow Hay (Spartina patens) and Glasswort (Salicornia sp.), and 106 square feet of Estuarine Waters and Public Trust Area. The project would also result in the disturbance of approximately 22,940 sq. ft. of high ground as the result of spoil disposal, bulkhead construction, the associated anchor and tie-back system and backfill. The docking facility would incorporate approximately 416 square feet of Public Trust Area and Estuarine Waters. However, it is primarily located within a man-made basin and would not encroach into the channel, nor does it appear that it would it obstruct navigation. It would extend approximately 15' outside of the basin area, and 21' into the waterbody, which measures approximately 48' across at this point. It would not extend any farther across the waterbody, but would be extended an additional 4' out from the basin to minimize the area to be dredged. The co-applicant, Etta Rooks, is the only other riparian property owner along the canal with dock access, as the pier north of Ms. Rooks is not elevated and therefore blocks continued channel access except perhaps by kayak (the next riparian property owner accesses the AIWW from a channel north of the pier. The dock would not extend into either 15' riparian setback. We are proposing to remove the material utilizing the bucket to barge method. A hydraulic excavator will be utilized with a clamshell bucket. In order to prevent any damage to the surrounding marsh adjacent to the channel we are proposing not to dredge any closer than 5' to those areas. The material will also be removed in two passes to prevent sloughing. A silt fence will be installed around spoil area to prevent run-off. Once the spoil dewaters, it will be spread out and seeded. A small portion of the spoil will be used to backfill the proposed bulkhead. The purpose of relocating the pier, dock and lift is to get into deeper water away from the marsh. Currently, the existing bulkhead has deteriorated and has allowed the area under the dock and lift to shoal in. The proposed new bulkhead and relocation will help to prevent any filling and will also reduce the frequency of the need to dredge. Standard construction processes are proposed. { U i_ ?
