TROGDON, III SECRETARY Reference: Application for Section 404 Individual Permit and Section 401 Water Quality Certification for the proposed SR 1409 (Military Cutoff Road) extension and US 17 Hampstead Bypass in New Hanover and Pender Counties. TIP Nos. U-4751 & R-3300, submitted December 21, 2016 Dear Sir: NCDOT received public comments from your office on March 8, 2017 subsequent to the conclusion of the public comment period on March 2, 2017. Your cover letter indicated nine responses were received, two of which were resource agencies and the remainder from citizens along the projected corridor. Per your direction, the resource agency comments have not been addressed by NCDOT. Below you will find our responses to the seven citizen comments. As you noted, most of the citizen concerns were related to drainage and the unknown hydraulic structures for project construction. Furthermore, many of the comments were regarding R-3300. As indicated in our permit application, only preliminary design has been developed for R-3300. Therefore, at this time, little can be determined regarding any potential drainage issues for Mr. Ernest Bryant Jr., Mr. Mike Spahr, and Mr. Keith King's concerns. However, NCDOT's general drainage design practice is to maintain existing/established drainage patterns. Any outfall where potential project impacts are anticipated, a pre and post project conditions analysis will be made to evaluate what impact the project has if any on the outfall. This will have to be done during the design stage of the project. Any historical flooding issues at any of the sites that property owners can provide would be helpful during the design stage. Typically, during the field investigation the hydraulic engineer will attempt to obtain historical flooding information from nearby property owners, US mail carriers, local residents, and division personnel. Likewise, Mr. James Teachey's concerns with access to his property cannot be properly evaluated until the design period for R-3300 has initiated. Further public involvement will be coordinated during the process where his concerns can be addressed. Mr. Geoffiy S. Grimsman indicated he does not like selected R-3300 corridor and would prefer eastward shift to avoid impacts to neighborhoods of Island Creek Estates, Farm Road, and Deerfield. NCDOT implements the Merger Process on many of its large and complex projects to streamline project development and permitting processes with regulatory agencies and other stakeholders. Impacts to the "human environment" are given equal consideration to all other variables during the decision process. Effects to private properties, residences, and businesses are avoided and minimized to the greatest practicable extent. These minimization efforts will continue to be evaluated and incorporated during the design process for R-3300. Ms. Irene G. Van Travis has concerns about contaminates affecting the water supply. Along with the 404 permit, the North Carolina Division of Water Resources issues a Water Quality Certification to ensure protections to the water supply. NCDOT implements many design standards and best management practices to maintain the integrity and mitigate the risk of construction and post-construction related threats to ground and surface water. Finally, Mr. Thomas Skinner stated he would like the USACE to provide him a copy of the Public Notice. He also indicated he believes R-3300 will be an asset to the community.
