Alan,
I spoke with Dr. Bird again on the phone today. He says that the HOA has already legally
taken responsibility for the operation and maintenance of the BMPs. I explained that if we
were to issue an NOV for failure to properly maintain the BMPs, it would be addressed to the
responsible party, which is now the HOA. Dr. Bird seems interested in trying to figure out
whether the DWQ improperly approved the BMPs when the project was issued in 2002. Bev is
sending him a CD with all the file documents that we have on this project. Dr. Bird also
expressed frustration that the state seems to be "on the developer's side" and stated that
the HOA may take some kind of legal action against DWQ and/or the developer.
Dr. Bird mentioned some correspondence that has occurred between you and the developer
between January and March of this year. Can you please provide a copy of this as well as
any additional correspondence you may have on this project that has occurred since the
project was approved in 2002? It seems very important in this case that we have a complete
file on the project.

Regarding a storm water pond constructed several years ago. The HOA isn't happy with the
pond and wants to know what we are going to do about it. I informed the person that if the
pond was constructed per plan then it meets our requirements, any maintenance subsequent to
that is the owners responsibility. I think that is the issue. The pond hasn't been turned
over to the HOA, and before they take it over they want it fixed. I have been to the site
and they "fixed" the problem, but again, after a couple of rain events there are some
problems, thus the circle.....
