TIP U-2406. Attached is the application packet for the subject project. The North Carolina Department of Transportation (NCDOT) proposes to construct on new location the NC 100 Bypass of Elon College. The project extends from a proposed tee intersection with existing NC 100, 900 feet east of Cook Road, to the NC 100 - NC 87 intersection at Glen Raven, a total of approximately 3.0 miles. The proposed roadway consists of a two-lane, 24-foot roadway with 4-foot paved shoulders. The analysis of alternatives and the environmental impacts are discussed in an Environmental Assessment and Finding Of No Significant Impact, signed by the Federal Highway Administration (FHWA) on November 16, 1994 and October 31, 1995, respectively. The State Project Number is 8.2471101 and the Federal Aid Project Number is STP-MAM-M-5102(1). ENVIRONMENTAL IMPACTS Jurisdictional Wetlands. The project will impact 9 wetlands. Wetland delineations were conducted by NCDOT biologists using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. Ms. Jean Manuele from the USACE Raleigh office verified the wetland delineation on July 2, 1996. The Division of Water Quality (DWQ) rating system was applied to each wetland site. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin, 1979) system and the North Carolina Department of Environment, Health, and Natural Resources, Division of Environmental Management; 2 Field Guide to North Carolina Wetlands (Report No. 96-01, 1996). Table 1 shows the wetland communities, quality analysis, and acres of impact for each section of the project. TABLE 1. The forested sites (PFOI) and the scrub shrub site (PSS1) supported basically the same vegetation but in different successional stages. Tree species included sweet gum (Liquidambar styraciflua), red maple (Acer rubrum), willow oak (Quercus phellos), and black willow (Salix nigra). The shrub species included all the tree species, ironwood (Carpinus caroliniana), Chinese privet (Ligustrum sinense), black cherry (Prunus serotina), green ash (Fraxinus pennsylvanica), and Brookside alder (Alnus serulata). The herbaceous and vine layers contain seedling tree and shrub species, Japanese honeysuckle (Lonicera japonica), soft rush (Juncus effusus), sedges (Carex sp.), microstegium (Microstegium sp.), and poison ivy (Toxicodendron radicans). The herbaceous wetland (Site 1) was found along the power line easement portion of the wetland. Soft rush (Juncus effusus), sedges (Carex sp.), woolgrass (Scirpus cyperinus), Virginia chain-fern (Woodwardia areolata) and microstegium are the dominant vegetation in these areas. The "Acres Impacted" column in Table 1 reflects permanent fill, excavation, and mechanized clearing in wetlands and are further itemized in the summary sheets. The total impact for the project is 1.94 acres. Method III clearing, which is clearing 10 feet beyond the edge of the fill slopes, will be used throughout the project. Jurisdictional Surface Waters: Impacts to jurisdictional surface waters have been separated from jurisdictional wetlands. Ms. Cyndi Bell of the DWQ and you performed the stream jurisdictional delineations on February 26, 1998 and noted eleven jurisdictional surface waters, of which nine were mitigable. Table 2 lists the acres of impact and the linear feet of channel loss for the nine mitigable streams while the summary sheet (sheet 15 of 20) lists all eleven. Please note that the summary sheet also states a 0.09 acre pond (0.036 ha) will be filled. This pond has been previously drained and no longer exists. The total channel loss for the project is 2206 linear feet. However, 459 linear feet will be created on site, resulting in a net loss of 1747 linear feet of stream channel. TABLE 2. As of May 13, 1999, there were no threatened or endangered species listed for Alamance County. Cultural Resources. In a letter dated January 2, 1993, the State Historic Preservation Office (SHPO) concluded there were no historic properties within the area of potential effect (APE) eligible, either individually or as a complex, for the National Register. In a letter dated February 23, 1993, SHPO concluded the proposed roadway would not affect any significant archaeological resources. MITIGATION OPTIONS The USACE has adopted, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. Avoidance & Minimization. The NCDOT has employed many avoidance and minimization strategies that are detailed in the EA/FONSI. NCDOT was able to design most all of the crossings of surface waters (except Site 9) and wetlands at roughly perpendicular angles. In addition, 2:1 fill slopes were employed in wetlands and ditching 4 was successfully avoided in all areas except site 9. Stream relocations will employ the bioengineering techniques detailed in sheets 18-20 of 20. Compensation: NCDOT is proposing to pay the Wetlands Restoration Program (WRP) to provide the mitigation for this project. Specifically, a 2:1 ratio was used for both wetland and stream restoration resulting in 3.88 acres of wetland mitigation and 3494 feet of stream restoration. A copy of the letter requesting concurrence from the WRP is attached. It is requested that these activities will be permitted under a Section 404 Nationwide Permit 14 except for the crossings at sites 1 and 8 where a Nationwide Permit 26 is requested. By copy of this letter, we are also requesting a 401 General Water Quality Certification from the NC Division of Water Quality.
