APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Robusto:
You have our approval, in accordance with the attached conditions and those listed below, to
impact 0.36 acre of wetland in order to construct the Stone Creek Rand Subdivision in
Mecklenburg County, as described in your application received by the Division of Water Quality
(DWQ) on July 13, 2004. After reviewing your application, we have determined that this project is
covered by Water Quality General Certification Number 3402, which can be viewed on our web site
at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Nationwide
Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers. Please note that
you should get any other federal, state or local permits before proceeding with your project,
including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and
Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless
otherwise specified in the General Certification. This approval is only valid for the purpose and
design that you described in your application. If you change your project, you must notify us in
writing, and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter; and is
thereby responsible for complying with all conditions.
For this approval to be valid, you must follow the conditions listed in the attached Certification,
as well as the additional conditions listed below:
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional
wetlands and waters or areas within 50 feet of all streams and ponds on the property. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the
404 Permit (whichever is later). A sample deed notification format can be downloaded from the

2. The culverts required for this project shall be designed and installed to allow for aquatic life
movement as well as to prevent degradation of the wetland.
3. Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in wetlands
and waters is unavoidable, they shall be removed and the natural grade restored within six
months of the date the Division of Land Resources has released the project.
4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Preconstruction Notification application. All
construction activities shall be performed so that no violations of state water quality standards,
statutes, or rules occur.
5. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in
full compliance with all specifications governing the proper design, installation, and operation and
maintenance of such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the
most recent version of the North Carolina Sediment and Erosion Control Manual. The
devices shall be maintained on all construction sites, borrow pit sites, and waste pile
(spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
b. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
c. The reclamation measures and implementation of these measures must be in
accordance with the requirements of the Sedimentation Pollution Control Act.
6. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate
of Completion" form to the 401NVetiands Unit of the NC Division of Water Quality. Please send
photographs upstream and downstream of each culvert site to document correct installation along
with the CertiFicate of Completion form.
7. Continuing Compliance. Centex Homes shall conduct its activities in a manner consistent with
state water quality standards (including any requirements for compliance with section 303(d) of
the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ
determines that such standards or laws are not being met (including the failure to sustain a
designated or achieved use) or that state or federal law is being violated, or that further conditions
are necessary to assure compliance, DWQ may reevaluate and modify this certification to include
conditions appropriate to assure compliance with such standards and requirements in
accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify
Centex Homes and the US Army Corps of Engineers, provide public notice in accordance with
15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC
2H.0504. Any new or revised conditions shall be provided to Centex Homes in writing, shall be
provided to the United States Army Corps of Engineers for reference in any permit issued
pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404
Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

In accordance with 15A NCAC 2 H.0500, XXXXe of the Hinshaw-Pearson Company, Yarbrough-
Willliams-Houle Inc., has permision as outlined below to fill 0.36 acre of wetlands and 237 linear feet of
perennial streams in order to construct the Gilead Ridge residential subdivision in Mecklenburg County,
North Carolina. All activities associated with these authorized impacts must be conducted with the
conditions listed in the attached certification. THIS CERTIFICATION IS NOT VALID WITHOUT THE
ATTACHMENTS.

As required by 15A NCAC 2H .0506, and the conditions of this certification, you are required to compensate
for the above impacts through the restoration, creation, enhancement or preservation of wetlands as
outlined below prior to conducting any activities that impact or degrade the waters of the state.
Mitigation:
237 linear feet of perennial streams is required by the WRP for the 401 Water Quality Certification.
In correspondence dated July 8, 2003, the WRP indicated that up to 474 linear feet of stream
mitigation will be accepted by the WRP if necessary for the 404 Permit.
Note: Linear foot requirements proposed to be mitigated through the Ecosystem Enhancement Program
(EEP) must be rounded to the nearest foot and acreage requirements must be rounded to one-quarter acre
increments according to 15 2r.0503(b).
One of the options you have available to satisfy the compensatory mitigation requirements is through the
payment of a fee to the Ecosystem Enhancement Fund per NCAC 2R .0503. If you choose this option,
please sign this form and mail it to the Ecosystem Enhancement Fund at the address listed below. An
invoice for the appropriate amount of payment will be sent to you upon receipt of this form. PLEASE NOTE,
THE ABOVE IMPACTS ARE NOT AUTHORIZED UNTIL YOU RECEIVE NOTIFICATION THAT YOUR

Staff visited the site on July 29, 2004. Site is forest and agricultural fields. Sixteen acres of
wetlands were delineated at the site, Total proposed wetland impact is 0.36 acre.
There are five impact areas at the site located in the larger of the two wetlands that is nearest to
Tom Short Rd_ The main impact (0.282 acre) is for the construction of a road crossing. The
crossina is located in a narrow section that connects to larger wetland areas. The road is
aTpprox?y 60 ft wide. There is an additional 125 ft of impact that was not clearly explained by the
consultant. The application states that it is a city requirement, More information will be requested to
clari the impact.
The consultant has informed staff that riprap will be used at the upstream and downstream end of
the culverts only. The original plan appeared to show rip "blanketed" across the up and
downstream side of the road.
The remaining impacts are minor: two tem op rary sewer crossings (0.007 & 0.028 acre) and lot fill

SUBJECT: Review of an application by Centex Homes, Providence Cato Subdivision,
DWQ No. 040980, Unnamed Tributary Flat Branch, Mecklenburg County
The applicant is requesting 401 Water Quality Certification from the North
Carolina Division of Water Quality. The NCWRC has reviewed information provided by
the applicant, and field biologists on our staff are familiar with habitat values of the
project area. These comments are provided in accordance with provisions of the Clean
Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The project proposes to develop Stone Creek Ranch in a wooded and agricultural
area. Impacts are proposed due to sewer installation, new access roads and individual
home lot fill. Total wetland impacts are indicated to be 0.36 acres. This is indicated to
be a reduction from previous submittal impacts. Lot fill on two lots equals 0.045 acres.
Existing wetlands on the property are indicated to be 16.24 acres although approximately
six (6) acres are proposed to be protected/preserved in common open space and tree save
areas. This is indicated to provide preservation at a 12.5:1 ratio. Imperviousness is
indicated to be "estimated" to be less than 30%.
Based on our review of the submittal, it appears that impacts have been
minimized considerably; however, we are concerned about setting a precedent for
allowing fill for additional lots. We do not consider it necessary to fill these wetlands as
they can be left in a natural condition and permanently protected to provide stormwater
and water quality benefits as well as maintaining any existing habitat values.
Accordingly, lot fill (impacts 3 & 5) appears to be avoidable and is not recommended.

Instead, these areas and the total of all remaining waters and wetlands should be
permanently protected as undisturbed naturally vegetated (preferably forested) common
areas through deed restrictions or other enforceable methods. Wetland areas should be
protected or restored as undisturbed forested common areas to offset lost habitat values
and minimize unnecessary impacts. If the total impervious area is close to or exceeds
thirty (30) percent, these preserved wetlands could provide substantial stormwater
management as well as habitat benefits which may offset the potential need for
constructed stormwater management facilities.

Instead of using the typical fescue grasses or exotic plant species, the following mixtures should
be considered for lower elevation stormwater ponds and mine sites:

* When possible on slopes less than 3:1 use Switchgrass instead of lespedezas and on slopes greater than
3:1 use Orchard Grass or Creeping Red Fescue. Other native species may be appropriate depending on
soil, slope, and region. Korean lespedeza may be appropriate in colder geophysical areas. We do not
recommend Sericea lespedeza. Native plants and warm season grasses are preferred over exotic plants.
Add one of the following to the above mixture:
Creeping Red Fescue 5 lbs/acre
Ladino Clover** 5 lbs/acre
Atlantic Coastal Panic Grass 5 lbs/acre (PLS)
Alfalfa** 5 lbs/acre (requires fertilizer containing Boron)
** Lime & fertilize disturbed areas according to NRCS soil test results and follow planting guidelines as
appropriate and necessary. Depending on elevation and region, other native species may be appropriate.
Note that mowing should be limited to late winter or early spring. Mowing should only occur as needed to
prevent unwanted tree growth on a 2-3 year schedule.
The provision of shade around impounded waters can significantly reduce thermal impacts. Trees
and shrubs (I year bare root seedlings) should be planted randomly at a minimal rate of 100 trees
per acre on the top and upper portions of the structure and at a minimal rate of 150 per acre
around the normal water elevation and littoral shelf area. The following list of tree species may
assist in providing habitat benefits:

Other species may be utilized depending on site requirements and native plant availability. Pines* should
not exceed 15% of the reforestation. No more than 20% of the tree species will be of a single species. An
80% success rate is acceptable over five years. Large or fast growing trees like Sycamore and Maple**
may not be appropriate near detention facility dams. Note: Non-native plants included in this list are
routinely considered beneficial and/or agriculturally established non-natives. They have been included as
they are readily available commercially and they do not exhibit many of the negative attributes of other
non-natives that tend to spread or inhibit native plant propagation and survival.

Dear Ms. Jones and Mr. Dorney:
The purpose of this correspondence is to address the additional information request in a letter from the
NC DWQ dated June 29, 2004 and notify of revised impacts at wetland impact location #4. USGS, Soil
Survey, and wetland crossing details are attached. No streams are located at the crossing as implied
within your letter (additional info request 2.) There is a ditch through the wetland characterized by
significant spoil piles located immediately adjacent to the ditch; However, the attached detail shows that
an individual culvert located near the existing ditch will be buried to accommodate for the flows if they
are to occur through the ditch. The amount of area to be impacted by the crossing #4 has been
reduced by approximately 5000 spare feet in order to minimize impacts. This reduction has been
accomplished by reducing the areas of temporary impact for construction activities and is the absolute
minimum area needed to comply with City of Charlotte Engineering requirements. A copy of the
wetland delineation map is enclosed for your use.

On June 17, 2004, the Division of Water Quality (DWQ) received your application dated May 21, 2004 to
impact 0.48 acres of wetlands or waters to construct the proposed residential subdivision. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional
information requested below, we will have to move toward denial of your application as required by 15A
NCAC 211.0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Please provide location map for the project including a USGS 1:24, topo and county soil survey
map.
2. Please provide cross section details for the stream crossing showing the provisions for aquatic life
passage and how wetland hydrology will be maintained.
3. Please address whether the road crossing can be redesigned to minimize wetland impact.
4. Please provide a signed delineation map form the Corps of Engineers showing jurisdictional
wetlands and streams.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Alan Johnson of the DWQ Mooresville Regional Office. If we do not hear from you within three
weeks, we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.

The purpose of this PCN is to request authorization for proposed impacts to regulated Waters of the
U.S. and waters of the State for the above referenced project Impacts are requested under Nationwide
Permit 39 and its WQC as a single and complete project for the purpose of constructing the proposed
residential subdivsion (see attached application forms and maps).
Minimization and avoidance has been achieved through exhaustive redesign efforts based on the
previously approved delineation. No regulated channels are to be impacted and less than 1 /2 acre of

Attach a vicinity map clearly showing the location of the property with respect to local landmarks such
as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and
development plans in relation to surrounding properties. Both the vicinity map and site plan must include
a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and financial
viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and
explain why these design options were not feasible. Also discuss how impacts were minimized once the
desired site plan was developed. If applicable, discuss construction techniques to be followed during
construction to reduce impacts.
Impacts are assessed to be minimal. Exhaustive measures have been taken to produce many site
plans to minimize and avoid impacts to areas identified as wetlands on approved wetland
delineation maps.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of
Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands
or greater than or equal to 150 linear feet of total impacts to perennial streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits,
published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure

that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed
impact and function and relative value of the impacted aquatic resource will be considered in determining
acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be
appropriate and practicable include, but are not limited to: reducing the size of the project; establishing
and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and
replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving
similar functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order for
USACE or DWQ to consider the application complete for processing. Any application lacking a required
mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also
choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for
Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.htm1.
Provide a brief description of the proposed mitigation plan. The description should provide as much
information as possible, including, but not limited to: site location (attach directions and/or map, if
offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed
(restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed
restrictions, conservation easement, etc.), and a description of the current site conditions and proposed
method of construction. Please attach a separate sheet if more space is needed.
Preservation at a 12.5:1 ratio of approximately 6 acres of higher quality wetlands than those to
be impacted within areas identified as wetlands on the approved wetland delination maps are to
be protected / preserved in common open space and tree save areas with no future impacts.
