On June 23, 2008, the Division of Water Quality (DWQ) received your After-The-Fact
application dated June 16, 2008, to fill or otherwise impact 0.21 acres of 404/wetland to
construct a residential development at the site. On August 5, 2008, the DWQ received additional
information from you, however, the DWQ has determined that your application remains
incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or

You have applied for a Nationwide Permit No. 29 from the USACE and corresponding General
Certification No. 3705 from the NC DWQ. The Nationwide Permit No. 29 per the USACE
website is utilized to permit "Single Family Housing". You did not provide adequate responses
to the requests cited below that were contained in our July 7, 2008, Request For More
Information correspondence to you.
Please re-submit your site plans on full plan sheets at a scale of no smaller than 1"=50'
with topographic contours shown.
2. Please indicate proposed lot layout as an overlay on the site plan.
3. Please locate any planned sewer lines on the site plan.
4. Please indicate all wetland impacts including fill slopes on the site plan.

as overlays on the site plan.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina
