Dear Mr. Stancil:
On March 26, 2008, the Division of Water Quality (DWQ) received your application dated
March 26, 2008, to fill or otherwise impact 0.096 acres of 404/wetland, 124 linear feet of
intermittent stream, and 6,923 square feet of Zone 1 Neuse River basin protected riparian buffers
and 3,356 square feet of Zone 2 Neuse River basin protected riparian buffers to construct a
residential subdivision at the site. On May 16, 2008, and June 27, 2008, the DWQ received
additional information from you, however, the DWQ has determined that your application
remains incomplete and/or provided inaccurate information as discussed below.
The following items listed in the June 20, 2008 Request for More Information Letter were
omitted from the most recent submittal:
1. Delineated drainage basins,
2. Details of the high flow bypass system,
3. Boundaries of the drainage easements for all three bioretention areas,
4. Clean-out pipe locations, and
5. A pretreatment system,
Other deficiencies in the resubmittal included the inadequacy of the construction sequence and
the failure to remove the baffles from the bioretention cells as requested.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
