Expected pond surface area: 2.85 ac. VII. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. See Attachment I VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 9 of 12 freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmizide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation will be handled by deed restriction. See restrictive covenant guidance sheet 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. Future Project Plans The owner owns a total of 104 ac. at the site. The 42.75 ac. tract south of Crystal Beach Road will not be developed at this time. Proposed Impacts to Waters of the United States/Waters of the State 1). Provide a written description of the proposed impacts: Three impacts to wetlands will be required to develop this site into single family residential lots. These proposed impacts are: (W1) 1,419 square feet (0.032 ac.) at Rabon Court station 6+00 for the construction of the road to gain access to the SE corner of the property. (W2) 2,249 square feet (0.051 ac.) at Sylvia's View SE end of road for filling/grading in order to construct driveways for lots # 29 and #30. (W3) 111 square feet (0.003 ac.) at the North end of the Open Space lot for trenching the sanitary force main. All impacts are permanent. VII. Impact Justification (Avoidance and Minimization) Avoidance measures: Impact area W1- in order to gain access to the SE corner of the property the wetlands have to be crossed. The road was placed in this position to minimize the wetland impact, only catching the end of the wetland finger. If we moved the road and road side swales outside the wetlands then we would not have enough room for on-site septic for lots 56-58. Impact area W2 - in order to gain access for lots 29 & 30 we had to cross the wetland pocket. With the location of the wetlands and no other access to these lots, this was our only option. Impact area W3 - in order to serve lot 22 we had to cross the wetlands with the sanitary force main to the designated septic lot in the open space area. Page 1 of 3 Tripp Landing Beaufort County Minimization measures: The culverts under the road at wetland impact 1 were placed west of the wetland finger in order to have room for the sediment trap outside the wetlands. After site is established with permanent seeding, the sediment trap will be converted into (2) two scour holes also outside of the wetlands. The driveways providing access to lots 29 & 30 will be piped in order to allow flow from one end to the other on the wetland pocket. Grading from the driveway down to the wetland pocket will be minimized by using minimal cover over the pipes and minimal shoulder width on each side of the driveways. The force main crossing at wetland impact 3 will be minimized by using a small trencher to reduce the trench width for pipe installation. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. b. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. c. The Permittee shall preserve and maintain the remaining DA jurisdictional wetlands and waters identified on the attached plat titled plat titled Tripp Landing., signed and sealed by Anthony Hamm on 10/10/2007. All present and future lot owners are prohibited from performing any of the following activities on the property: Filling; grading; excavating; earth movement of any kind; construction of roads, walkways, buildings, signs, or any other structure; any activity that may alter the drainage patterns on the property; the destruction, mowing, or other alteration of vegetation on the property; disposal or storage of any garbage, trash, or other waste material; or any other activity which would result in the wetlands being adversely impacted or destroyed. d. Permittee shall execute and cause to be recorded in the Beaufort County Register of Deeds restrictive covenants acceptable to the Corps of Engineers for the purpose of maintaining the remaining wetlands, as shown on the plat titled Tripp Landing, signed and sealed by Anthony Hamm on 10/10/2007, in their natural state in perpetuity, prior to the sale or conveyance of any lots or other property within the subdivision. The permittee shall enforce the terms of the restrictive covenants and, prior to conveyance of the property, shall take no action on the property described in the covenants inconsistent with the terms thereof. The permittee shall provide a copy of the recorded restrictive covenants to the Corps of Engineers within 15 days of recording. 2 e. The above deed restrictions applies to the property identified by PIN # 6621-86-1817 as recorded in the Beaufort County Register of Deeds on the date of this letter. The jurisdictional determination referenced in this permit represents a portion of the entire property identified as PIN # 6621-86-1817.
