On April 24, 2008, the Division of Water Quality (DWQ) received your application dated April
23, 2008, to fill or otherwise impact 0.37 acres of 404/wetland, 10 linear feet of intermittent
stream, 0.50 acres of open water (pond), and 1,800 square feet of Zone 1 Neuse River basin
protected riparian buffers and 1,200 square feet of Zone 2 Neuse River basin protected riparian
buffers to construct the proposed residential development at the site. On May 30, 2008, and
July 25, 2008, the DWQ received additional information from you, however, the DWQ has
determined that your application remains incomplete and/or provided inaccurate information as
discussed below. On June 25, 2008, the DWQ sent you correspondence requesting the
following:
As the chart on Sheet I illustrates, there are numerous high density drainage areas on
this site. Per the requirements of GC 3705, these drainage areas must comply with
Stormwater Management Plan (SMP) Requirements for Applicants Other Than the North
Carolina Department of Transportation, available at:

nNCDOT. pdf For each high density drainage area, please include an SMP that removes
a minimum of 85 percent TSS and 30 percent TNfrom the stormwater generated by this
project. For each proposed BMP, please provide a completed BMP Supplement Form,
with all the required items. The BMP Supplement Forms are available at the following
web site: ham: //h2o. enr. state. nc. us/su/bmpforms. htm.
2. Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from
this site must be discharged through a correctly designed level spreader. Level spreader
design requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP

3. Please provide one Level Spreader Supplement Form for each proposed level spreader,
available at: http://h2o,enr.state.nc.us/su/bmp forms htm. Please include the Required
Items checklist and all items listed therein.
Your response to each of these requests was the same, "The engineer for this project is
currently working on the stormwater plan." This response is not acceptable.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina
