1 have enclosed a set of plans, a PCN application for NWP #14, and a vicinity map relative to the
proposed bridge replacement project on SR 1402 Jim's Creek Road, Yancey County, NC.
We propose to replace the existing 18' timber bridge with a double barrel box culvert
(2@10'x4'x45') with a low flow barrel with baffles. Stream slope at the site is 4.2%. Cross
vanes will be installed to maintain channel dimension and profile. Culvert installation will result
in permaneut impact to 45 linear feet of Jim Creek with an additional 45 linear feet of floodplain
bench/cross vanes. Temporary impacts to 102 linear feet of the stream are necessary for
dewatering/diversion and a temporary detour (2@54"x 38')during construction. The stream is
approximately 9 feet wide with gravel, cobble, and boulder substrate. Jim Creek is classified as
Class C, Trout.
Existing channel morphology will be maintained upstream and downstream of the culvert.
Riparian vegetation will be reestablished along disturbed areas associated with the project.
Stormwater will be dive�rted through grass-lined ditches or vegetated buffers prior to entering
streams.
This project may impact potentially suitable northern long-eared bat (Myotrs septentrionalis)
(NLEB) summer roosting habitat via tree clearing. Following the SLOPES from N W P Regional
Condition 3.13, the project is located outside of a red HUC and a survey found no evidence of
bat presence/usage at the site. A total of 2 trees will be cleared for the project. No effect on the
remaining Yancey County list of federally protected species (threatened or endangered) or
designated critical habitat will occur. Marella Buncick of the USFWS is be copied on the
application since Yancey County tributaries drain to Designated Critical Habitat stated in NWP
Regional Condition 2.1.

As a part of the 401 Certification process, the project was processed through the DOT
Programmatic Agreement for Minor Project as required by Section 106 of the National
Flistoric Prese�vation Act of 1966 and GS 121-12(a). No Historic Resources will be affected.
These forms are attached for the Corps file.
By copy of this letter, we request Marla Chambers, North Carolina Wildlife Resources
Commission Western Region Coordinator, to comment directly to the Corps concerning the
pennit request.
By copy of this letter, we are asking the Area Roadside Field Operations Engineer, to comment
on the above project. Jim Creek is classified as Class C, Trout.. The project will not require a
trout buffer variance.

Replace the existing 18 timber bridge with a double barrel box culvert (2@10'x4'x45') with low and high flow barrels with
sills and baffles.

A permanent impact to 45 linear feet of Jim Creek will be necessary for culvert installation with an additional 45
linear feet of impact for floodplain bench and cross vane installation. In addition, a temporary impact to 102 linear
feet will be necessary for an impervious dikeldiversion to dewater the work area during construction. A temporary
detour (2@54"x38' Pipes) will be installed that is within the 102 linear feet of temporary impact since the site is on a
dead end road without other access. Equipment used will include excavator, crane, and trucks.

The purpose of chis letter is to notify you that the North Carolina DepaMment of Environmen[al Quality -
Division of Mitigation Services (NCDEQ-DMS) will provide the compensatory stream mitigation for the subject
project Based on the information received from you on March 24, 2017, the impacts are located in CU 06010108 of
the I'rench Broad River basin in the Northern Mountains (NM) Eco-Region, and are as follows:

F.3.c.iii of the In-Lieu Fee Instrument dated July 28, 2010. If the above referenced impac[ amounts are revised, then
[his mitigatlon aceeptance letter will no longer be valid and a new mitigation acceptance letter will be required from
NCDEQ-DMS.
