Erica,
This is in regards to DOT's request this week to renew the permit & certifications
for the project, 9-39116 in Wake County. Since, according to your letter, the 404
does not expire until August 31, 2008, as long as the COE extends it before that day
then you do not need a 401 re-issuance. (We'll cancel out the application fee debit,
as well.)
If, for some reason, by August 31 the 404 has not been extended and does expire, let
us know and we'll do a re-issuance then.

Dear Sir:
The North Carolina Department of Transportation (NCDOT) has been issued Nationwide 23/33
and 14 and GP 31 permits from the U.S. Army Corps of Engineers (USACE) for projects 13-
3916, R-2904, U-3344A and U-4010. Project construction in jurisdictional areas will not be
completed by the permit expiration date, therefore, we are requesting permit re-issuance.

The Section 404 permit for U-3344A was issued by default, as the U.S Army Corps of Engineers
review time period exceeded 45 days (per Nationwide Permit General Conditions number
13,a.,3). NCDOT will comply with all conditions, descriptions, and mitigation allowance in the
attached permit application dated 3/3/06, PCN form, Permit Drawings, 404 General Conditions
and EEP mitigation acceptance letter.

Application is hereby made for re-issue of the USACE 404 permits and DWQ 401 certifications.
All permit drawings and plan sheets submitted with the original applications are current and do
account for the entire scope of the projects. All environmental commitments and special
conditions referenced in the Permit Applications will continue to be followed throughout project
construction.

The NCDOT will also continue to adhere to all general conditions set forth in the 401 General
Water Quality Certifications (WQC) 3701, 3688 and 3704. All general conditions of the Water
Quality Certifications will be met. Written concurrence is only required for B-3916, R-2904, and
U-3344A, therefore we are providing five copies of this application to the North Carolina
Department of Environmental and Natural Resources, Division of Water Quality for their review.
