SUBJECT: Landstar Development - Alpine Creek Development, Cranberry Creek and
Tributaries thereof, DWQ No. 2008-0537 version 2, Avery County
The applicant has corrected a previous discrepancy about the amount of impacts for a proposed
culvert. Biologists with the North Carolina Wildlife Resources Commission are familiar with
habitat values in the area. These comments are provided in accordance with the provisions of the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the
North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25).
The application now indicates an impact of 39 linear feet for Culvert # 16. As previously
indicated in our earlier review, Wild Brown trout are known for Cranberry Creek.
Based on our review of the recent 401 Certification application and our conversation (July 28,
2008) with Linda Wiggs (DWQ-ARO), we will not object to the culvert providing that
recommended conditions, including the trout moratorium in our comments of March 27, 2008
are following as appropriate. If practicable for this culvert, aquatic and terrestrial life passage
(crayfish, salamanders) should still be encouraged by 1) using a properly sized rough-walled
CMP instead of smooth-walled plastic piping, 2) cutting the end of the pipe so that it is flush
with the sloped bank and 3) provision of a riprap channel beneath the culvert to the lip of the
CMP in a manner that improves potential migration to and through the culvert.
