Authorizing development in Carteret County at adi. to Bogue Sound and Huff Gut at 493 Broad
Creek Loop Rd in Newport , as requested in the permittee's application dated 2/19/08 (MP-1 and MP-21 and
1/11/08 ( MP-3) , including the attached workplan drawings (3), 1 dated revised 2/18/08, 1 dated revise 5/20/08, and 1 dated revised 6/4/08
This permit, issued on July 31. 2008 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) In accordance with commitments made by the permittee, in order to address concerns of the Division
of Marine Fisheries (DMF), deed restrictions shall be placed on all lots requiring the utilization of
rain barrels to collect a portion of runoff from each main residence. In addition, the remaining gutter
downspouts shall use splash blocks so that direct roof runoff shall flow over grassed yards, and all
driveways shall be pitched away from house and left or right depending on grade. These deed
restrictions shall be recorded with the Carteret County Register of Deeds, and copies provided to the
Division of Coastal Management prior to the initiation of any development authorized by this permit.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2011

2) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including but not limited to all roads,
sidewalks, utilities, and infrastructure associated with the 12-lot subdivision, all as expressly and
specifically set forth in the attached permit application and workplan drawings. Any additional land
disturbing activities and/or construction may require a modification of this permit. Contact a Division of
Coastal Management representative at (252) 808-2808 for this determination.
Retaining Wall
3) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
4) The retaining wall shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except for that
which may be required for the construction of the retaining wall, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
5) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
6) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the retaining wall immediately following completion of backfilling activities.
Stormwater Management
7) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW8 061207 on 12/7/06. Any
violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit.
Water Ouality
8) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality
Certification No. 3705 (DWQ Project No. 08 0368), which was issued on 7/4/08. Any violation of the
permit approved by the DWQ shall be considered a violation of this CAMA permit.

ADDITIONAL CONDITIONS
General
9) No open water areas or vegetated wetlands shall be excavated or filled, even temporarily.
10) No wetlands shall be excavated or filled outside the area indicated in the attached workplan drawing.
11) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party
without the written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under NWP 18 (COE Action
Id. No. SAW-2006-00792-016) which was issued on 7/2/08.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252)-808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
