Perry, 2216 NC 45N, Colerain, NC 27924 Authorizing development in Bertie County upstream of Perry's Beach on the Chowan River, off NC Hwy 45 and Bull Pond Rd near Colerain, as requested in the permittee's application dated 12/26/07, including the attached workplan drawings (3) all dated 12/26/07. This permit, issued on July 31, 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The riprap alignment shall approximate the normal water level at the time of construction. 2) The alignment of the permitted riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2011 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Perry Permit #,114-08. } Page 2 of 4 ADDITIONAL CONDITIONS 3) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 4,) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Riprap Groins 5) The riprap groin shall not extend more that 25 feet waterward of the normal water level. 6) The height of the riprap groin shall not exceed 1 foot above normal water level. 7) The riprap groin material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 8) The riprap groin material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Upland Development 9) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities, including any development and/or construction associated with the 8 residential lots, may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 264- 6481 for this determination. Sedimentation and Erosion Control 10) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 11) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms). At a minimum, a silt fence shall be properly installed immediately waterward of the area to be excavated prior to the initiation of an excavating activities. 12) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Perrv Permit # 114-08 Page 3 of 4 ADDITIONAL CONDITIONS Stormwater Management 'w f Y 13) The Division of Water Quality approval of this project under stormwater management rules of the 4 Environmental Management Commission is covered by way of Stormwater Permit No. SW7080203, which was issued on 5/22/08. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. f Archaeological Assessment 14) Prior to initiation of any ground disturbing activities, the permittee shall arrange for a comprehensive archaeological survey and evaluation of the entire project area of approximately 18.18 acres. A professional archaeological consultant shall undertake this work. The purpose of this work shall be to relocate Site 31DR2, along with any additional sites, and to identify and evaluate those sites, which may be eligible for listing on the National Register of Historic Places (NRHP). In addition, this work should determine whether such sites may be adversely affected by the project activities; and, if so, to develop and implement an appropriate mitigation plan. All activities associated with the archaeological investigations shall be conducted in close coordination with the Office of State Archaeology (OSA). Consultation with the OSA by the consultant shall take place prior to the commencement of any fieldwork. Written notice from the OSA of the satisfactory completion of this condition shall be submitted to DCM prior to initiation of any development activities authorized by this permit. General 15) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 16) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 17) No vegetated wetlands shall be excavated or filled, even temporarily. 18) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Lucille J. Contact a representative of the Division at (252) 264-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 08-0248), which was issued on 3/25/08. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198000291 (COE Action Id.
