Gate City Baptist Church contracted with ECS to assist them in restoring the stream buffer, stabilizing the area adjacent to the stream and securing a NWP and a 401 Water Quality Certification. ECS personnel met at Gate City Baptist Church with Ms. Sue Homewood with the North Carolina Division of Water Quality (NCDWQ) and Mr. Williams with the USACE on April 18, 2008. During the meeting, it was determined that the stream and stream side buffers must be restored to natural or near natural conditions. The most degraded areas will require in-stream grading. Vegetative plantings will be required along the stream bank and in buffers around the stream. Grading and seeding will be required to stabilize the stream banks and buffers. Following restoration activities, the agencies will not allow mowing in buffers around the stream so that these areas can naturalize. ECS submitted an application dated June 23, 2008. A response from Mr. Andy Williams with the US Army Corps of Engineers (USACE) was received on July 29, 2008 (attached). This application is an update to the former application and addresses Mr. Williams's remarks. 1) The initial application was unsigned. A signed copy of the pre-construction notification form is included. 2) The initial application indicated 380 linear feet of stream impact. Drawings 1 and 2 indicated more than 600 linear feet of impact. The drawing scales were incorrect. Approximately 4 cubic yards of fill (sandbags) will be placed in the stream channel. These temporary impacts were not included in the initial application. The updated application includes the temporary impacts. Once construction of the project has been completed, the sandbags will be removed and the area where the sandbags were located will be returned to pre-construction contours. Construction Plan A restoration plan has been prepared based on the field visit with Mr. Andy Williams and Ms. Sue Homewood. The stream banks will be graded, seeded and covered with reinforced turf matting for stability. Log drops will be installed to stop head cutting that has began at the downstream portion of the restoration area. One eroded downstream bank area will be rebuilt. Unsuitable soils must be removed from this area until a suitable base is encountered. The rebuilt bank will be seeded and covered with reinforced turf matting. Erosion gullies that have formed on the site will be graded and an erosion control berm will be installed so that the erosion control gullies do not reappear. All disturbed areas will be reseeded and mulched. See the attached Drawings 1 through Drawings 4 for the site layout, construction sequence, construction and erosion control details and seeding and planting details. Planting Plan A thirty foot streamside buffer will be planted. A listing of acceptable species in the piedmont region is attached. The quality, size, genus, source, species, and variety of tree and shrub plantings indicated should comply with applicable requirements of ANSI Z60.1 "American Standard for Nursery Stock". Seedlings should be planted between October 15th and March 15th only. See the attached drawings for the area that will be replanted. The plantings shall be performed as follows: Containerized Seedlings and Bare Root Seedlings: The seedlings shall be containerized one-gallon or three-gallon trees and shrubs. The seedlings should be planted at a density of approximately 470 stems per acre to ensure the target density of 320 stems per acre is achieved at maturity. A mixture of shrubs and trees shall be planted in the vegetative buffer area with predominately shrubs along the stream bank and predominately trees further away from the stream. To achieve the desired density, the approximate planting density to be used is 8' x 8' spacing. If, at the end of one year after planting, the number of viable trees present within the planted area is insufficient to provide a target density of no less than 320 trees/acre at maturity (approximately five years), additional trees should be planted to ensure that the target density objective is reached. Monitoring Plan Based on the field visit with Mr. Andy Williams and Ms. Sue Homewood, vegetative plantings and stream work must be monitored and reported after the first year of construction/planting. Throughout the first year after construction, ECS plans to perform visual reconnaissances to evaluate the success of the restoration. ECS will document the visits with photographs and evaluate the area for evidence of stream and bank erosion and other damages. In addition, ECS will conduct a complete stem count of planted vegetation to determine the success rate of the vegetative plantings. Photographs and findings will be presented to the USACE and the NCDWQ. A stream restoration project is currently planned in response to a Notice of Violation dated February 6, 2008 for stream standard violations and failure to secure a 401 Water Quality Certification. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
