NCDOT, Division 1 113 Airport Drive Suite 100 Edenton, NC 27932 Dear Mr. Jennings: This letter is in regards to the Avon/Kinnakeet Sand Mine Expansion in Avon, NC. As you may be aware, a variance was issued by the North Carolina Environmental Management Commission (EMC) on August 14, 2006 to allow for the excavation of 6.16 acres of 404 jurisdictional wetlands. Condition 8 of the variance states that: "All sand materials mined from the expansion area are to be stockpiled for the exclusive use of the North Carolina Department of Transportation for use in road stabilization activities on Ocracoke and/or Hatteras Islands." The application for the variance contains a letter dated June 15, 2006 from Department of Transportation board member Stan White to the North Carolina EMC. In the letter, Mr. White states that: "Without stockpiled material from this site that is readily available at moments notice, I am afraid that NCDOT will be unprepared for the eventuality that looms." Currently, a significant amount of this material is not stockpiled above ground, but has been deposited in an adjacent pit that had been previously mined. In order to ensure that the requirements of the variance are being met, DWQ requests clarification on whether this method of stockpiling the material is adequate to meet DOT's needs of being "available at moments notice". Please respond in writing if this is acceptable or whether changes in how the material is stockpiled should be made.
