This letter is in response to the Notice of Violation & Intent to Assess Civil Penalty that
the Kerr Lake Regional Water System/City of Henderson NC received for the Month of
December 2016. At the time of this violation, our lab analyst of twenty-five plus years had
retired. The Operator that was performing the decant sampling for the plant is still in the learning
phase and there was confusion on the correlation between Turbidity and Total Suspended Solids.
To remedy this incident and insure that it does not happen again, we have temporarily
transferred an employee with ten plus years of experience in the industry to the lab in order to
further the knowledge of the sampling and testing parameters with the Operator. With this
change and more oversight of the lab procedures and requirements, this should ensure that this
type of violation does not occur in the future.

The City of Henderson/Kerr Lake Regional Water Facility regrets the violation occurred
and as mentioned above, has taken additional steps to insure compliance. Due to the KLRWP's
favorable track record relative to compliance, we do not believe that a civil penalty assessment is
warranted.
