PROJECT SUMMARY: The applicant proposes to renovate the Calico Jacks Marina, reducing the slip count by 6, replacing a portion of the bulkhead, and performing maintenance excavation of the basin and access channel. 9. Narrative Description The applicant is the new owner of the Calico Jacks Marina located on the southeast side of Harker's Island. This property is located adjacent to Back Sound at 1698 Island Road in Carteret County. The site currently houses a 45-slip marina, ferry service to Cape Lookout, motel, parking, ship store, and commercial boat ramp. The 263 linear feet of shoreline is presently stabilized by a timber bulkhead, with further marina stabilization in the form of a breakwater located under the docks. The total tract size of the Calico Jacks property is 1.73 acres, and the site averages Calico Jacks Page 02 +5' nhw in elevation. The property is unzoned. Presently, this property is serviced by Harker's Island Community Water, and utilizes a private septic system. The existing marina was developed prior to the implementation of the CAMA, and has received several permits through the years for maintenance excavation and minor modifications to the marina. The riparian corridors to this marina extend historically with the outer edges of the existing docking system. The marina is currently situated adjacent to the corridors, with no setback in place. The existing boat ramp is located to the west side of the property, and the docks surround the marina on all four sides with a 56' opening on the waterward side. The ship store is located beside the ramp, and will remain as-is. Fuel service is presently provided for ferryboats and slip occupants. Parking is located to the west of the motel, which is configured perpendicular to the shoreline in the middle of the property. The septic system is to the east of the motel, and until recently, the far east side of the property was used for R/V parking. Parking for the marina also exists on the north side of Island Road. There is no clear evidence as to how far the original access channel was excavated, however aerial photography suggests that it was not excavated more than ±250' to ±300' offshore. The federal channel extends through Back Sound at the marina location, several hundred feet offshore. Current soundings within the basin average -2.6' nlw, and in the access charnel -3.7' nlw. There is no submerged aquatic vegetation within or adjacent to the project area, nor is there coastal marsh or other wetland species. The Carteret County Land Use Plan classifies this site Limited Transition, with AEC's classified as Conservation. The water quality classification within Back Sound is SA, with the added protection afforded ORW's. Back Sound is not designated Primary Nursery Area, and the waters within and immediately around the marina are closed to the taking of shellfish for consumption. No shellfish are visible within the marina. Bottom composition in this high-energy area is predominantly sand. Back Sound is ±2.5 miles wide at the project location. Uses on the properties of Back Sound east and west of Calico Jacks are exclusively residential, with residential docks. The first dock to the east of the site is approximately 75' away, while the first to the west is in excess of 100' away. Several hundred feet to the east of the site lies the National Park Service Cape Lookout headquarters and museum. The applicant applied for and received CAMA Minor Permit #464-08 for the conversion of the motel and R/V parking area to a 94-space dry stack building with mobile travel lift. This was stand-alone development intended to be in operation prior to the development proposed in this application. Legal actions have prevented the majority of that development from being constructed to date. 10. Project Description: The applicant proposes to renovate the existing marina. The bulkhead along the northern shoreline would be replaced in two locations. Stabilization in the form of a 34' concrete vertical bulkhead would be constructed across the existing boat ramp, removing this feature. Along the east side of the property, a new 100' section of concrete vertical Calico Jacks Page 03 bulkhead would be replaced. Both sections of wall would average 2' from the existing wall or nhw contour, with no more than 5' offset from same at any point. Tieback and deadman installation would disturb approximately 10' of high ground along the structure. The existing boardwalk to the east, west, and along the shoreline of the site would remain, as would the breakwaters. Six new piers are proposed: Dock A is proposed for 163' x 5', and would extend along the western breakwater and boardwalk, providing 8 slips to its east, inside the basin. Four slips would be 34' x 15', with 14' x 16' boatlifts, and 4 slips would be 28' x 12', with 13' x 14' boatlifts. Between the slips would be two 34' x 3' finger piers and two 28` x 3' finger piers. A waiver has been obtained from the western adjacent riparian property owner for the docks to be reconstructed in their present location, up to the dividing riparian corridor line. Dock B is proposed for 90' x 5', and is located along the shoreline, providing four 40' spaces ranging from 16' to 20' in width, defined by 5 mooring pilings and a single 20` x 3` finger dock. At the east end of Dock B is a 21' x 16' access platform and transient dock for loading. This is the area of the permitted travel lift. At the west end of this dock is a 19' x 14' platform for access and loading of the ferryboat, allowing this existing service to continue. Dock C is proposed for 191' x 8', providing dockage on both sides in the form of six 14' x 16' boatlifts, and six 13' x 14' boatlifts. The west side slips would be defined by three 34' x 3' finger docks, and the east side would be defined by four 28' x 3' finger docks. This dock, Dock C, would connect to Dock B at the north end, and would have a 68' x 8' platform at the waterward, or southern end. This platform would serve as the fueling dock. Dock D would be located along the eastern side of the property, parallel and 15' from the eastern breakwater and boardwalk. This dock is also labeled Dock C on the plats, but each slip is labeled with a D. The applicant was unable to secure a waiver of the riparian setback in order to replace the docks in their present location. The dock will extend for 190' at a width of 5', and will provide docking to its west, inside the basin. The 12 slips would be defined by six 3' x 26' finger docks, and one 3' x 27' finger dock. Each will have a 13' x 14' boatlift. All development on this side is proposed 15' from the neighboring riparian corridor. Lastly, there is transient Dock E on the landward side of the basin, connecting to Dock D, and amounting to 78` x 4` in an "L" configuration. This loading dock is in the area of the permitted travel lift as is Transient Dock D. Both are to support the launching of boats from the permitted dry-stack storage building. When completed, the docking system will provide 39 wet slips (6 less than presently offered) in which 35 will have boatlifts, 2 transient platforms for the travel lift, a platform for fueling, and a platform for the ferry boats. Total incorporated area is 59,340 sf, with 6,824 square feet of shading. The proposed boats to be served will be 24'-40' in size. To support ingress and egress, the applicant proposes to perform maintenance excavation to the marina and access channel to the depth of the connecting waters, or -4' nlw. The boat basin area to be dredged is 245' x 230', with existing soundings averaging -2.6' nlw. The access channel averages 42' x 200'. with current soundings averaging -3.7' nlw. The 8400 sf area to be dredged to -4' nlw will require the removal of approximately 93 cubic yards of sand, also by bucket to barge. The total 3015 cubic yards of sand to be removed are to be placed on an upland location to be determined through the project bidding process. The permit would be conditioned to require that the spoil site be pre-approved for location, size, and suitability. Spoil storage should utilize approx. 20,000 sf of high ground area. The applicant has committed to install a portable wastewater pumpout, place "No Field Discharge Allowed" signs at the entrance to each of the 4 main docks, place "Pumpout Available" signs at the same locations, and to limit overnight docking to one week through marina policy. No onsite vessel maintenance will be conducted. 11. Anticipated Impacts: The proposed bulkhead should require that approximately 1340 sf of high ground be disturbed for securing tiebacks and deadmen. Approximately 268 square feet of shallow bottom habitat will be filled with this shoreline stabilization feature, all within the existing basin area. The proposed marina will provide 6 less slips than does the existing marina, for a final slip count of 39. Boatlifts will keep 35 of the vessels out of the water. With the. CAMA Minor. Permit previously issued, there will also be 94 dry stack spaces to utilize this marina. The existing commercial boat ramp will be closed with this proposed development. The marina will incorporate approximately 59,340 square feet of Public Trust Waters, all of which has been historically incorporated, and will shade approximately 6824 square feet of same. Platform area along the 263' of shoreline will be 4297 square feet. The entire system will be relocated 15' west of the eastern breakwater to address the riparian corridor setback. No hazard to navigation will be brought about by this development. Excavation of the basin and channel will disturb approximately 64,750 square feet of sandy shallow bottom habitat, removing approximately 3,000 cubic yards of material from the system. Turbidity within these Outstanding Resource Waters will be increased during the bucket to barge dredge activity, but should be short lived. Because of the heavy sand consistency of the substrate, turbidity should quickly settle, and not introduce significant fines into the water column. Dredging of this basin and channel will not cause stagnation because of the ±2' of tidal amplitude, and the connecting water depths being the same as the post excavation contours. Spoil disposal will disturb approximately 20,000 sf of high ground to be determined at a later date. No high ground development is proposed under this application, although the issued Minor CAMA Permit allowed for redevelopment of the existing impervious area, to a lesser amount than was pre-existing. The intended use of this development is commercial.
