Falls in Transylvania Co. with Jennifer Robertson and staff from Wetland and Natural Resource Consultants on Dec. 13. Jennifer contacted me on Dec. 11 to arrange a site visit as requested by DWQ with the purpose of looking for rare aquatic species, particularly green salamanders and bog turtles. I searched several areas of appropriate habitat on the site as indicated on the attached map. These sites include a wetland site along Toxaway Creek (bog turtle) and several cliffs and rockface areas for green salamanders. Neither species was found during the surveys. The wetland did not contain suitable habitat for bog turtles, i.e. lack of open areas dominated by moss and graminoid hummocks. The rock faces and cliff areas studied did exhibit excellent habitat for green salamanders and multiple areas of suitable habitat were identified. It should be pointed out, however, that these species are Federal Species of Concern (not endangered or threatened) and furthermore they are not aquatic dependent species as they live in rock outcrops. I would also like to point out that surveys for these species should ideally be carried out earlier in the year (spring for bog turtles and fall for green salamanders). In addition to the animal surveys, two watchlist plants were encountered during the survey, seep rush (/Juncus gymnocarpus/) and Appalachian Shoestring Fern (/Vittaria appalachiana). /These plants were found in the wetland and in the falls on Toxaway Creek (Abbey Falls) respectively. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The DWQ has concerns that federally listed Threatened and Endangered water dependent species may exist onsite: Please contact Ed Schwartzman with the Natural Heritage Program to schedule an onsite survey for federally listed Threatened and Endangered water dependent species. Once the survey has been conducted please forward the findings to the DWQ. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and that you remain interested in continuing to pursue permitting of your project and wi1.1 be providing the DWQ the requested information at a later date. Please contact me in writing and Kevin Barnett of the DWQ Asheville Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
