REQUEST FOR MORE INFORMATION
Dear Mr. Vincent:
On July 7, 2008, the Division of Water Quality (DWQ) Wilmington Regional Office (WiRO)
received your 401 Pre Construction Notification (PCN) application dated July 1, 2008 for road
crossings within the subdivision. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A
NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide all of the following information so that we may continue to review
your project.
Additional Information Requested:
1. The subdivision plat map needs to be of a larger size and depicting lot numbers, road
names or labels, utilities and some topographical information.
2. All lots need to be buildable without any additional wetland impacts. There are lots
shown that will need driveways across wetlands to access the buildable portion of the lot
but since there are no lot numbers to identify these particular lots, please review each lot
carefully and show how much additional wetland fill will be required. Some lots show a
very small area of high ground and a building footprint (the same built upon area BUA as
indicated on the stormwater plans) needs to be shown on these lots indicating that they
are buildable or you will need to remove the lot and/or incorporate it into adjoining lots.
3. The wetlands need to be labeled as jurisdictional or isolated.

4. All wetlands must be verified by the USACE, your application indicated that the USACE
had not verified a portion of the proposed project. Please have this done and modify the
plans to show the corrected lines.
5. There are a lot of stub out roads indicated on the plans. Please verify that these stub
roads will not require additional impacts to wetlands when they eventually connect to
other adjoining properties.
6. There is one internal stub out road located between wetland crossing #4 and #5. Why is
this a stub out? Please show the connection to the high ground hummock and incorporate
the additional wetland impacts in the application.
7. Please show the treatment plant and all utility lines and indicate if there will be additional
wetland impacts with the installation of the utilities and whether the impacts will be
temporary or permanent and include them in the application.
8. You have not shown the locations of the stormwater ponds although you have indicated
that a stormwater permit has been issued. Please show all ponds, swales and other
stormwater features on the overall subdivision drawing. Please indicate if any of these
features could or will have impacts on the wetlands.
9. There are large sections of upland without any lot lines (one is on Old Folkstone Road
and the second section is located between wetland crossing #1 and wetland impact #1 of
Hwy 172) that have been left open. Please indicate what will be developed in these areas
and show it on the plans. Incorporate any additional wetland impacts in the revised
application.
10. Please give a better description of the avoidance and minimization that was done for this
project and other parcels of land that were considered. In addition, show other
subdivision designs considered.
11. Wetland crossing # 8 can be avoided because of two other access roads into the
subdivision.
12. Please include a draft deed restriction or restrictive covenants (if required by the USACE)
for the remaining wetlands. The draft needs to be as accurate as possible concerning the
proposed project area.
13. There seems to be some small isolated wetlands on some of the lots. Some of these look
as if they will need to be impacted to make the lots buildable. Please identify the isolated
wetlands and indicate which ones will be impacted and add these impacts to your revised
application (the wetland impacts for the DWQ need to include all isolated wetland
impacts in the application).
14. The wetland identified as Wetland W 11 is completely surrounded by a road, please
explain how this wetland will be kept hydrated.
15. Wetland impact # 2 can be eliminated if the road alignment could be moved over towards
the property line.
16. Please copy the DWQ in your response to the incomplete letter that you received from
Mr. Brad Shaver from the US Army Corps of Engineers.

Please respond within three weeks of the date of this letter by sending this information to me in
writing and two copies to Ian McMillan c/o 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh,
NC 27604-2260. Please reference the DWQ Project # of 20081046 in all future correspondence.
If we do not hear from you within three weeks, we will assume that you no longer want to pursue
this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your
application are not authorized (at this time) by the DWQ. Please call me at 910-796-7215 or
