DWQ comments at this time include, but are not limited to: * The 20' view shed clearing in the trout buffer and the 4' trail clearings are not going to fly in light of the recent NC Administrative Law Judge ruling on trout buffers. * The DWQ will require that all of the streams (intermittant and perennial (and its buffers) outside of those impacts permitted through this process be preserved in perpetuity through Deed Restrictions or Conservation Easements and would be looking for 50' minimum buffers on perennial streams. * Avoidance and Minimization on the requested 950' of impacts will need to re-addressed. The DWQ needs more than just preservation at this point. The more extensive use of bottomless culverts, bridges, and / or stream restoration are all options. * The DWQ will reguire a Trout Moratorium for this project. * The DWQ will require strict sediment and erosion controls, with continous upstream / downstream turbidity monitoring, a turbidity limit of 10 NTU and disturbed acerage limits similar to Mtn Air and Mtn Top developements (no more than 10 acres at a time). * Addressing mitigation for cumulative impacts from previous permits. (The included mitigation chart is confusing because it does not seperate previous impacts from proposed impacts.) I hope this gives you a starting point to work from on this package.
