2016 -01636), in Charlotte, Mecklenburg County, North Carolina.
Messrs. Shaeffer, Johnson, Hamstead and Ms. Higgins,
Enclosed is a request for Nationwide Permit #29 for the proposed Wildwood residential
development in Charlotte, Mecklenburg County, NC. The 29 acre site contains 1,894
linear feet of stream channels. The site was delineated in July of 2016 and a field review
and verification by Alan Johnson of NCDEQ was conducted on July 12, 2016 and
reviewed and verified by David Schaeffer of USACE on September 1, 2016. A
Preliminary Jurisdictional Determination Request was submitted on August 15, 2016.
The site was named "Thomas Road Site" when the PJD was submitted and was
assigned as SAW -2016-01636. Please refer to this submittal for JD related information.
The Wildwood site is a single/complete project independent of the adjacent
development, Southern Trace. The two sites have different owners and independent

access to each development. The connectivity to Alydar Commons Lane in the
adjacent development is being required by the city of Charlotte to facilitate connectivity.
Wildwood is not, and should not be considered, a phase of any adjacent development.
Avoidance/Minimization Discussion:
Proposed permanent impacts associated with the project total 90 linear feet of a
perennial stream (RPW B). Specifically, the proposed impacts to jurisdictional waters
are associated with fill and grading for construction of roadway access and the
installation of culverts at one stream crossing providing access to uplands and
connectivity to an adjacent development. The applicant was unable to completely avoid
this impact as the stream bisects the site along the western portion of the site and
facilitates the necessary connectivity to Alydar Commons Lane in the adjacent
development. However, the applicant was able to minimize impacts to the stream by
locating the crossing at an existing stream crossing location and incorporating the use
of headwalls to minimize impacts. No other impacts to streams or wetlands are
proposed. Due to the minimal impacts associated with the proposed project, no
compensatory mitigation is being proposed for the anticipated permanent impacts.
Also enclosed is a copy of our Threatened/Endangered Species Evaluation for the site
in which no listed species were identified within the project area. The site is wooded
which may be considered summer roosting habitat for the listed Northern Long Eared
Bat. Comparing our site location to the USFWS Asheville office's website
(http://www.fws.gov/asheville/htmis/project_review/NLEB_in_WNC.html) it appears
that the site meets the "exempt" criteria which requires no further action under section
7 of the Endangered Species Act for this species and formal USFWS concurrence is not
required.
We believe that the site plan has been designed to avoid and minimize impacts to
aquatic resources on the site while still providing needed access to develop the site as

Project was designed to minimize road crossings and only one is being proposed for required connectivity to the adjacent residential development.
This road crossing is required for connectivity and access to the upland areas. Headwalls will be used to minimize impacts to streams to facilitate the
road. Only 90 linear feet of stream impact is proposed for the 29 acre site. No additional impacts are proposed for the remainder of the development.
Rip -rap for bank stabilization will be installed above the OHWM. No impacts will occur from sewer lines.

The culvert length and stabilization within the stream have been designed/sized to safely accommodate anticipated residential traffic and foot travel but
minimize the area of impact to existing surface waters. Extensive use of headwalls is being proposed to minimize impact to the stream. Sidewalks
have been sized and located close to the road to minimize the width of the stream impact. Location of the stream crossing is designed to utilize an
existing crossing minimizing the impact size.

Wildwood Site - Threatened / Endangered / Protected Species Evaluation
GENERAL LANDSCAPE DESCRIPTION:
The Wildwood Site (29.0 acres) is located just west of Thomas Road, and just
east of Alydar Commons Lane in Charlotte, North Carolina. It can be found on
the Lake Wylie, NC USGS Topographic Quadrangle Map; latitude is 35.0644 N,
longitude is -81.0147 W. The topography consists of upland flat grading into
gentle slopes, with the elevation ranging from 610 to 680 ft. (Figure 1. The site
is mostly covered with a secondary growth, disturbed mixed pine/hardwood
forest. A smaller portion is covered with abandoned upland old fields and
pastures in varying stages of succession. There are dirt -gravel roads traversing
the site, and a large overhead power line right-of-way bisects the site north to
south.

METHODOLOGY:
The US Fish and Wildlife Service website httr)://www.fws.aov/endangered/ was
referenced to determine the occurrence of Threatened and Endangered species
for Mecklenburg County North Carolina (Table 1). Table 1 summarizes
listed/protected species recognized in Mecklenburg County as of October 10,
2016. Maps and aerial photographs were assembled and the site was
investigated October 10, 2016.

Three plant species with federal protection were included in the survey efforts:
Schweinitz's sunflower (Helianthus schweinitzi►), listed as Federally
Endangered, is typically found in open habitats which historically have
been maintained by wildfires and grazing bison and elk herds. Now most
occurrences are limited to roadsides, woodland and field edges, and utility
rights-of-way (ROW).
• Smooth Coneflower (Echinacea laevigata), listed as Federally
Endangered, is typically found in open woods, cedar barrens, roadsides,
clear cuts, dry limestone bluffs and power line rights-of-way, requiring
abundant sunlight and little competition from other plant species.
• Michaux's Sumac (Rhus michauxi►), listed as Federally Endangered,
requires habitat of sandy forests and woodland edges. This species
requires periodic fire as a part of its ecology.
A total of three animal species with federal protection are listed as potentially
occurring in Mecklenburg County:
• Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden
Eagle Protection Act, typically inhabits forested areas near large bodies of
open water such as lakes, marshes, seacoasts and rivers, where there are
suitable fish populations and tall trees for nesting and roosting.
• Carolina Heelsplitter (Lasmigona decorata), listed as Federally
Endangered, is restricted to cool, clean, well -oxygenated water. Stable,
silt- free stream beds are required for this species. Typically stable areas
occur where the stream banks are well -vegetated with trees and shrubs.
• Northern Long-eared Bat (Myotis septentrionalis), listed as Federally
Threatened. During summer, northern long-eared bats roost singly or in
colonies underneath bark, in cavities, or in crevices of both live and dead
trees. Males and non -reproductive females may also roost in cooler
places, like caves and mines. It has also been found, rarely, roosting in
structures like barns and sheds. Northern long-eared bats spend winter
hibernating in caves and mines, called hibernacula.

RESULTS:
Habitat Descriptions
(Species lists reflect the seasonality of the survey)
The site is mostly covered with a secondary growth, disturbed mixed
pine/hardwood forest. A smaller portion is covered with abandoned upland old
fields and pastures in varying stages of succession. There are dirt -gravel roads
traversing the site, and a large overhead power line right-of-way bisects the site
north to south. Roadside habitat borders the property along Thomas Road
A large portion of this site is covered with a secondary growth, disturbed mixed
pine/hardwoods forest. The average diameter at breast height (DBH) for the
canopy trees is 10 inches with some larger trees present. Canopy trees include
Loblolly Pine (Pinus taeda), White Oak (Quercus alba), Red Oak (Q. rubra),
Southern Red Oak (Q. falcata), Shagbark Hickory (Carya ovata), Sweetgum
(Liquidambar styraciflua), Tulip Poplar (Lidodendron tulipifera), Virginia Pine (P.
virginiana), and Shortleaf Pine (P. echinata). The subcanopy contains Redbud
(Cercis canadensis), Winged Elm (Ulmus alata), Eastern Red Cedar (Juniperus
virginiana), Red Maple (Acer rubra), Flowering Dogwood (Cornus florida), Red
Mulberry (Morus rubra) and American Holly (Ilex opaca). The shrub layer
includes Blueberry (Vaccinium sp.), Strawberry Bush (Euonymus americanus),
Russian Olive (Elaeagnus umbellate), and Chinese Privet (Ligustrum sinense).
The herb layer includes Christmas Fern (Polystichum acrostichoides), Spotted
Wintergreen (Chimaphila maculata), Downy Rattlesnake Plantain (Goodyera
pubescens), Running Pine (Diphastiastrum digitatum), Bedstraw (Galium sp.),
and Japanese Stiltgrass (Microstegium vimineum). Vines present are Japanese
Honeysuckle (Lonicera japonica), Catbrier (Smilax sp.), Virginia Creeper
(Parthenocissus quinquefolia), Muscadine (Vitis rotundifolia), and Poison Ivy
(Toxicodendron radicans).
The portion of the site under the power line rights-of-way and abandoned field is
covered with a disturbed, old field succession scrub/shrub community composed
of pine and hardwood saplings, open mixed herb grassland, and blackberry and
woody vine thickets. Dominant species present include saplings of Sweetgum
(Liquidambar styraciflua), Winged Elm, (Ulmus alata), Shortleaf Pine (Pinus
echinata), Virginia Pine (Pinus virginiana), Red Cedar (Juniperus virginiana),
Black Cherry (Prunus serotina), and Black Gum (Nyssa sylvatica). Shrubs
present are Blackberry (Rubus sp.), Russian Olive (Elaeagnus umbellata),
Winged Sumac (Rhus copallina), and Groundsel (Baccharis halimifolia). Vines
observed are Japanese Honeysuckle (Lonicera japonica), Catbrier (Smilax sp.),
Poison Ivy (Toxicodendron radicans), and Yellow Jessamine (Gelsemium
semperviriens). Herbs include Broomsedge (Andropogon virginicus), Plume
Grass (Erianthus contortus), Indian Grass (Sorghastrum nutans), Nightshade
(Solanum sp.), Johnson grass (Sorghum halepense), Sericea Lespedeza
(Lespedeza cuneata), Ragweed (Ambrosia artemisiifolia), Goldenrod (Solidago

sp.), Beggars Ticks (Desmodium sp.), Aster Patens (Symphyotrichum patens
var. patens) and Rosinweed (Silphium compositum).
The roadside along Thomas Road has a mowed Fescue (Festuca sp.) shoulder.
The narrow ecotone at the woods and field edges are made up of Fescue,
Serecia Lespedeza, Broomsedge, Dog fennel (Eupatorium spp.), Goldenrod
(Solidago spp.), Blackberry, and Multiflora rose (Rosa multiflora).
Endangered/Protected Species Results
• Although potential habitat exists for Schweinitz's Sunflower, Michaux's
Sumac and Smooth Coneflower along the roadside corridor, power line
right of way, field and and woods edges, examination of these areas
revealed no occurrences on-site.
• No habitat exists on the site for Bald Eagles, and there were no sightings
nor were any nesting sites observed.
• The on-site streams do not appear to have the habitat characteristics
required to support populations of the Carolina Heelsplitter. Based on
existing documentation, Carolina Heelsplitter populations have not been
previously identified in this basin. No individuals were observed during the
survey nor would any be expected on-site.
• Comparing our site location to the USFWS Asheville office's website
(http://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html) it
appears that the site meets the "exempt" criteria which requires no further
action under section 7 of the Endangered Species Act for the northern
long eared bat.

We recommend further consultation with you and your project planners and
engineers regarding coordination with USFWS and other federal and state
agencies.

Ms. Gaffney is a classically trained botanist and biologist and has conducted field work
and investigative studies covering thousands of cumulative acres in both North and
South Carolina since 1996, including:
• Cabarrus County NC Natural Heritage Inventory 1997-1998. Organized,
directed, and worked in field survey of natural areas in Cabarrus County for the
North Carolina Natural Heritage Program, collecting field data and writing reports.
• Lincoln County NC Natural Heritage Inventory 2000-2001. Organized, directed,
and worked in field survey of natural areas in Lincoln County for the North
Carolina Natural Heritage Program, collecting field data and writing reports.
• Threatened and Endangered Species Surveys and Natural Communities
Evaluation for over 30,000 acres in North and South Carolina, 1996 - present.
• Located and identified at least six previously unreported populations of Federally
Endangered Schweinitz's Sunflower (Helianthus schweinitzi►).
• Located and identified four previously unreported populations of
Threatened Dwarf Heartleaf (Hexastylis naniflora).
• Located a previously unknown population of Federally Endangered Schweinitz's
Sunflower at Redlair Farm in Gaston County, NC. This discovery led (in part) to
the purchase of the site by the State of North Carolina Plant Conservation
Program, now called Redlair Preserve. This population has become a Recovery
Site for the species.
• Participated in numerous Piedmont Prairie restoration projects in Mecklenburg,
Union, Cabarrus and Gaston Counties, North Carolina.
