Dear Ms. Beckwith:
The North Carolina Depaitment of Transportation (NCDOT) requests modification of its pe�mit
(Action ID 2014-01668, NCDWR 2014-0912) to replace a functionally obsolete 18' W x 16.0' L
single span timber bridge. The modification involves our current proposal to use a 2 r�r 13' W x 6'
H x 40' L reu�forced concrete bos culvert (RCBC) on an 80 degree skew 0.5% slope instead of
the originally proposed 22.1' W x 6.5' H x 49' L prefabricated aluminum box culveM with
liead�valls. Sills and floodplain benclies will be installed with tlie RCBC to maintain stream
dimensions and provide aquatic life passage during periods of low flow. An off-site detour will
be used to wnvey traffic during constmction. The proposed design cl�ange will reduce tlie stream
impact for tlie culveit by 9 feet, but require an additional 25 feet of rip rap and floodplain bench
impact.
Enclosed are the Pre-Construction Notification (PCN) Fonn, EEP Mitigation Acceptance Letter,
SHPO Concurrence Forms, vicinity map, USGS topographical map, Culve�t Survey Report, plan
sl�eets, and pliotograpl�s.
Tlie Noith Carolina Natural Heritage Database was checked for records of tlu•eatened and
endangered species. The database lists 47 species for Transylvania County that liave federal
status. The bog tuitle (Gl�ple�xys nn�h/enbergii) is listed as threatened due to similariry of
appearance to the listed northern bog turde. Eight species, Carolina northern flying squirrel
(Glnuconrys snbrinus colora�us), Appalachian elktoe (Alnsniidonln rm�enelirnra), mountain sweel
pitcher plant (Sm�racei�ia rubrn ssp. jouesii), small wl�orled pogonia (Isoh•ia medeoloides),
spreading avens (Geurn radini�rm), swamp pink (Helonins bulln(n), Virginia spiraea (Spirnen
i�irginim�n) and rock gnome lichen (G�+nmoderma linem�e), are listed as eitlier tl�reatened or
endangered. Transylvania County is within the kno�vn range of northetn long-eared bat (Mytosis
seplenh•ionnlis) as �vell.

The Appalachian elktoe is found in well-oxygenated streams with moderate to fast flowing water
and requires stable relatively silt free substrate that is gravelly or rock. The Appalachian elktoe
records in the area ai�e fi•om relatively large streams, tlie Frencli Broad River, Little River and
Mills River. There are no records for the smaller tributaries of these streams. No Appalachian
elktoe were observed during the field scoping process and records indicate the nearest known
occun�ence is located approximately 22 river miles from the project area in tlie French Broad
River.
Carolina no�tliern flying squi�rel, rock gnome lichen, and spreading avens are species that require
habitat found at relatively higl� elevation. Although most rock gnome Iichen populations occur
near or above 5,000 feet elevation, it does occw• at lower elevations within deep river gorges.
The elevation at the site is approximately 2,200 feet and ve�tical rock substrate required by the
rock gnome lichen is lacking near the project site.
Small whorled pogonia generally occurs in open, dry, deciduous woods with acid soil according
to the U.S. Fish and Wildlife Service. However, it is also known to occur in a variety of habitats
in North Carolina, including abng streams. The project site is maintained road right of way, with
some forest area consisting of deciduous trees. Tlie area is also heavily impacted by invasive
species that include Chinese privet, Japanese honeysuckle, multiflora rose and periwinkle. The
site has very Iow potential to suppod small whorled pogonia. Records indicate tlie neai�est known
occurrence of small whorled pogonia is approsimately 11 miles east of the project area.
Virginia spiraea occws along rocky, flood-scoured riverbanks in gorges or canyons. Gravel and
rock bars that provide habitat for Virginia spiraea are lacking at tlte p�roject site. S�vamp pink and
mountain s�veet pitcher plant are species that are found in saturated soils. The project vicinity is
higlily disturbed and �vetlands are not associated with the site.
Although Transylvania County is within the known range of nor[hern long-eared bats, there are
no known hibernacula or maternity roosts here. And, this project is several miles from the nearest
"red huc" for known l�ibernacula or maternity roosts. This project should require cutting about 12
large ti�ees. However, blasting and pile driving (percussive activities) are not planned. There are
no bats or signs of bat usage on this bridge.
The project is limited to tlie replacement of an existing spanning st�vchu•e �vith a box culvert.
Erosion and sedimentation control measures will be implemented to further minimize potential to
adversely affect aquatic liabitat. No Appalachian elktoe were observed during the field scoping
process and records are lacking for smaller tributaries of the French Broad River. Since the
nearest occupied habitat in tlie French Broad River is approsimately 12 miles upstream of the
conFluence of Boylston Creek, we recommend a"no effecN' detennination for the Appalachian
elktoe.
Terrestrial habitat has been highly disturbed at the project site due to road right of way and
residential development. The project is limited in scope and habitat appears to be lacking for
ten�estrial tiveatened and endangered species. For these reasons and tliose discussed above, we
reconnnend a"no effect" detennination for terrestrial threatened and endangered species.
This project was reviewed by NCDOT's Human Enviironment Unit in 2013 for potential affects to
historical architecture and archaeology. It was detenuined that no suivey was required for
historic arcliitectui�e. An archaeological survey was conducted on October 4, 2013, aud it was

determined there would be no effect, and no fiuther archaeological investigations ��-ere necessary
for this projeet (see attaclied forms).
NCDOT best m�n�gement practices will be used to minimize and control sedimentation �nd
erosion on this project The construction forem�n will revie�v all erosion and sedimentation
control measures daily to ensure erosion and sedimentation is being effectively controlled. iFthe
devices are uot funetionuig as u�tended, H�ey �vill be replaced immediately �vith better devices.

Boylston Creek (D WR Class C) is sho���n on the USGS topographic roap as a perennial stream.
The channel is well defined �vitli a substrate primarily composed of cobble, gravel nnd s�ud/silt
and is approsiinately I S feet in �vidth. Boylston Creek flotvs npproximately 10 miles to tlie
Freucli Bro�d River. The �rench Binad River meets Ihe definiliou of a Traditional Navigable
Water. For these rcasous, we believe Boylston Creek is a Relatively Permanent Water and is
under the jurisdiction of the U.S. Army Corps of Engineers. 6i order to consh'uct the projecf, it
will be necessary to impact �vaters of tlie United St�tes iu the Freucli Broad River Basin (HIIC
06010105). Specifically, NCDOT is requesting to replace Bridge No.106 with a RCBC. The
impacts are Iisted in the table belo�v.

Traffic will be detoured off-site. Erosion and sedimentation control measures will be installed. Water will be diverted

The minimum length culvert to meet secondary road standards was designed for this site. The culvert will be buried 1 foot
below lhe existing streambed elevation and sills will be installed. Floodplain benches will be installed at the inlet and outlet
ends of the culvert to help maintain channel dimensions and aquatic life passage especially during periods of low flow.

Erosion and sedimentation BMPs will be installed prior to construction. Water will be diverted around the work area during

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested ihis preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will

Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was
undertaken on August 29, 2013. Based on this review, there are no existing NR, SL, LD, DE, or SS
properties in the Area of Potential Effects, which is 75' fi•om die centerline eacL way and 300' from each
end of tl�e bridge. There are three homes within the APE, hvo are imder fifty years of age based on
Transylvania County GIS/Tax information and one is over fifty years of age. 91 King Rd, built 1955, is a
one story frnme house norlhwest oFfhe bridge; it is unremarkable and not eligible for National Register
listing. Bridge No. 106 is a timber bridge bnilt 1955, it is not eligible for NR listing. Tliere are no

An archaeological survey and evaluation for replacement of Bridge No. 106 on SRI502 over Boylston
Creek in Transylvania Couuty was conducted on October 4, 2013, by Tasha Benyshek, Michael Nelson,
Belinda Cox, and Brenda Magouirk-Nelson of TRC Environmental Corporation (TRC). During the
course of lhe survey, one previously unidentified archaeological site (31 TV 1073) was located within the
project APE. The archaeological resource is recommended not eligible for the NRHP, and no further
archaeological investigations are needed for this project.

SUMMARY OF CULTURAL RESOURCES REVIEW
Briefdescripliox ofreview aclivilies, resnlls ojrevie�v, and ca�cle�sions:
TRC has cmiducted an inteusive archaeological survey and evaluation for the replacemenl of Bridge No.
106 on SR 1502 (King Road) over Boylsron Creek in Transylvania County, North Carolina (Figures 1
and 2). As speci}ied by the NCDOT, the survey area and Area of Potential Effecfs (APE) for archaeology
extends 300 feet (91.44 m) northeast and 300 feet (91.44 m) southwest along SR1502 from either end of
Bridge No. 106. The corridor is approximately I50 feet (45.73 m) wide extending 75 feet (22.86 m) on
either side of SRI502 frmn its present cenfer.
A map review and sile files search was conduc[ed by Belinda Cox of TRC at the Office of Slate
Archaeology (OSA) Western Branch on September 26, 2013, whicli supplemented a previous NCDOT
review. Eight sites are located wilhin a mile radius of the project area, including 31TV 102, which is
recorAed within or directly adjacent to the project APE. Holden (1966) initially recorded 31TV 102 and
found a Woodland triangular pp/k; the site was recorded as being nodh of Boylston Creek and jusl east of
Long Branch in a small sloping field. This description is consistent with conditions immediately to the
nodh of ihe current APE. Wetmore later revisited a Middle Woodland site she recorded as 31TV 102. The
site form indicates that the site was located in a fallow field that was to be developed, and includes ihe
descriplion `9ndustrial" on the site condition portion of �he form. The indusirial setting Wetmore
describes f ts ihe surrounding area to the west of fhe APE. Wehnore's map of shovel test locations shows
31"I'V IO2 west of Sutton/Long Branch (Wetmore 1993: t26), and based on this map is 180 m west of the
curreut APE, well outsiAe the current survey area.'1'he Holden and Wetmore 31TV 1021ocations are
likely different sites, and il is possible that Wetmorc revisited 31TV101 rather than 31TV102, as
31TV101 is located west of Sidton Creek. Regardless, Holdeds 31TVI02 is likely closer to nearby NC
280 ro ihe nodh of thc project area, within the agricultural fields in that direction. The nodhern portion of
ihe current APE consis�s of a residen�ial area, and ihe landforms are modified in this location. Only one
of the three residential structures wilhin the APE are depicted on the 19G5 USGS map (USGS I965)
(only 2 oF3 are on recent 1997 USGS map [USGS 1997]), however, so it is possible that 3lTV 102 was
located in what is now a developed arca. Site 3ITV 102 was not rediscavered during the current survey
Topographic maps, United States Department of Agricidture (USDA) soil survey maps, and hisroric maps
were examined for infonna�ion on natural or cul[ural variables that migh[ have aTfected site locations.
The Price and Strother map (1808) shows "Bouydstones" Creek and tribidaries, abng with a ro2d
crossing "Bouydstones" Creek, but no other detail in the area. The MacRae mnp (1833) depicts Boylstons
Creek, along with some of its tributaries, and a road t6rough fhe valley but no olher detail in the area. The
Kerr map (1882) also depicts Doylston Creek and a road in the area, bat no detnil in the project area
eilher. The 1906 Pisgah quadrangle wutains mucl� more detail and shows Boylston Creek, along with
Sutton Creek and Long Branch, allhough Long Branch is not labeled. NC 280 is shown in its approximate
current location, as is a road in the SRI502 location along wi�h �he creek crossing in or near its current
location. No shuctures are depicted wifhin the APE, although several aee shown Further to the southeast
(USGS 1906). Similarly, the 1935 and 1945 Pisgah Forest USGS quadrangles do not show any structures
within the APE (USGS 1935, 1945). As mentioned above, a single stnicture appears on tl�e 1965
quadrangle, in the northwes[em portion of the APE (USGS 1965). By fhe time the 1965 map was
photorevised, two houses are present, with tlie addition of one in the soutUwestern quedrant of the APE
(USGS 1978).
On-line soils data show two soil types within the project area (NRCS 2013). Most of the area is mapped
as Rosman fine sandy loam, 0-2% slopes, frequently flooded. These soils occur in floodplains. Most of
the residential area is classified as Braddock loam, 2-8% slopes and consist of stream terraces comprised
of olA alluvium (NRCS 2013).

The archaeological field survey included a systematic walkover of the APE to search for above-ground
features and Ihe excavation of 21 shovel tests (Table 1) in areas lacking standing water, wetland soils, or
signs of severe disturbance. All qundrants of the APE were found suilable for shovel testing. The shovel
tests measured 30 cm in diameter and were excavated ro subsoil or at least 75 cm below surface (cmbs);
all soils that were not obvious fill were dry-screened through %s-inch mesh. Limited augering was
conducted at the beses of select shovel tests to fudher assess the potential for buried sites and to find the
depth to basal gravels.
The westem portions of the APE are wiHiin a residential area, and landforms appeared largely modified
(Pigures 3 and 4), although STs 4 and 6 encountered intact alluvial soils nearest the creek. No artifacis
we��e recovered in that area. The eastern parl oFihe APE consists of agricultural tields that were planted in
corn at the time of survey (�igure 5). Surface visibility was approximately 50%. Na artifacts were
recovered from shovel tests to the south of SR1502, nor were any observed on the surface.
One very low density site was newly discovered (3ITV 1073) in the nor[heas[ern quadrant of the APE
(see Figures 2 and 5). Ten shovel lests were excavated in the site area. Soils all consisted of loamy
alluvium, but were variable, with some shovel tests (e.g., ST7) appearing to encounter swales while
others contained � more clear A over B soil sequence. Some shovel tests contained mottled, hydric soils
at the bases. Only thrce artifacis were recovered, consisting of a piece of quatlz debitage and hvo sherds.
The sherds are too sroall and eroded to allow component identification. No artifacts were observed on ihe
surface. The site may continue to the north outside of ihe APE, although a cursory look at ihe surface in
that direction did not i�veal any artifacts. The landfonn rises in ihat direction and ihat area may have been
more apractive for prehistoric occupation, as it would have been less frequently tlooded. Due to ihe very
low densily, sile 31TV 1073 is recommended not eligible within the survey area.
Based on the results of the backgromid research and field survey, there is no evidence ihat NRHP-eligible
archaeological resources are situaled within the Bridge l0G APE. Consequently, no addi[ional
archaeological investigatious are recommended for this project as currenlly defined.
