NUTRIENT OFFSET CREDIT CALCULATION DOCUMENTATION FOR TRACT 2 Neville Farms Asbuilt & Baseline Document (Phases 1 &2) Watershed Investments NC WATERSHED Investments,- MEMORANDUM TO: Katie Merritt, NCDWR FROM: Mike Herrmann, WINC DATE: March 20, 2017 RE: Asbuilt & Baseline Monitoring Report Watershed Investments NC, LLC 1630 Weatherford Circle Raleigh, NC 27604 Phone: 919.533.9195 Neville Farms Buffer and Nutrient Offset Bank Parcel (Phase 1 & Phase 2) The purpose of this memorandum is to document several changes that occurred from what was proposed in the June 1, 2016 Neville Farms Buffer and Nutrient Offset Bank Parcel Development Package (BPDP) to the submittal of the March 20, 2017 Asbuilt & Baseline Monitoring Report: Neville Farms Buffer and Nutrient Offset Bank Parcel (Phase 1 & Phase 2) (Asbuilt Report). Changes include the following. 1. Surveys of the conservation easement boundaries resulted in slight changes to the conservation easement boundaries proposed in the BPDP; therefore, resulting in changes to final acreages, and buffer and nutrient offset credit amounts. Final acreages and credit amounts are documented in Tables lA-1D of the Asbuilt Report. 2. Nutrient offset credit calculations for Tract 2 changed from amounts proposed in the BPDP; documentation of these changes as well as approval from planning can be found within Appendix G of the Asbuilt Report. 1.0 Introduction Watershed Investments NC (Sponsor) is pleased to provide the NC Division of Water Resources (DWR) this Asbuilt & Baseline Monitoring Report for the Neville Farms Bank Parcel (Site). The purpose of this project is to generate Jordan Lake riparian buffer restoration and preservation mitigation credits as well as nutrient offset credits. The Neville Farms Bank Parcel is included in the Neville Farms Mitigation Banking Instrument (MBI) for Riparian Buffer Mitigation and Nutrient Offset Credits signed between Watershed Investments NC, LLC and the NC Division of Water Resources (DWR) and effective on January 29r1, 2016. The MBI is in accordance with 15A NCAC 02B .0295 (Temporary Consolidated Buffer Mitigation Rule, effective October 24, 2014) and 15A NCAC 02B .0240 (Nutrient Offset Payments Rule). The site encompasses 6.15 acres of land along Neville Creek, which is a tributary to University Lake south of Chapel Hill in Orange County North Carolina. Site activities consisted of approximately 5.04 acres of riparian restoration and approximately 0.94 acres of riparian preservation. An additional 0.17 acres of Tract 1 is included in the project easement area but is outside the rule -defined riparian buffer zone and, consequently, not included for either riparian buffer mitigation or nutrient offset credit generation. The Site is comprised of two separate tracts owned by two different land owners and will be mitigated in two phases. Phase 1 is comprised of Tract I and Phase 2 is comprised of Tract 2. Each phase/tract will have its own credit release schedule for milestones met in accordance with the Neville Farms Mitigation Banking Instrument (MBI). Though the tracts are adjacent, the division of the Site was necessary based on land use, land planning, and project crediting. Moving forward; however, project activities for both Tracts should proceed on the same schedule. Tract information is as follows. Tract Acreage Location Tract 1 (Gambill/Neville Property) 4.31 ac. Main project area located on the north side of Neville Creek and accessible from Old Greensboro Highway Tract 2 (McGee Property) 1.84 ac. Area south of Neville Creek and accessible from StansburyRoad Conservation easements were placed over Tract 1 on February 3, 2016 and recorded at the Orange County Register of Deeds in Deed Book No. 6073, Page No. 230, and Tract 2 on October 13, 2016 and recorded at the Orange County Register of Deeds in Deed Book No. 6203, Page No. 221 (Appendix D). Orange County is the delegated authority by the NC Environmental Management Commission to conduct determinations on whether drainage features in their jurisdiction are surface waters and subject to the buffer rules of the State found in 15A NCAC 02B .0267 (Protection of Existing Riparian Buffers). Orange County Planning and Inspections assessed the Site and provided their determination on February 9th, 2015 that the surface water features on the Site are subject to the Rule (Appendix C). The project has restored and preserved forest adjacent to surface water features to reduce nutrients that flow into Neville Creek, University Lake, and ultimately Jordan Lake. The project will have ancillary benefits that include reducing sediment runoff, reducing nutrients to streams through agricultural runoff, and thus, improving aquatic and terrestrial habitat. Any nutrient offset or riparian buffer mitigation generated from this Bank Parcel may offset impacts from development, both existing and proposed, within the Upper New Hope 1 Neville Farms Asbuilt & Baseline Document (Phases 1 &2) Watershed Investments NC Subwatershed of Jordan Lake, as verified by DWR staff onsite and in a letter dated April 6, 2015 (Appendix E). 2.0 Project Location The Site is located approximately 3 miles southwest of Chapel Hill, NC and one mile upstream of University Lake (Figure 1, Appendix A). Surface water drainage features at the Site feed into the Upper New Hope Subwatershed of Jordan Lake. The Site is located in the Cape Fear River Basin 14 -digit United States Geological Survey (USGS) Cataloging Unit 03030002060070 of the South Atlantic/Gulf Region (North Carolina Division of Water Quality [NCDWQ] Sub -basin Number 03-06-06). Directions to Tract 1 (Gambill/Neville Property) • From Raleigh, go West on I-40 and take Hwy 54 -West Exit to Chapel Hill • From Hwy 54, take the Jones Ferry Rd Exit, turn left to go South (0.9 miles) • After passing University Lake, turn right onto Old Greensboro Highway (1.8 miles) • Tract 1 entrance is on the left through a driveway right-of-way at address 1426 Old Greensboro Road, Chapel Hill • Latitude: 35.8917', Longitude: -79.1281° Directions to Tract 2 (McGee Property • Follow the above directions but instead of turning into the entrance for Tract 1, proceed another 0.5 miles • Turn left on Bowden Road (1.2 miles) • Turn left onto Stansbury Road; Tract 2 is at the end of the road at address 2201 Stansbury Rd, Chapel Hill, NC • Latitude: 35.8926° , Longitude: -79.1262° 2.1 Land Use The Site consists of two separate tracts of land as described below. Tract 1 Tract 1, 4.31 acres, is part of a 112 -acre farm that includes livestock pasture, woodlots, and hay production. Tract 1 is located in an area dedicated to hay production, which is classified as an agricultural practice. Annual nitrogen application rates for the property were approximately 100 lbs/ac. Portions of the easement area had a narrow buffer of trees (10-15 feet in width) immediately adjacent to the stream. The majority of the reforested area is located within the 100 -year floodplain for Neville Creek. Runoff from Tract 1 flows directly to Neville Creek. Tract 2 Tract 2, 1.84 acres, is part of a 9 -acre single-family residential property with pervious areas maintained as a fescue grassed lawn, which is not classified as an agriculture practice. Portions of the easement area currently had a narrow forested buffer of trees (10-15 feet in width) immediately adjacent to the stream. An area at the lower end of the easement that was over grown in blackberry (Rebus argutus) and Japanese honeysuckle (Lonicera japonica) was cleared and reforested with a native tree buffer. Surface water leaves Tract 2 directly through drainage to Neville Creek. 2 Neville FarmsAsbuilt& Baseline Document (Phases 1 &2) Watershed Investments NC 2.2 Historic Vegetation The majority of Tract 1 was planted in fescue and rye grass for hay production. Tract 2 was a managed fescue lawn. The majority of both banks of Neville Creek had a narrow tree buffer (10-15 feet in width) adjacent to the stream that provides some buffer functions. Based on feedback from DWR staff, areas with tree cover were considered Buffer Preservation for mitigation purposes. The thin riparian buffer is comprised of a mix of native trees and scattered invasive species as follows. Invasive species controls were used as part of this project and are discussed in Section 3.3. Observed Native Tree and Shrub Species Tulip Poplar (Liriodendmn tulpifera) Sweet Gum (Liquidambar styraciflua) Red Cedar (Juniperus viTiniana) Box Elder (Acer negundo) Ironwood (Carpinus caroliniana) Loblolly Pine (Pinus taeda) Spicebush (Lindera ben.Zoin) Coralberry (Sympboricarpos arbiculatas) Observed Invasive Species Chinese Privet (Li gustrum sinense) Autumn Olive (Elaeagnus umbellata) Japanese Honeysuckle (Lonicera japonica) 3.0 PROJECT PLANTING PLAN 3.1 Riparian Restoration Activities The riparian restoration was conducted according to the temporary rule 15A NCAC 02B .0295. Restored plant communities within the Site will provide stabilization and improve water quality and habitat within Nutrient Sensitive Waters of Jordan Lake. The protected buffer easements were planted up to 200 feet back from the top of the stream bank, with appropriate native species observed in the surrounding forest and species known to occur in similar environmental settings. Site preparation on both phases occurred November 16-18, 2016 and planting of bare root stems on both phases occurred December 21-22, 2016. Site preparation included spot spraying observed invasive species within the entire Site. Revegetation of the Site included planting 2915 bare root trees (Table 5, Appendix B). Planted stock consisted of high-quality bare root plants approximately 24 inches in height. Seedlings were hand -planted using KBC planting bars and were pretreated with an endo/ectomycorrhizal spore root treatment. 3.2 Riparian Preservation Activities A narrow fringe of mature trees exists in most of the Site within the Neville Creek riparian buffer. The preservation area was reviewed by DWR and determined eligible for Buffer Preservation (Appendix E). Preservation areas are included in the permanent conservation easement (Figure 3, Appendix A). The riparian buffer, as defined in 15A NCAC 02B .0267, extends a maximum distance of 50 feet from the top of stream bank. 3 Neville Farms Asbuilt & Baseline Document (Phases 1 &2) Watershed Investments NC 3.3 Invasive Species Control Invasive species management occurred throughout the entire Site. Within Tract 1, autumn olive and Chinese privet were treated by cutting each plant at the base and spraying freshly cut stumps with the herbicide Crossroads. Japanese honeysuckle along the buffer edge was also treated; however, some of the plants were treated using the cut and spray method using the chemical Crossroads, but most received a foliar application of glyphosate (Roundup) for best results. Within Tract 2, the dense overgrowth of blackberry and Japanese honeysuckle located between the planting area and Neville Creek was brush cut with a hydraulic cutter and immediately sprayed with the herbicide Crossroads for optimal results. In addition, within the planting areas of Tract 1 and Tract 2 herbaceous competition management will be conducted as necessary during the first full growing season. Herbaceous competition management will consist of mowing as well as spot herbicide spraying to treat any regrowth of targeted invasive species. 3.4 Easement Boundaries Two separate conservation easements, one on Tract 1 and one on Tract 2, were secured along with access easements necessary to provide permanent access to the conservation easement areas. Easement boundaries are identified with wooden cedar posts spaced at approximately 150 feet to ensure clear distinction between the Site and adjacent properties. Boundaries may be further identified by marker, bollard, post, tree -blazing, or other means as allowed by site conditions and/or conservation easement. Boundary markers disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis. The easement boundaries will be checked annually as part of monitoring activities with the status of the boundaries reported in annual monitoring reports. 4.0 MITIGATION POTENTIAL As noted in the Neville Farms MBI, buffer credit determination is subject to the Temporary Buffer Rule 15A NCAC 02B .0295(h) and (i). Figure 3 (Appendix A) identifies the riparian areas and credit types for Phase 1 and Phase 2. In accordance with Rule 15A NCAC 02B .0295, the width of the buffer/nutrient credit generation area begins at the most landward limit of the top of bank or the rooted herbaceous vegetation and extends landward to a maximum distance of 200 feet. Nutrient offsets are not being generated within the areas described as Preservation. Preservation areas meet the requirements described in .0295 (m)(2)(D) — Preservation of Buffers on Subject Streams. Restoration areas meet the requirements of .0295(1) — Riparian Restoration or Enhancement. Nutrient Offset credits are consistent with rules 15A NCAC 02B .024. The following is a summary of the Jordan Lake riparian buffer credits and nutrient offset credit calculations for Phase 1 and Phase 2 of the Site. Detailed credit calculations are included in Tables 1A -1D (Appendix A). 4 Neville Farms Asbuilt & Baseline Document (Phases 1 &2) Watershed Investments NC Phase 1 (Tract 1) • 0.40 acres Riparian Buffer Preservation = 1742.4 square feet of credit • 3.74 acres Nutrient Offset = 7220.59 lbs -N delivered and 424.901bs-P delivered) Phase 2 (Tract 2) • 1.30 acres Riparian Buffer Restoration = 55,321.2 square feet (ftz) of credit • 0.54 acres Riparian Buffer Preservation = 2330.50 square feet (ft2) of credit As indicated in the Site's MBI, credits generated from riparian buffer restoration activities can be converted and transferred from buffer credits to nutrient offset credits with Division approval and from nutrient offset credits to buffer credits. However, when converting from nutrient offsets to buffer, all applicable ratios and percentages of full credit will apply according to 15A NCAC 02B .0295. Neville Farms' Nutrient Offset and Riparian Buffer credits will not be debited within the same area (not stacked). The Neville Farms Bank will service impacts within the Upper New Hope Subwatershed of Jordan Lake. 5.0 PROJECT MONITORING AND PERFORMANCE STANDARDS 5.1 Success Criteria Pursuant to criteria found in the Temporary Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295 and Neville Farms MBI, vegetative success for the Site will require the survival of at least 260 planted trees per acre at the end of Year 5 based on monitoring data compiled for the site and site visits by the DWR. Natural recruits will not count towards annual achievement of performance standards; however, they may be taken into account during review by the NC DWR. Recruitment of volunteer species in the floodplain is anticipated due to adjacent forests that exist upstream and on the stream bank. 5.2 Project Monitoring Plan Riparian vegetation monitoring for Phase 1 and Phase 2 will be based on the CVS Level 1-2 Protocol for Recording Vegetation, Version 4.2 (Lee et al. 2008). Annual vegetation monitoring will occur each year during the fall season with the first year for each Phase occurring at least 5 months after initial planting of the Tract/s. Vegetation monitoring plots measure 0.0247 acre in size and cover 2% of the planted area. Accordingly, four (4) permanent vegetative plots will be used to monitor Tract 1 and two (2) permanent vegetative plots will be used to monitor Tract 2. At the request of NC DWR, one (1) additional permanent vegetation plot will be installed in the Zone C Restoration area of Tract 1 during year 1 annual monitoring for a total of five (5) permanent vegetation plots in Tract 1 and two (2) permanent vegetation plots in Tract 2 (Figure 2, Appendix A). A reference photo will be taken from the southwestern corner of each plot. All planted stems in the plots will be marked with flagging tape and recorded. Data collected will include species, height, planting type (planted stem or volunteer), and grid location. Baseline data was collected on January 5, 2017 by Axiom Environmental and derived an average density of 607 planted stems per acre (excluding livestakes) (Table 7, Appendix B). The Sponsor shall submit to DWR an annual monitoring report for each phase, no later than December 31 of each year for five consecutive years. Reports will document the success of the vegetation and any maintenance, supplemental planting, or encroachment within the easement areas. As planting and the 5 Neville FarmsAsbuilt& Baseline Document (Phases 1 &2) Watershed Investments NC monitoring for both Phase 1 and 2 occurred on the same schedule, WINC intends to submit one Monitoring Report each year for at least 5 years to document the above requirements for both phases. All Monitoring Reports shall reflect the Phase for which it is being submitted. Monitoring bonds shall be renewed with confirmation of renewal provided to DWR with each annual monitoring report for each phase. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals. Invasive and noxious species will be monitored and controlled so that none become dominant or alter the desired community structure of the site. In addition, easement boundaries will be checked annually with the status reported in annual monitoring reports. 5.3 Adaptive Management Plan In the event that the Site, or a specific component of the Site, fails to achieve the defined performance standards, WINC will develop necessary adaptive management plans and/or implement appropriate remedial actions for the Site in coordination with DWR. Remedial actions will be designed to achieve the performance standards specified previously, and will include identification of the causes of failure, remedial design approach, work schedule, and monitoring criteria that will take into account physical and climatic conditions. 5.4 Long Term Management Plan WINC, acting as the Bank Sponsor, established a Conservation Easement for Tract 1 and Tract 2 separately. The Conservation Easements allow for yearly monitoring and, if necessary, maintenance of the Site for a minimum of five years post planting, or until DWR approval has been given. These activities will be conducted in accordance with the terms and conditions of the Neville Farms MBI. Prior to the submission of the 4th year monitoring reports for each Tract, Tract 1 and Tract 2 will be transferred to a responsible third party. The third party shall be responsible for periodic inspections of Tract 1 and Tract 2 to ensure that restrictions required in the Conservation Easements are upheld. Endowment funds required to uphold easement conditions shall be negotiated prior to site transfer to the responsible party. 6.0 FINANCIAL ASSURANCE To comply with the MBI, a monitoring bond was substituted for the performance bond and will cover the monitoring costs for the entire Site, or, at a minimum, be in the amount of $25,000. WINC reserves the right to acquire one monitoring bond to cover the costs of monitoring for both Phase 1 and Phase 2, or two monitoring bonds to cover the costs of Phase 1 monitoring and Phase 2 monitoring, separately. Each bond shall be renewed annually for at least 5 years, or until DWR approval of the Site's success criteria. This is a standard document given to citizen's inquiring about parcels of land. Our system is organized by PINs instead of physical addresses or latitudes / longitudes, but you should be able to easily cross reference the supplied data. The stream in question is shown on both the USGS and Soil Survey, hence portrayal on our GIS System. It also has associated floodway / floodplain with approximate required Orange County stream buffers as shown. With regards to the question of it being a jurisdictional stream subject to buffer rules ... Orange County is delegated by DWR to conduct Surface Water Determinations and our protocol is as follows: a stream is considered as jurisdictional if it shows up on the Orange County GIS System (a collection of both USGS and Soil Survey Streams) and can only be removed by staff certified in Surface Water Identification after a jurisdictional call of removal is made at the required cost for assessment ($200 for 1-2 Determinations/Site ). Our aerial imagery clearly shows the section of Neville Creek in question as a "water flowing" feature, so I saw no reason for a site visit at the expense of the client. On March 24, 2015, Ms. Merritt performed a site assessment of two properties near the subject site, which are more accurately described in the attached aerial map. If approved, mitigating these properties could provide riparian buffer credits and/or nutrient offset credits within the Lipper New dope Watershed of the Cape Fear River Basin. Ms. Merritt's evaluation of the two ,properties' for buffer and nutrient offset mitigation is shown below: Gambill Property • Stream onsite is Neville Creek and was determined to be at least lntermittent by the Town of Chapel Hill (email from Wesley Poole with Orange County on February 9, 2015). • The narrow forest fringe along Neville Creek was described to be mature with a closed canopy the entire length of Zone 1 of the proposed mitigation area. Therefore, Zone 1 is viable for buffer preservation only and suitable for buffer mitigation credit only. • The existing land use condition within ,Zone 2 of the Jordan buffer (21-50') was determined to be active hay crop cultivation. Therefore, Zone 2 is viable for buffer restoration and suitable for either buffer mitigation credit or nutrient offset credit. • The existing land use of the riparian area located outside of the Jordan buffer (S1-200') was determined to be active hay crop cultivation. Therefore, this area is viable for riparian restoration and suitable for either buffer mitigation credit or nutrient offset credit. Summary of project, changes in the as -built to Phase 2, and revised nutrient offset calculation Project Overview Neville Farms Buffer Mitigation and Nutrient Offset Bank ("Neville Farms") is located south of Chapel Hill in Orange County and consists of two Phases. Neville Farms' Mitigation Banking Instrument (MBI) was signed between Watershed Investments NC, LLC (WINC) and the NC Division of Water Resources (DWR) and effective on January 29th, 2016. The purpose of this project is to generate Jordan Lake riparian buffer restoration and preservation mitigation credits as well as nutrient offset credit for use in the Upper New Hope Subwatershed of Jordan Lake. Phase 2 restoration activities completed include the control of invasive plants and the planting of native hardwood species on land formerly managed fescue lawn. Phase 2 of Neville Farms is located on an approximately 9 acre residential property. During the construction of Phase 2, adjustments were made to the area included in the conservation easement that differs from that planned easement reviewed by the DWR for the Bank Parcel Development Plan (BPDP). Differences between the BPDP and as -built easement boundary are for the following reasons: • The planned easement area was drawn remotely using GIS and tax parcel data. Parcel data, however, did not reflect the surveyed location of the property boundary. Use of the surveyed boundary resulted in conservation easement boundary changes (effect: increased area). • Field identification and survey of the top -of -bank used to mark the easement boundary edge as opposed to GIS identification (effect: refinement of top -of -bank with little overall area change). • The property owner sought to exclude a corner of the planned easement to maintain its historic recreational usage and playhouse structure (effect: decreased area). As part of the BPDP, the Division directed WINC to use Version 3.0 of the Jordan -Falls Stormwater Tool to estimate nutrient reductions from Phase 2 of the project. For consistency with this approach, the same tool and version are used to estimate nutrient reductions based on as -built conditions. Attachment B contains a copy of the Jordan -Falls tool worksheets reflecting as -built conditions while Attachment D contains the original documentation that was reviewed and approved by the Non -point source branch for the BPDP. It describes the project, restoration activities, and nutrient offset calculations. A map of the site and contributing drainage area is included in Attachment C. The watershed draining to Phase 2 continues to experience development. In particular, The Orchard, a community of mostly two acre lots continues to build and sell lots in what was formerly wooded land. Tract 2 of Neville Farms Nutrient Offset Calculation Summary Project Overview Tract 2 is part of a larger restoration project identified as Neville Farms in the Bank Parcel Development Plan that is currently being developed. Located adjacent to Neville Creek, a perennial stream in Orange County, Tract 2 is on an 8.8 acre property owned by John McGee. The watershed draining through the project site encompasses 31.6 acres. The proposed Tract 2 conservation easement is approximately 1.7 acres with 1.20 acres anticipated for reforestation. The remaining 0.5 acres, a narrow, mature buffer ranging between 10 and 20 feet exists in portions of the easement area, will be considered as buffer preservation with no proposed nutrient reduction benefit. Attachment C provides a map of the Site including the land draining to it. For areas of the conservation easement lacking a forested buffer or with forests less than 50 feet, residential lawn will be replaced with native trees to create a buffer with widths varying between 50 and 150 feet. In accordance with current DWR policy, success criteria on the project will be based on a minimum planted stem density survival of 260 stems/acre after 5 years. Currently, the majority of Tract 2 consists of residential lawn. While it is eligible for buffer credit, staff from the 401 and Buffer Unit directed me to work with the Planning Section to develop the nutrient offset crediting because the site falls outside of the typical practice for generating nutrient offset credit (i.e., riparian reforestation of agricultural land). Attachment D contains a copy of the letter summarizing their determination. Nutrient Reduction Calculation Summary The calculated nutrient credit available for the site is 1091.10 N lbs and 243.00 P lbs. This is based on an annual nutrient offset crediting for the site of 36.37 N pound (lbs)/year and 8.10 lbs/year multiplied by 30 years. The method used to quantify nutrient offset credits has been developed through coordination and communication with the NC DWR Planning Unit staff. The agreed on approach involves the use of site-specific factors and the Jordan -Falls Stormwater Accounting Tool (JFSAT) Version 3.0. Supporting printouts from the tool are included in Attachment B. A summary of the nutrient offset calculation is included below. Table A-1 provides a summary of the estimated reduction from the JFSAT. The JFSAT accounts for both land conversion for nutrient removal from upland sources. The upland area is 29.93 acres. This area includes The Orchard, a development under construction that contains a mix of residential and forest land use with 2 ac residential lots being the predominant parcel type.
