PROJECT SUMMARY: The applicant proposes to construct a 49-unit condominium complex with associated driveways, parking areas, stormwater system, utilities and kayak launching facility. PROJECT DESCRIPTION Coastal Planning Services, Inc., representing Mainsail of Beaufort, LLC, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located at the intersection of Turner Street and West Beaufort Road, adjacent to Town Creek, in Beaufort, Carteret County. To find the property, take Highway 70 east from Morehead City to Beaufort. Turn left onto Turner Street, in Beaufort, and the property will be located on the right hand side, at the intersection of Turner Street and West Beaufort Road. The subject property is bordered by residential and commercial properties to the north, west and east and by Town Creek to the south. Historically, or at least for the past 10-15 years, the project site operated as a mobile home park. The mobile home park was recently demolished and only a portion of the infrastructure remains, including an access drive, concrete culvert and several parking pads. The applicant has begun lot preparation and utilities installation at this site and is currently working along the northern portion of the property, outside of the 75' Area of Environmental Concern (AEC). The applicant has stockpiled fill material onsite and has established appropriate sedimentation and erosion control features. The remaining portion of the site, which is located within the 75' AEC, remains untouched and exhibits a marginal amount of vegetation (consisting mostly of lawn grasses and shrubs). A concrete culvert traverses the property and runs parallel to Turner Street beneath the concrete entrance drive. A small section (approximately 60 square feet) of Coastal Wetlands exists at the northern end of the culvert, and appears to be isolated and non-tidal. A second area of Coastal Wetlands (approximately 615 square feet) exists along the southern side of the culvert and this area also appears to be non-tidal. These two areas of Coastal Wetlands appear to be flooded only during extremely high tides. Water located within the culvert (that which is feeding the Coastal Marsh) appears to be stagnant and hydraulically complacent, with no tidal influence. The entire southern shoreline is stabilized by rip-rap material which gradually tapers off towards the high ground. There does not appear to be any "404" type wetlands located between the Coastal Marsh and the uplands due to the slope and grade of the property. Intermittent sections of Coastal Wetlands, primarily Smooth Marsh Cordgrass (SpartinaAlterniiora), exist along the southern shoreline bordering Town Creek. Elevation at the site ranges from 4-6 feet about Mean High Water. According to Carteret County, the CAMA Land Use Classification for the area, within and around the project site, is Conservation (within the waters and surrounding marsh) and Residential (along the high ground). The North Carolina Division of Water Quality classifies the waters of Town Creek, adjacent to the project site, as SC. The N.C. Division of Marine Fisheries does NOT designate the area as a Primary Nursery Area (PNA). According to the Division of Environmental Health, Shellfish Sanitation Section, the area located within Morgan's Creek is CLOSED to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to redevelop the 8.0-acre tract by constructing an entrance/exit drive (Mainsail Drive), forty-nine condominium units, amenities, utilities, storm water collection/treatment system, pier and kayak launching facility. Additionally, the applicant is proposing to remove the existing box culvert and excavate approximately 615 sq. ft. of coastal marsh. The details of the development are as follows: Beginning along the entrance to the property, adjacent to Turner Street, the applicant proposes to remove the existing concrete driveway and box culvert. Currently, a 615 sq. ft. area of Coastal Wetlands exist along the northern side of the driveway, within and adjacent to the boxed culvert. The culvert, which is full of debris, is essentially a closed system and is only being flooded during extremely high tides. The coastal marsh is present due to constant ponding of water within the culvert. The applicant's proposal is to remove the existing culvert and excavate the 615 sq. ft. area of Coastal Wetlands. According to the application package, a 6' x 80' x -4.5' section of earth would be excavated for culvert removal. The excavated material would remain onsite and would be used as backfill for other phases of the project. A new 48" culvert would be installed beneath the proposed entrance/exit drive (for the western driveway) and would measure approximately 76'. The top of the new culvert Mainsail of Beaufort, LLC, C/o Richard Sockett Page Three would be placed approximately 2.3' above the Normal High Water (NHW) line. Two earthen swales (approximately 20'(w) x 30'(1)) would be constructed on each end of the proposed culvert to allow for adequate drainage and tidal flow. These swales would be tapered to a grade of approximately 0', relative to normal low water. Once the existing culvert is removed, and the new culvert and swales are installed, the area should regain tidal characteristics. It should be noted that only a small portion of the upland development is located within the 75' AEC, specifically the access road, culvert, swales, a portion of condominium unit(s) #23, 448 and #49, and a portion of the driveway accessing condo 423. Additionally, a portion of the storm water overflow piping (associated with the SW pond) is located within the 75' AEC. The remaining upland portion of the project is located just outside of the AEC. Within the interior portion of the property, the applicant proposes to construct forty-nine (49) town home/condominium units with paved driveways, Mainsail Drive (which extends from Turner Street to W. Beaufort Road), utilities and a storm water collection/treatment system. Units 1-22 would be constructed on the northern side of Mainsail Drive and units 23-49 would be constructed on the southern side. Each unit would measure approximately 25' x 40' (footprint) and would run in a north south direction. Storm water collected from these units would be channelized towards Mainsail Drive, and then gravity fed to the proposed storm water collection pond located in the northeast corner of the property. Utilities for the complex would be located within the Mainsail Drive right-of-way. A thin strip of landscaping is proposed along the southern shoreline, within the 30' Coastal Shoreline Buffer. As proposed, the landscaping would consist of trees and native vegetation. No artificial shoreline stabilization features are proposed at this time. In addition to the upland development, the applicant is also proposing to construct a pier and kayak launching facility. According to the application package, a 6' x 78' concrete sidewalk would provide access to the launch facility from Mainsail Drive. The concrete walkway would terminate at the 30' Coastal Shoreline Buffer, and from that point waterward, the applicant proposes to construct a 6' x 36' wooden access pier that would provide access to the platform and step-down launch area. The platform (6' x 26') would be constructed below the NHW line and straddle the outer edge of Coastal Wetlands. The outer limits of Coastal Wetlands, in the vicinity of the proposed platform, vary and the line is irregular. A small portion of the platform (located on the eastern side) would extend approximately 6' over the Coastal Marsh. The remaining portion of the platform would cover approximately 2' of Coastal Marsh. The proposed 3' x 20' step-down would be constructed on the outer edge of the main platform and no portion of the step-down would be located over Coastal Wetlands. As proposed, the terminal end of the launching facility would stop just shy of the near shore edge of the channel, within 1/4 of the width of the waterbody. The applicant has indicated that municipal water and sewer would be provided by the Town of Beaufort City. The applicant submitted an Express High-Density Stormwater Permit application to the North Carolina Division of Water Quality. The Express Stormwater Permit was modified on 1/29/08, under project number SW8070820. The applicant has also submitted, and obtained approval of a Sedimentation and Erosion Control Plan (SECP) from the Division of Land Quality. The plan was approved on 6/23/08, and was issued under Carte-2008-149. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 9.0 acres of high ground. The proposed building/condos, driveways and parking area would result in the creation of approximately 148,052 square feet of impervious surface. The construction of the proposed pier and kayak launching facility would incorporate approximately 240 sq. ft. of public trust and estuarine waters. The project site is located on the southeast corner of the intersection of Turner Street (NCSR 1174) and West Beaufort Road (NCSR 1170) and borders Town Creek. The Town of Beaufort has granted approval for construction of 49 units and related amenities on the site. State stormwater and erosion and sedimentation control plans have also been approved for the project. Copies of these state approvals are attached. A mobile home park and apartments previously located on the project site have been removed. Outside the CAMA AEC, work has begun on site preparation and installation of utilities and other project infrastructure. Within the CAMA AECs, the project consists of demolition and removal of existing infrastructure and debris, as well as new construction. The proposed work is listed below and is identified in textboxes on enclosed project plans. Within the southeast portion of the site, the following structures/items located within an AEC will be abandoned and/or removed as shown on page 1 of project plans: 1. Two sections of existing sewer pipe will be abandoned (one section measuring 78', another section measuring 18'). The sewer pipe will be removed if necessary for proposed new construction. 2. 254 linear feet of existing water main will be abandoned, and removed if necessary for proposed new construction. 3. Two sewer manholes will abandoned, removed to below grade, and filled. 4. One existing fire hydrant will be removed. 5. One existing storm drain will be abandoned, and removed if necessary for new construction. 6. Miscellaneous debris in creek and along shoreline will be removed (please see attached photographs Al/A2, A3 A4, A11/A12) Within the western portion of the site, the following structures/items located within an AEC will be demolished and/or removed, as shown on page 1 of project plans: 1. Land disturbance within the coastal shoreline AEC is to be minimized during clean-up and re-vegetation activities and includes light grading, planting, seeding, and mulching. Debris removal from coastal wetland areas is to be accomplished with minimal disturbance by hand or, if necessary, by equipment with extended reach capabilities. Project plans specify no digging or excavation in coastal wetlands or below normal high water (NHW) during the clean-up process. Debris is to be "grabbed" and lifted from its position. Where debris removal creates vegetative voids in coastal wetland and water areas, appropriate indigenous coastal species will be planted based upon location relative to normal water levels. Construction of project components for which CAMA express permits are requested are listed below. These components are shown on page 2 of project plans: 1. Stormwater and erosion and sedimentation control measures in the eastern portion of the site to include: • rock/silt check dam consisting of about 4' of 24" reinforced concrete pipe storm drain with about 12 square feet of riprap and installation of about 108 square feet of riprap at the end of the stormwater outlet swale, • 35'of 8" PVC storm drain with approximately 12 square feet of riprap, and • stormwater outlet swale. 2. Units 23, 24, 48, and 49 - areas within AECs include portions of buildings, covered front decks, and uncovered rear decks to be located in the coastal shoreline AEC (please see page 2 of plans for specific built-upon areas for each of these buildings). 3. Driveway/parking area to serve building 23 (page 2 of plans provides specific built-upon square footage for each building driveway/parking area to be located in the AEC). 4. Installation of underground utilities (electric, cable, and phone) in continuous trenches within a 15' wide area along the rear of all southern units as shown on project plans. 5. Walter Cole of Soil & Environmental Consultants performed a coastal wetland delineation of the project site that was approved by Ryan Davenport of the Division of Coastal Management on December 14, 2006. Included with the project plans submitted in support of the CAMA permit application is a map of the approved wetland delineation. All proposed landscaping will be located outside of and landward of the delineated wetlands. Landscaping will consist of trees, shrubs, and mulch, with an emphasis on indigenous species.
