I strongly recommend that you hire a civil engineer to size the culvert. It doesn't matter that you installed a culvert that is the same size as the one 150 feet upstream. It could be too large or two small depending on the situation and in both cases it is a problem if your objective is compliance with our Federal permits. Most banks will not issue a mortgages where there are violation or non- compliance with Federal laws/regulations. When you stick a pipe in a stream without careful thought, you can destabilize the stream and cause flooding and/or erosion up and down stream. This is especially true in urban areas. If the culvert is too big, you can reduce the depth of the water in the channel which adversely affects the ability of aquatic life to pass through the culvert. If the culvert is too small, you can impound water and cause flooding upstream during large storms. Nationwide Permit 18 requires (among many other things) the following: - The culvert be buried 12 inches into the stream bed. See the attached cross section. We do not care about the dirt on top of the culvert. You are required to dig down into the stream bed enough so that the bottom of the culvert is 12 -inches below the existing stream grade. Sediment fills the bottom of the culvert which mimics that natural ecology of the stream. You would then cover the top of the culvert with dirt. - The dimension, pattern, and profile of the stream above and below a pipe or culvert should not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. - The width, height, and gradient of a proposed culvert should be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. - Culverts are to be designed and constructed in a manner that minimizes destabilization and head cutting. Destabilizing the channel and head cutting upstream should be considered and appropriate actions incorporated in the design and placement of the culvert. It is pretty difficult to be able to demonstrate that unless you have some experience with hydrological modeling and engineering. Please let me know your availability this afternoon. You sure make it sound simpler than what we were being lead to believe after the fact. I am the current homeowner for the property and we were the ones that contracted the pipe being installed on our newly bought land back then. I would like to resolve this in some fashion as I will need to do so whether John continues to purchase the home or not as I will still have the same issues going forward and will have to disclose to be ethical and honest. A couple points to your detailed writing below: 1. When the call came in to the city at the start of this email thread the pipe was already being installed. The neighbor was mad at us for buying the property and half of his back yard was why he did many things to hinder me and my family. 2. The area around the creek was already relatively clear with a bridge and walking path on both sides as well as a small field type area directly where the house sits today. There was a rope swing and area where kids played in the creek. It was made to be safe place. I don't have any pictures. 3. We were told prior to the installation of the pipe that no permit was needed as it was less than an acre and by the area grandfathered in. The only puddling in the creek that I remember was the area still there below the installed pipe. No other areas in the creek on our land is that puddling. 5. We chose to use the 48" double corrugated pipe, which is over kill we were told, because that is what size the state DOT used about 75 yards up the creek where the road passes over. 6. There was a bend in the creek and we did not alter the lay of the creek. We had them install an expensive angle piece of pipe to bend with the existing creek so any impact would be minimal. 7. We could review the amount of dirt on top of the pipe in some areas. At the ends it is not 12" covering for sure as we used large stone to surround the pipe up to about 10 feet before the pipe entry. We wanted to monitor if any erosion was going to take place from the install. We could raise the level of dirt on the pipe where needed now as we have seen or had no issues. Rarely does the creek get above a 18" even is hard down pours. There is some grading that needs to take place there for the buyer anyway so this would be easy to accomplish. 8. After the pipe was installed and we received the email I did check to see how to permit and who to contact. Going through the difficult process as it was explained kept me from going any further all this time. I have no excuse or comments for my lack of action. It would be very troubling if they have not contacted us considering the recommendation of the City of Charlotte. The Federal permitting on this is a bit complicated because there have been many changes since the impact occurred. The culvert would probably have qualify for a Nationwide Permit (NWP) 18 or 29 at that time depending on the circumstance. I have attached these permits for your reference. The NWP 18 is for minor discharges and can be used, in certain circumstances, without submitting a paper application to our office. We call this a non -notifying or non -reporting permit. In order to qualify for a non -notifying NWP 18 at that time the stream would have to be void of riffles and pools, the discharge would have to be less than 25 cubic yards in the stream bed, the discharge could not involve the loss of 0.10 acre of waters, and the project could not involve cutting of trees greater than 3 -inches diameter as breast height in or next to the stream. I would need more pictures of the stream on the up and down stream ends of the culvert to determine whether it contains riffles and pools. It would also be helpful to have photos of the stream before the impact. The discharge was most certainly less than 25 cubic yards in the stream bed and probably did not result in a loss of greater than 0.1 acre of waters. However, large trees were obviously cut to install the culvert. The tree cutting required the submittal of an application in August of 2015 because large trees are habitat for the threatened Northern Long Eared Bat. However, we have recently signed an agreement with the U.S. Fish and Wildlife Service that allows these non -notifying activities to proceed without the submittal of a paper application in certain areas (Charlotte being one of those areas). Nationwide Permit 29 for residential subdivision always requires notification. We generally do not like to see such a large impact for a residential yard. If they had called us prior to installing the culvert, we would have asked them to demonstrate that they actually need the culvert and cannot avoid the impact. In this case, it is clear from the photos that there would be no yard at all if there wasn't a culvert. I am willing to allow the culvert to remain under a non -reporting NWP 18 under the following circumstances: 1. The project qualifies for a non -notifying NWP 18 as described above. 2. The U.S. Fish and Wildlife Service (copied) does not object. If we determine that an application is necessary, the property owner will need to go through enforcement proceedings with our office which could take 3-6 months. I would recommend the property owner contact me at their earliest convenience to discuss the culvert. If there is a violation of Federal law on the property, it prevents potential buyers from acquiring a mortgage loan in good faith. Also, even if we do allow the culvert to remain under a non -notifying NWP 18, it still must be in compliance with the terms and conditions of NWP 18. For example, if the culvert is in fact 48 -inches, the culvert must be buried 12 -inches to allow for aquatic life passage. It does not look like it is buried 12 - inches. The culvert also must be designed to maintain stream base flows and not change the hydrologic regime of the stream. This really requires a civil engineer to properly size the culvert. We suggest these engineered plans for this be submitted to us for review, but it is not a requirement by our ordinances since your project involves under 1 acre of grading/disturbance — technically we have no plan submittal/permit requirement. Due to significant drainage area to the site, it is possible the 0100 to the site is >50 cfs — therefore I'd recommend you have a civil engineer study the 100+1 stormwater flooding impacts. The goal would be to ensure you cause no rise in 1 00y flood hazard on adjacent properties, and that you set the new house pad safely above the flood hazard (100yr peak elevation at the lot + 1' is typical requirement). Stream impacts (filling/piping) would be need to be verified and go through permit process by NCDENR/USACE as we discussed. My recap is: A couple of items we agreed on were: 1. You had no issue with the pipe or the installation of the pipe. Looked good. No need for it to be adjusted or removed. You felt better about the situation when you saw the circumstances and installation. 2. 1 would simply get a back dated permit and pay a fee 3. 1 needed to extend or remove the drain line causing some erosion to bank at the top end of the drainage creek. 4. The pipe could not be any longer than 150 feet and it is about 120 feet so it does not exceed that amount. The 4 conditions that I was asked to email you during the meeting to get this resolved and work through was as follows: 1. 1 would have at sign a trolling agreement which simply states I will work with you to resolve this matter. I am awaiting the agreement from you. 2. 1 have to fill out the application and you would send me a link to do so. I will do that the day you send it. 3. There is a fee to pay to the state for the application and I have to get that from Alan which I have copied on all emails. I need that amount and address. 4. 1 may have to fill in the bottom of the pipe to make the state happy. I will do so as soon as you tell me, but you thought it was fine the way it was.
