On November 8, 2016, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification from the Divisionfor the above referenced project.
Additional information (signature page & agent authorization form) was received on November
9, 2016. A request for additional information was sent on December 5, 2016. Additional
information was received on February 2, 2017. Additional information following the February
20,.2017.scheduled meeting was received via emaiL.on March 9, 2017 and. at the Ashevilleii.
Regional office on March 10, 2017. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following
information is received: -
1. On February 20, 2017 The Division of Water (DWR) met with the Broadway Group to
discuss additional information items for the New Retail Store in Transylvania County. We
discussed the additional information items at the meeting. We also discussed avoidance and
minimization clarification,DWR requested a more detailed initiative for each alternative site
plan layout proposed for the project. DWR also requested that all jurisdictional features be
shown as an overlay on all site plan layouts.
The new information provided, received March 10, 2017 included the same narrative and site
plans submitted on February 2, 2017 (attached). - -
Please provide the avoidance and minimization clarification requested for each site plan
layout.

2. Sheet #4 of the proposed project plan, dated, March 6, 2017 outlines the temporary diversion
plan view. Provide the detail for B2 "open" shown on the plans.
Clarify and describe how the water will be diverted from the center of the stream to the top of
the temporary diversion without violating water quality standards and maintaining stability of
the area.
3. Clarify and explain if the 44LF 30" RCP pipe labeled on the plans is a permanent structure.
This pipe is shown on sheet # 9 (Storm Plan) Sheet 10 (Storm Cross Sections) and Sheet 14.
(Landscape Plan). Is this structure permanent and if so why is it needed after the temporary
diversion has been completed?
4. Clarify that no untreated stormwater is entering any of the open throat inlets (ex. B3 OTI).
5. Clarify the area of the outfall of the pump around. If any permanent or temporary fill will be
placed below the ordinary high water mark, please update the impact table to reflect the
current impacts. Explain and clarify the coir matting proposed. Provide additional
information that this method will provide appropriate stability of the stream bank and stream
channel during water velocities of the temporary diversion procedure.
