The subject property is located southeast of the intersection of Davis Drive and Airport Boulevard within the Town of Cary, North Carolina. The project lies within the Neuse River Basin. The project area is 21.66 acres of the total 34 -acre property currently owned by Redus Twin Lakes LLC, and will be developed by Leyland Alliance. The subject property drains to Crabtree Creek, which is designated Class C/NSW, a tributary to Crabtree Lake within the Neuse River basin (HUC 03020201). There is one perennial stream feature (stream `A') which originates north of the property, and flows south adjacent to the eastern property boundary for approximately 500 linear feet before it flows into a lake (Lake A) that also lies just east of the property boundary. The stream feature is depicted on the Wake County Soils Survey map, but not the USGS quadrangle, and is therefore subject to the Neuse River Riparian Buffer Rules (Figures 1 & 2). This feature is also subject to the Town of Cary Urban Transition Buffer (UTB) rules, and will require a 50 -ft UTB. Lake A is depicted on both the Wake County Soils Survey map and the USGS quadrangle, and is therefore subject to the Neuse Riparian Buffer Rules, as well as a 100 -ft Town of Cary UTB. There are no surface waters within the subject property; however, Neuse and Town of Cary UTB, buffers for the adjacent surface waters extend onto the subject property. There are also three riparian wetland areas within the project boundary, wetlands "A", "B", and "C" that total 0.319 acres. A jurisdictional wetland and stream delineation performed by McAdams Company was field verified by Ms. Tasha Alexander (USACE representative) on August 31, 2016. A Preliminary Jurisdictional Determination was issued September 16, 2016 (AID SAW -2016- 01492). The NC Division of Water Resources (DWR) also field verified the locations of surface waters on and adjacent to the subject property, and LEY -15010 Ms. Karen Higgins Twin Lakes March 14, 2017 Page 3 of 7 documented their findings in a letter dated June 27, 2003 (NBRRO 03-143). This buffer determination has no expiration date, and thus is still valid. The limits of the streams and wetlands have not changed since these original determinations. See Figures 1-3 and the enclosed documentation for existing conditions.Land use within the vicinity of the project is mainly residential, commercial, and forested. PROPOSED IMPACTS: The proposed mixed-use project known as Twin Lakes is comprised of a 21.66 -acre project area within a 34 -acre parcel of land currently owned by Redus Twin Lakes LLC, and will be developed by Leyland Alliance. Twin Lakes will consist of a 131,000 square foot grocery anchor and 26,900 of commercial/retail development fronting Davis Drive, pedestrian/greenway access paths, and public gathering spaces (Figure 4). The proposed project will also include associated utilities, stormwater management, and roadway improvements along Davis Drive. The entire site was designed to minimize impacts to aquatic resources while utilizing the remaining parcel. The design is for a high density project within the project area, but all sedimentation and erosion control measures will be implemented before construction to minimize runoff. A network of stormwater management facilities will be strategically placed throughout the site to treat and detain storm flows coming from the site. Although efforts have been made to avoid impacts to jurisdictional waters, two wetlands will be impacted by grading and fill associated with two retaining walls, a road, a sidewalk, and a parking lot. There is a total of 0.124 acres of riparian wetland impacts associated with the proposed project, while avoiding the remaining 0.195 acres of riparian wetlands. There are no stream impacts associated with the proposed project. Chessway Drive in the northwest corner of the project area must line up with the existing Chessway Drive on the north side of Airport Boulevard as dictated by NCDOT. There is also 0.017 acre of wetland impact proposed to wetland `B" associated with a public gathering park space on the southern end of the proposed project, which will incorporate a retaining wall to minimize wetland impacts, however, there is some minor grading required in this area and within wetland `B' to construct and maintain the integrity of the retaining wall. There are three proposed stormwater outfalls and one proposed sanitary sewer connection will necessitate impacts to Neuse buffers. There is a total of 2,383 s.f. of impacts to Zone 1 and 1,690 s.f. of impacts to Zone 2 of the Neuse buffer. There is an existing Town of Cary sanitary sewer located within and parallel to the Neuse Buffer along the existing lakes, which is dictating one proposed sanitary connection to the existing sewer within Zone 2. The design of the three stormwater outfalls are required to discharge to the existing lakes, and the through the Neuse Buffer in these locations at a perpendicular or near perpendicular angle. Typical construction equipment, such as a long-arm track -hoe, front end loader, and bush hog will be used for the initial clearing. There is a total of 0.124 acres of riparian wetland impacts associated with two proposed retaining walls, a parking lot and a sidewalk within the project, while avoiding the remaining 0.195 acres of riparian wetlands. There are retaining walls proposed to minimize wetland impacts, however, there is some minor grading required in these areas to construct and maintain the integrity of these retaining walls. The applicant proposes mitigation in the form of avoidance and minimization to waters of the U.S. DIFFUSE FLOW & STORMWATER MANAGEMENT PLAN: The proposed stormwater management plan for Twin Lakes will be designed to protect the downstream environment. The proposed project will result in a significant increase in peak flow rates. To mitigate this impact, the proposed facility has been sized such that post -development peak flow rates are no greater than pre -development levels in the 1-, 2-, 5-, and 10 -year storm events. The plan incorporates stormwater management techniques to manage both water quantity and quality aspects of site runoff. Stormwater management for Twin Lakes will be accomplished by incorporating engineered stormwater best management practice facilities to capture and treat the stormwater runoff from developed areas. Two stormwater ponds are proposed. Other stormwater treatment devices that will be used are level spreaders in conjunction with vegetated filter strips, which are designed to remove a minimum of 40% average annual total suspended solids (TSS), and provide 30% total nitrogen and 35% total phosphorus removal. The stormwater ponds will serve the dual purpose of water quality and water quantity (i.e. detention) control. Since the Town of Cary is a delegated authority for NCDWR Stormwater Management Plans, the review and approval of the SWMP is part of the Town of Cary review process. The proposed development will be subject to the stormwater management requirements set forth in the Town of Cary Land Development Ordinance (LDO). Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to jurisdictional wetlands, streams, and buffers have been avoided and minimized to the maximum extent practicable. There is a total of 0.124 acres of riparian wetland impacts associated with two proposed retaining walls, a parking lot and a sidewalk within the project, while avoiding the remaining 0.195 acres of riparian wetlands. There are retaining walls proposed to minimize wetland impacts, however, there is some minor grading required in these areas to construct and maintain the integrity of these retaining walls. There is a total of 2,383 sf (0.055 acres) of Zone 1 Neuse Buffer impacts, and 1,690 sf (0.038 acres) of Zone 2 Neuse Buffer impacts. There are no stream impacts associated with the project. The buffer impacts are necessary for the installation of three stormwater outfalls and one sanitary sewer connection. Impacts to Neuse Buffers associated with the proposed referenced infrastructure have been minimized by designing them perpendicular to the stream/lake shoreline and Neuse Buffers. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Page 7 of 14 PCN Form — Version 1.3 December 10, 2008 Version The design is for high density development, but all proper sedimentation and erosion control measures will be implemented, and there is a network of stormwater management facilities strategically placed throughout the site to treat and minimize runoff. Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation, as described in the Erosion Control Plan sheets to be reviewed and approved by the NC Division of Land Quality and/or Town of Cary Water Resources Department. All work will take place during dry conditions and can be facilitated from high, non jurisdictional, stable ground adjacent to the shoreline. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, tree protection, and other measures as shown on the erosion control plans, clearing only as necessary to install these devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. All slopes shall be graded no steeper than the angle that can be retained by vegetative cover or other adequate erosion control devices or structures. No material for construction will be placed in wetlands, streams, or Neuse Buffers at any time. Excavation will be limited to the area necessary for site preparation; all excavated material will be placed and retained on high ground above the flood pool elevation.
