Gentlemen:
On July 15, 2008, the Division of Water Quality (DWQ) received your application dated May
28, 2008, to fill or otherwise impact 720 linear feet of perennial stream, and 48,423 square feet
of Zone 1 Neuse River basin protected riparian buffers and 5,416 square feet of Zone 2 Neuse
River basin protected riparian buffers to culvert 720 feet of perennial stream at the site. On June
30, 2008, the DWQ received additional information from you, however, the DWQ has
determined that your application remains incomplete and/or provided inaccurate information as
discussed below.
1. You have proposed to fill (culvert) 720 linear feet of buffered stream. This proposed
activity will require a Major Variance from the DWQ. If you still want to pursue this
project you may do the following: pursue a Major Variance and reapply with the DWQ
401 Wetlands Permitting Unit if need be, or redesign your site and reapply with the DWQ
401 Wetlands Permitting Unit if need be.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
