Dear Ms. Homewood:
Mr. Craig Stone, Jasper Pointe, LLC, (Applicant) received a March 6, 2017 letter from the
NCDEQ-DWR requesting information to process the application for a 401 Water Quality
Certification (WQC) for the above referenced project. The purpose of this letter is to address
the request for additional information.
NCDEQ-DWR Comment 1): According to the parcel information provided in the application, the
current owner of the parcel is John Mark Golding. Pursuant to 15A NCAC 02H .0502(f), when
the applicant (Jasper Pointe LLC) does not have title to the property, documentation must be
provided that the applicant has been authorized by the owner to apply for a certification.
Please provide that documentation.
Applicant Response: An agent authorization form from the owner of the parcel is attached.
NCDEQ-DWR Comment 2): Please provide more details regarding avoidance and minimization
of stream and wetland impacts for this project. This Office believes that the road impacts as
shown on the plans as can be moved or reconfigured within the property boundary to avoid the
impacts to the stream. Please revise the plans to avoid the impacts or provide a detailed
explanation of why this plan for the activity cannot be practically accomplished, reduced or
reconfigured to avoid impacts to the stream and wetlands. [15A NCAC 02H .0506(f) and (g)]
Applicant Response: The applicant has an option to purchase a sub -divided parcel as shown on
the attached recorded survey PLAT. The remaining 1.779 acre parcel (shown as Parcel 2 in
attached PLAT) is not available for the applicant to purchase. Therefore, the proposed project

has no other reasonably alternative to provide access to the proposed multi -family residential
property that would avoid impacts to jurisdictional waters. During construction of the
necessary access road a grading easement is required on an adjacent property. A copy of the
grading easement agreement is included as an attachment.
NCDEQ-DWR Comment 3): The stormwater plan calculations note that due to the required
grade on the entrance road into the property a portion of the impervious area cannot be
treated in the SCM. However it appears that there is available area adjacent to the road and
within the property boundary for a stormwater control measure. Please redesign the project to
ensure that stormwater from all impervious surfaces is treated in a primary stormwater control
measure or provide further explanation of why the area adjacent to the road and part of the
parcel is not available for additional stormwater treatment.
Applicant Response: The applicant has revised the stormwater management plan to remove
curb and gutter from the access drive. The remainder of impervious surfaces will be treated by
the proposed bio cell. A copy of the updated Construction Plan and Profile is included as an
attachment. As shown on the attached drawings and acknowledged by the applicant, the bio
cell discharges within the vicinity of adjacent properties.
NCDEQ-DWR Comment 4): Please provide a BMP Supplement Form with all required items for
every BMP on the site (see http://portal.ncdenr.org/web/wq/ws/su/bmp-manual). [15A NCAC
02H .0506(b)(5) and (c)(5)]
Applicant Response: A BMP Supplement Form is attached.
NCDEQ-DWR Comment 5): Please submit an original signed and notarized O&M Agreement
form. Sample O&M forms are available at: http://portal.ncdenr.org/web/wq/ws/su/bmp-
manual. [15A NCAC 02H .0506(b)(5) and (c)(5)]
Applicant Response: An original signed and notarized O&M Agreement form has been mailed
to Ms. Homewood's attention separate of this response.
NCDEQ-DWR Comment 6): Please provide a soils report that states the level of the SHWT
elevation based on a boring within the footprint of the proposed BMPs. [15A NCAC 02H
.0506(b)(5) and (c)(5)]
Applicant Response: A SHWT Determination Report for the proposed BMP is included as an
attachment.

TEMPORARY GRADING EASEMENT
'PHIS TEMPORARY GRADWG p.ASEMENT (this "Easement') made this L3 day
Of r&� , 2017 by Jahn Mark Golding ("amnio") to Jasper Pointe, LLC, a North Carolina
limited liahiloy company ("Grantee").
RECITALS:
A. Grantor is the owner in fee simple of that certain 1799 acre tract of mal properly,
7, ore particularly described as Tract 2 on Final Plat Jasper Pointe Apartments" dated December
2016 and recorded in Plat Buck 33, Page 96, in the Office of the Register of Deeds of Slnry
County, North Carolina (the "Granter Property").
B. Grantee is the owner in fee simple of that certain 5 619 acro tract of real property
more particularly described as Tract 1 on Final Plat Jasper Pointe Annulments" dated December
7, 2016 and recorded in Plat Book 33, Page 96, in the Office of the Register of Deeds of Sorry
County, North Carolina (the "Grantee Property').
C. Gmnmc has requested that Grantor grant to Grantee a temporary grading
casenturit over and across a portion of the Grantor Property for the purpose of Grantee carrying
out construction and grading activities in connection with the development of the Counter
Property and Creator has agreed to grant such easement.
NOW THEREFORE, in consideration of Ton Dollars (§10000), and other good and
valuable eonsidemtieq the receipt and sufficiency of which is hereby aclmowlcdged, Grantor
hereby agrees as follows.
GRANT OF'I'EMPORARY GRADING EASEMENT
Grantor docs hereby esmblish, give, grant, and convey to Grantee, its agents, contractors,
successors and assigns, for the benefit of the Grantee Property, a temporary grading and
construction casement (the 'Icamoraey Grading Content") over and across the hatched area
Inhaled as "Grading Easement' on attached Exhibit A (the "Basement Area) for the purpose of
Grantee carrying out construction and grading activities in connection with the development of
the Grantee Property. All cost and expanse of such grading and cunstructiou shall be at the sotc

expense nfCmmdee. The Temporary Grading Easement shall aut(malically terminate .'twit,

GRANTOR'S COVENAVTS AND GRANTS
Grainer, for himself and his successors and assigns, does covenant to and with Grantee
and its successors and assigns that he is We fee owner of the Easement Area free and clear of all
encumbrances, that he is unmarried and that he has fall right and authority to convey Hie

CENTRAL PROVISIONS
Grantor shall hold Grantee harmless from and fndonmE'y Grantee free and against any
and all actions, claims, lines, penalties, liabilities, damages, and costs and expenses of any kind,
including reasonable attorneys' ices actually incurred, arising out of or relating to Gi antnr'.s, nr
his agents', employees', or contractors' actions or omissions on or about the Easement Area.
This Easement and rights and conditions sit forth herein are covenants running with the
land and are granted for the benefit of Gramme and the current and futme owners) of fee simple
title to all or a portion of the Grantee Property and their grantees, successes, assigns, and lessees.
This Easement is binding upon rich mature owuct(s) of fee simple title to all or part of the
Easement Arco and its gmmcrs, heirs, successors, assigns, and Icssecs and shall be appurtenant to
and ran with the title to the Grantcc Property.
No waiver of any breach of he easement, covenants, or agreements contained herein
shall be construed as, or constitate a waiver of, any other breach of the same or any otter
provisions, or any default hereunder, aur shall the same constitute a waiver of, acquiescence in, or
consent to any further other succeeding breach.
If any term of this basement is held invalid to any extent, the remaining terms and
on shall remain valid and enforceable to the fullest extent peratired by law.

My weak consisted of evaluating soils with a hand auger to derereaine soil color patterns that indicate
presence of a seasonal high water table (SIIW T
The roil characteristics were evaluated for resume, Ammar, consistency, depth to seasonal high water
table or perched water table, and depth to mprolim or partially weathered rack. I also reviewed the boring
logs for groundwater depth and soil information.
The USDA soil descriptions arc presented or Table L Boring locations were edvanced in the relative
locations shown on the drawing.
Seasonal High or Perehed Water Table
The SIIWT las become more frequently used as an assumed of Am highest level of water settle
fluctuations due to agricultural considerations, regulations for septic system designs and, more recently,
stormwater design. The SEWT is routinely estimated by Soil Scientists from soil morphology (soil
Forming facture) and landscape position. Soil colors are evaluated because gray colors are associated with
saturated and thorniest reducing soil environments- the presence or absence of iron. Red, reddish
yepow, brawn, and brownish yellow relate ore associated with at orbic add chemical]} oxidizing
conditions.
During weathering of soil minerals, over a paint ofome, soluble consYimenm are removed from the sap
profile and mote stable compounds will precipitate. Iron is released from ourremis and coats soil particles
wish thin oxide coatings that give soils their red to yellow color; The nemod color of mil paitioles le
gory =it they are cowed with hon.
Soils also contain microorganisms thin generate energy from the oxidation of soil organic matter. When
the soil becomes saturated front flooding or slowly poreolming water, oxygen is removed from the seal
layer and anaerobic conditions prevail. Vader anaerobic conditions, other types of soil microbes can
derive energy the chemical reduction of oxidized hon and change its state drum ferric to ferrous iron (loss.
of an elettmn). The requirements for this chemiml-miorabiological process me me absence of oxygen
for several weeks, a temperature of w least 41 degrees (r), and the presence of organic matter (roots, etc).

Soil Scientists use the Mansell Color Systemto evaluate Ne degree of color changes visible m the soil
Law chrome colors aro considered to be guy or black to the Martell System (chrome less than 2). We
normally consider that once soil layer has about 5% gory colors and reeloximorphic patterns (red -
yellow entered motdea), then tint soil is mounted at least 21 days and qualifies as e SHWT or perched
water table.
Sometimes soil water is actually •perched' because of soil characteristics such as .shrink -swell clay
mineralogy; andior weak or massive structure. A perched wand able forms above or within an
impermeable layer of soil or rock or sapmlin that separa s; it from the actual groundwater table below.
This happens in some piedmont soils and some raper coastal plain soils in NC and is the Triassic Basin
soils. Perched water tables areidentified by layer of soil that does nor coupon redoximorphic conditions
between the main water table and the layer in question.
Soil Evaluation
The location ofthe proposed front is found on a ridge -shoulder slope. The soils retrieved in the hand
augers are speckled brown and yellow saprolite that range in texture been come sandy from to loamy
sand. Hand auger refusal occurred at 4 to 5 fed below the states.
Borings foam Tanana were reviewed ed evaluate deep soils athe site. Borings 2 and 3 found
groin lwatd. But B-2 was nem the wdlond streau and B-3 was probably perched water on rock. All
other deep borings on the site did not encounter groundwater to a depth of a least 15 a 20 feet below the
surface.
But the hand auger borings add deep barings encountered shallow sands the are very hard soils or
actual auger ref id.
The soil talars to a depth of 15 to 20 feu hmeath existing grade do nor contain redoxinro rphic calors ar
do not show iron reduction and concentrations. Groundwater was not found be deep borings (except ss
noted) to a depth of at least 20 fear
A SBWT does net exist within 20 feet below the soil surface m the area designated for the biacell.
