Pursuant to Part 1, Condition A.(16) of the subject permit Duke Energy is required to 1) determine if
jurisdictional seeps identified in the permit as outfalls 101, 103, 104, 106,107, 109, 110, 11 and 112
meet the applicable water quality standards set forth in 15A NCAC 28.200; and 2) demonstrate that
non -jurisdictional seeps Identified as outfalls 105 and 108 will not cause violation of water quality
standards in the receiving stream. The determination of each of these items is required within 90 days
of the effective date of the permit. Outfall 102 is exempt from condition A.(16) pursuant to Special
Order by Consent No. S16-005. This submittal fulfills the requirements of condition A.(16) of the
subject permit.
Only three of the above named outfalls had measurable flow so that representative samples could be
collected. The outfalls with measured flow were outfall 102, outfall 104 and outfall 108. This is due in
large part to the activities undertaken by Duke Energy and authorized by the Department of
Environmental Quality to lower the water levels in the ash basin in an effort to mitigate seepage and
begin the process of closure. A summary of sampling results obtained in December 2016, January 2017
and February 2017 is provided with this submittal. These results confirm that outfalls 104 and 108 meet
the water quality standards. Outfall 102 exceeds the water quality standard for hardness. The hardness
in outfall 102 is most likely a result of inputs from natural sources, given that the water in the ash basin
does not exceed the hardness standard. As referenced above, outfall 102 is not subject to Condition
A.16 under the Special Order by Consent. Outfall 102 meets the interim hardness limits set fort in the
Special Order by Consent. Duke Energy has agreed to address water quality in outfall 102 actor ing to
the terms and schedule set out in the Special Order by Consent for Riverbend.
As required by the permit, Duke Energy will conduct monitoring for the parameters specified in permit
conditions A.(21.), A.(22.), A.(23.), A.(24.), A.(25.), A.(26.), A.(27.), A.(28.), A.(29.), A.(30.), A.(31.) and
A.(32.), as modified by the Special Order on Consent.
