R D W E S F n1 JUL 1 1 2008 DENR - WAFER QUAUIY WETLANDS AND STORMWATER BRANCH Dear Mr. Peurifoy: We have received your permit request to utilize our Regional General Permit 198200030 (GP30) which authorizes maintenance, repair, and construction activities in lakes and reservoirs owned, operated, and/or regulated by public utility companies and the Tennessee Valley Authority (TVA) in the state of North Carolina. Effective December 18, 2007, we have modified this regional general permit to require pre-construction notification only for activities that involve the dredging of previously un-maintained areas. For all other activities as described in the attached GP30, pre-construction notification to our office is no longer required. You may proceed with your work as proposed provided all the conditions of the attached GP30 are met. Please be reminded that this general permit does not obviate the need to obtain other federal, state, or local authorizations. This modification does not affect the conditions or pre- construction notification requirements to receive the required and corresponding Clean Water Act Section 401 Water Quality Certification #3693. This certification was recently modified and can be found at htip://h2o.enr.state.nc.us/ncwetlands/rd wetlands certifications.htm. Place: Lake Tillery, NC Tillery Beach Subdivision Lot#612&613 This project will be carried out in three parts. Phase One: Demolition and Removal of boathouse A. Destruction and removal from property of 14 by 26 foot cement block boathouse. B. Removal of the cement floor and cement ramp going into the water. Over the years the ramp has eroded and there is not much left of it. C. Removal of the iron track over which the boat traveled. This track extends into the water and it will be removed also. D. Burgin Back Hoe out of Norwood, NC will do the demolition and remove all the debris. E. Fill the hole left by the removal of the boathouse and its floor with dirt. F. Fill the area leading into the water with # 5 stone and riprap. This will leave the area with a natural gentle slope following the natural contour of the land into the water. This will run along the shore line for proximally 15 or 17 feet. A silt fence will be erected to prevent any soil erosion into the lake. Grass will be sawn in the remaining filled area. Phase Two: Removal of Pier A. This phase is the removal of the existing pier. I will remove the pier and dispose of the debris myself. The construction of the new pier and boathouse will be done by an approved Progress Energy contractor. B. The total for this construction will be 1175 square feet. C. Si rely u? , Edward Peurifoy Attachment to letter: Potential Impact of Soil Disturbance: There will be very little soil disturbance in the lake itself, since the boathouse is on the land. The only soil disturbance will come from working on the old pier and getting the old pylons out and putting the new ones in for the new pier. Most of the soil disturbance in the lake will come from the removal of the cement ramp going from the boathouse into the lake. This ramp was never very large. It extends about three feet into the water and over the years has eroded away and is now cracking up. I tried to include a picture of this ramp but it does not show up very well in the picture. You can see from the pictures that I have included that the old boathouse is developing structural problems. It is beginning to present a danger to people and really needs to come down. There is a small patch of aquatic plants now growing at the side of the boat house. These plants did not start growing there until about a year ago. If I can remove this ramp and replace it with number 5 stone and rip-rap, this will prevent any soil erosion into the lake and allow the aquatic plants to take hole in the stones and spread over a larger area.. We will also have a filter cloth barrier and a silt fence to prevent any soil erosion into the lake. Schedule For Work We would like to demolish and remove the old boat house and old pier in the months of June and August. The building of the new boathouselpier may run into the month of September.
