Please reference comments received by the North Carolina Division of Water Quality
(DWQ) and the North Carolina Wildlife Resources Commission (WRC) in response to the
Public Notice issued on March 6, 2006 for the development known as Round Mountain Falls.
Avoidance and Minimization
The land planning team has avoided and minimized impacts to the maximum extent
practicable, while still meeting development goals. New roads are proposed along
pre-existing logging roads in order to minimize new impacts to the property. There
were a total of 50 jurisdictional road and driveway crossings, in all phases (20 in
Phase 1 and 25 in Phases 2-4), proposed for the development of Round Mountain
Falls. Through minimization, crossings D, E, F, G, and J in Phases 2 and 3 have been
eliminated, decreasing impacts on site by 100 linear feet. Four bridges will be used
on site, they include, crossings 23 and 45, the bridge on the abandoned state road,
and the Toxaway Creek crossing north of crossing 2 which was inadvertently not
indicated on the maps. Two of these bridges were newly constructed at a cost of
approximately $50,000, each. To further eliminate impacts, a fifth bridge will be
utilized at crossing 25. One arch spans will replace the need for impacts at
crossings 22. After avoidance and minimization, 41 crossings remain. Twenty of
the 41 proposed crossings, in all phases, are at existing crossings; totaling
approximately 559 linear feet of previously impacted stream. This accounts for
41% of the total impacts on site, in all phases. Insufficient length and/or

diameter; and structural integrity make it necessary to replace and/or lengthen
these existing crossings. Impacts in the form of pipe extensions and new
construction requires authorization for 642 linear feet of additional impacts for
phases 2-4; a Nationwide permit authorized 150 linear feet of new impacts in
Phase 1 and 479 linear feet of replacement impacts. Utilization of arch spans is
not practical for most of the crossings within the development. Stream size and
time needed for construction played a role in not pursuing this option. Cost was
also a large factor; arch span crossings, on average, are ten times more expensive
than the comparable culverted crossing.
Within the Round Mountain Falls property boundary, there are over 89,500 linear
feet of stream channels. All proposed stream impacts, in all phases, are necessary
to access high ground and the 628 linear feet required for high ground access in
Phases 2-4 accounts for less than 1% of the total amount of stream footage on the
property. Over ninety-nine percent of all streams in all phases will remain un-
impacted.
Golf courses and lakes are often staples in large developments, however; McKeough
Land Company has opted not to pursue development of these amenities because of
the geographic location of the property. The goals for this project are to create
an economically feasible, low density development that takes advantage of the
natural amenities in Western North Carolina. The design team has strived to keep
this development as low density as possible while maintaining the economic
feasibility of the project. Round Mountain Falls is comprised of 816 acres that will
contain 191 lots, ranging from 2 to 10 acres, and greater than 150 acres of common
open space. This amounts to 1 home per 4 2 acres. Feasibly the design team could
decrease lots sizes to 1 acre and plan for over 650 homesites. This option was not
pursued in order to protect the integrity, beauty, and quality of the site.
Transylvania County was chosen because of it's over abundance of natural features
and convenience to urbanized areas such as Brevard, Hendersonville, and Asheville.
Transylvania County is home to the Blue Ridge Parkway, over 500 miles of trails,
and over 250 waterfalls. Approximately half of its land mass is devoted to Pisgah
National Forest, Gorges State Park, and Dupont State Forest. No other properties
considered offered the acreage required to economically sustain this type of
development, while still offering the abundance of natural areas required to draw
residence into a development without a central anthropogenic amenity.

Mitigation
Preservation is no longer the soul mechanism for mitigation on the site. Seven
areas on-site have been identified as candidates for restoration. An updated
restoration map and plan has been attached to this document. Restoration at a
ratio of at least 1:1 will occur for all perennial stream impacts, in all phases,
mitigating for approximately 293 linear feet. Restoration activities will include the
removal of unneeded road crossings; and sloping and re-vegetation of banks to a
condition comparable to conditions up- and downstream of the pipe. Preservation
at a ratio of 47:1 will occur for all intermittent stream impacts, totaling
approximately 23,030 linear feet. These areas will be contained within the
"Declaration of Easements, Covenants, Conditions, and Restrictions for the Plat of
Round Mountain Falls" to be protected in perpetuity. Lots in Phase 1 have already
been sold; therefore, they have not been included within the easement legal
description. However; all streams in Phases 1 are required to have a minimum 25-
foot trout buffer which has been indicated on all plans.
DWQ has expressed concern over the close proximity of restoration sites and
road crossing sites. Taking into consideration the updated restoration map and
plan only those crossing and restoration sites still applicable will be discussed.
Sites 7 and 20 are existing crossings. Restoration site 7 will be restored and road
crossing 20 will be upgraded and utilized with no additional impacts to the channel.
Restoration site 6 (formerly site 8) is located at the back of lot 118. The road
that contains restoration site 6 was impractical for use in this development. By
moving this road upslope, land planners were able to remove the road bed from the
trout buffer and provide access to more residential lots while increasing the
distance between the road and the stream.
Lot Sizes
Lot layouts and house placements have been determined by professional land
planners trained in land design and community development. Driveway crossings are
needed for lots 4, 27, 91, 85, and 116. These crossings, A, B, C, H, and I,
respectively, have been accounted for in the permit application. The design team
has been working closely with the Division of Land Quality to insure that impacts to
trout buffers are no more than what is allowable. All lots on site, with the
exception of those mentioned above, are buidlable without additional impacts to

streams or trout buffers. Lot 81 has been removed to provide more buildable area
for lots 95 and 96.

Stream Restoration Plan

Executive Summnry
The developer of Round Mountain Falls, MsKeough Land Company, Inc., proposes this
restoration plan to restore approximately 305 linear feet of channel up- and downstream of
existing road crossings. The plan, as outlined within this document, serves as guidance for
the proposed restoration.
Restoration will be:
• removal of fill dirt associated with the road crossing
• removal of pipes, rip-rap, logs or other crossing structures
• creation of aquatic habitat using rock
• stabilization of stream bank with fine grading
• installation of topsoil
• temporary seeding to aid in stabilization
• planting of stream banks and riparian buffers with permanent vegetation
Project oversight will be provided by WNR staff to ensure proper techniques and success;
and to propose modifications during the construction process, if necessary. Restoration
success will be measured in terms of stream aquatic life and stream buffer plant survival.
Construction Plan and Specifications
The restoration process will begin with the removal of fill dirt used in the road crossing.
Then the pipe, rip rap, and any other stream implements will be removed. All attempts will be
made to recreate the channel, stream bank slopes, and angles to the condition they were on
the site prior to disturbance. Because all of the sections of channel proposed for restoration
are nt old road crossings, they have been straightened. Sinuosity will be added to the
channel such that the restored channel will be 1.2 times its original length within the same
straight line distance.
At this point we will begin to harvest on site materials to be used in the restoration process.
Materials such as topsoil, vegetation, and rock will be harvested on site during other
construction activities from areas of similar slope and aspect.
Once the stream is restored, focus will move on to the stream banks. Topsoil harvested on
site will be added to the stream banks at a minimum depth of six inches. No soil amendments
(fertilizer) will be added in order to keep the system as natural as possible and to prevent
any excess nutrient runoff into the stream. Fine grading will be used when necessary to
recreate side slopes and micro-topography will be used for soil stabilization and to minimize
runoff.
Planting Plnn and Specifications
The slopes will be planted with appropriate riparian species from an approved list
(Attachment D) to recreate the natural buffers which occur on site. Rosebay Rhododendron
will be planted densely along the stream channel to provide shade, woody debris, and to mimic
the nnturnl system present on site. Rosebay Rhododendron and Dog-Hobble will be planted nt
a dense ratio toward the outer edge of the stream buffer to minimize re-colonization by
invasive exotic species and mimic nnturnl conditions on the site.
In the rest of the area, trees and shrubs will be mixed and the planting arrangement will be
on 10 X 10 foot spacing, which will result in 436 stems per acre. Tree shelters may be used
to accelerate growth and increase survivability.
All permanent vegetation will be harvested on site to ensure they are suitable native species.
During other construction, vegetation from similar slope and aspect will be harvested. This
vegetation will be properly excavated and prepared for transport in order to minimize dmm~ge
and ensure survivability. These plants will then be planted in the riparian buffer zone. This
procedure will occur this spring before the sap begins to rise, in order to reduce transplant
mortality. The contractor will assure percolation of all planting beds/pits prior to
installation. Large trees will be anchored into the ground as necessary.
The objective will be to mimic most of the natural buffer that is on site, which is mainly
composed of shrubs and trees. However, warm season grasses wi I I be used, in accordance
with the "Warm Season Grass Establishment and Management in North Carolina and Virginia"
provided by the US Fish and Wildlife Service as a temporary planting to aid with soil
stabilization.
Plont Material Specifications
Bare Root or Container (Herbaceous):
The plants will either be ordered ns bare root or in 1-quart containers. Plants will be planted
immediately upon delivery. Plants will be stored in shade and kept moist otherwise. Once
planted, the specimens shall appear healthy with no leaf spots, leaf dmm~ge, leaf
discoloration, chlorosis, leaf wilting or curling, or evidence of insects on leaves or stems.
Balled and Bagged (Woody Plants):
The size of the earthen boll shall at least meet the minimum requirements in the American
Standard for Nursery Stock (1980). Where plants are to be planted in saturated soils, the
bagged root ball shall have a surface diameter that is at least z of the diameter of the un-
pruned drip-line and a depth that is at least 8" per 5' of tree/shrub height. The hole for the
tree/shrub will be the rootbnll diameter plus 12" around the outer edge. The crown of the
rootbnll will be placed 1" above finish grade.
Plants will be planted immediately upon delivery. If this does not occur, plants shall be stored
in shade and root balls kept moist through periodic watering until the time of planting. Once
growing, the plants shall appear healthy with no leaf spots, leaf damage, leaf discoloration,
chlorosis, leaf wilting or curling, or evidence of insects on leaves.
Container (Woody Plants):
The soil within the root ball shall be field capacity (1/3 atmosphere) or wetter upon delivery
to the job site. Any wilted, dry rind/or lightweight plants shall be rejected. Plants shall be
planted immediately upon delivery. If not then they must be stored in shade rind root balls
kept moist through periodic watering until time of planting.
The shrub species will be either 2' to 3' or 3' to 4' in height. The tree species will be 8' to 10'
for the Red Maples and 7' minimum for the Willow rind Sycamores. Soil and root masses must
at least meet the minimum required container size. If soil/root masses are substantially
smaller, soil around the root mass is loose, indicating the plant has not been in the container
long enough to root itself, it shall be rejected.
If growing, plants shall appear healthy with no leaf spots, leaf damage, leaf discoloration,
chlorosis, leaf wilting or curling, or evidence of insects on leaves.
For trees and shrubs, where spiraling woody roots exist on the outside of the soil/root mass
upon the removal of plants from the containers, the landscape contractor shall separate
(cutting where necessary) rind spread them out prior to planting.
Planting Specifications
All areas between shrubs/trees will receive 3" of mulch. The contractor will assure
percolation of all planting beds/pits prior to installation. Large trees will be anchored into
the ground with n'Duckbill' Model No. 88-DTS-O earth anchors or approved equal. Evergreen
trees will be anchored with three 2"x2"x8' evenly spaced stakes rind tied with recycled tire
tree ties as manufactured by Grostrait or approved equal to promote a straight growth
pattern and prevent wind impacts.
Fertilization
Wood rLVegetation:
Frill/Winter plantings-Use Osmocote 18-5-11, twelve to fourteen month release fertilizer, to
be placed in hole or in soil fill/amendment mix at planting. Use grams (1 ounce) per 1-quart
container, 90 grams (3 ounce) per 1-gallon container (30 grams per each additional gallon).
Use 15 grams (1 ounce) per un-rooted cutting for willow whips (if used).
Soil Amendments:
Soil amendments are required around tree and shrub plantings. The amendments used should
be leaf or pine bark compost at rates of one part compost to one part soil (from planting
hole). Fertilizer should be mixed in with soil amendment mix. No surface mulch is required
where plants are planted at or near original grade, unless tree shelters are used to promote
growth and survival percentage. A 6" soil berm will be constructed 12" from the outer edge
of the rootball to hold water.
Monitoring
Upon completion of construction, WNR staff will provide the resource agencies with photos
of each site and a baseline monitoring report. A monitoring report with photos will be
submitted annually for 5 years. Success will be measured in terms of plant survivability and
utilization of the area by terrestrial and aquatic species.
Timetable for Restoration
The stream restoration project will likely begin this summer. Once the infrastructure within
the areas proposed for restoration has been completed, the restoration work will begin. The
following timetable is presented for restoration work once the road removal is complete.
Ranges are given below to allow for rain days and other unexpected delays.
• 1 week to remove exitsing impacts and open channels
o Remove road fill, culverts, riprap, etc...
o Flow will be in channel bed once the impacts are removed
• 1 week to restore stream channels
o mimic surrounding pattern, dimension, and profile
o including placement of rocks and woody debris
• 1 week to restore the stream banks to original condition
• 2 weeks to install the vegetation
Depending on weather conditions, the restoration work can be completed within one month.
Photographs will be taken and forwarded to the Army Corps and NC DWQ offices once all
restoration work is completed. Please contact WNR staff to accompany you and to schedule a
site inspection if desired.

Quantitative Analysis of Cumulative Impacts

Round Mountain Falls

Introduction
Current regulations applicable to the issuance of 401 Water Quality Certifications require
that the Division of Water Quality confirm that the project it is evaluating "does not result
in cumulative impacts, based upon past or reasonably anticipated future impacts, which
cause or will cause a violation of downstream water quality standards".
DWQ currently utilizes the following documentation to implement its regulatory obligation
to evaluate cumulative impacts: °Drnft Internal Policy, Cumulative Impacts and the 401
Water Quality Certification and Isolated Wetland Program. NC Division of Water Quality,
October 3, 2002, Version 1.6". OWQ's policy provides for three levels of cumulative impact
analysis. Most small scale projects where little impervious surface is added and where the
project is situated in an already developed locale will only require a "Generic Description" of
the project's possible cumulative impacts. A "Qualitative Analysis" is required for projects
of somewhat more impact that are located near existing roads and development. A
"Quantitative Analysis" is required.where n project is significantly and is likely to have a
growth stimulating effect.
DWQ's policy provides that it is applicable to private development projects, although it
recognizes that "many private development projects are unlikely to cause cumulative
impacts". DWQ recognizes that private development projects most commonly have
cumulative impacts when they are "1) relatively large, 2) involve commercial development,
and 3) occur in otherwise relatively undeveloped landscapes with an impact on regional
growth patterns".
For the Round Mountain Falls, DWQ staff has determined that n qualitative analysis of the
potential cumulative impacts of the project in terms of its effects on downstream water
quality would be appropriate.
To determine potential cumulative impacts, this project was reviewed for any growth
stimulating effects and their downstream impacts on water quality. As described in greater
detail below, the applicant does not believe that the project will result in cumulative impacts
that cause or will cause a violation of downstream water quality standards because it is not
likely to be growth simulative due to its size, its nature, and the fact that it will be
constructed in an otherwise relatively developed local landscape.
Project Description, Location, and Exis#ing Site Conditions
McKeough Lnnd Company, Inc. is proposing the construction of 40 infrastructure road
crossings and 5 driveway crossings on the 816-acre tract known as Round Mountain Falls.
The site plan consists of a residential development with 191 single-family lots ranging in size
from 2 to 10 acres and greater than 150 acres of common open space. Round Mountain Falls
is located nt the end of Oscar Chapel Rond, south of Rosman in Transylvania County, North
Carolina. In general, the site is bordered to the north by the Nnntnhala National Forest, to
the east by Blue Ridge, to the south by Chestnut Ridge, and to the west by Bear Pen Hollow.
The site is primarily forested with mixed mesic hardwood stands of differing age classes.
Some areas have recently been timbered. Several old homesites exist on the property,
although there nre no remaining structures. One grassed pasture is also present on site.
Elevations on the property range from approximately 2100 feet at the lowest point in the
Devil's Hole Creek volley to approximately 2800 feet at the highest points on Round
Mountain and the .southern ridge.
Project Aren Description
The project is located Went Rosman, n small town in the metro-Brevnrd Wren. Brevnrd is the
largest municipality in Transylvania County. Due to their proximity to waterfalls and
designated forest areas, Brevnrd and Rosman are seasonal destinations for outdoor
enthusiasts and prospective "second home" buyers. Brevnrd has approximately 6700
permanent residents. This population along with the growing seasonal population has
instigated commercial and residential development in the area. The main commercial
development in Brevnrd and Rosman is along the NC Highway 64 corridor. The Town of
Brevnrd is aself-sufficient municipality containing all necessary amenities to live, work,-and
play.
Watershed Description
This project is located in the Savannah River Basin. Devil's Hole Creek and its tributaries
nre the primary hydrologic systems on site. The site also contains smaller portions of the
Toxnway Creek, Ann Creek, Rock Creek, and Benrpen Creek watersheds. Ann Creek is n 4th
order perennial channel; there are 10,678 linear feet of stream channel in this drninnge on
site. Benrpen Creek is n 3"d order perennial channel; there are 4,088 linear feet of stream
channel in this drainage on site. Devils Hole Creek is a 4th order perennial channel; there
are 41,608 linear feet of stream channel in this drninnge on site. Rock Creek is a 3"d order
perennial channel; there are 15,724 linear feet of stream channel in this drainage on site.
Toxnway Creek is n 5th order perennial channel; there are 17,468 linear feet of stream
channel in this drainage on site. All streams and unnamed tributaries on the site are
classified at "C; Tr" waters, with the exception of Benrpen Creek and its tributaries which
are classified as "C" waters. Class "C" waters are defined as "freshwaters protected for
secondary recreation, fishing, aquatic life including propagation and survival, and wildlife."
The "Tr" designation identifies waters as being "suitable for natural trout propagation and
maintenance of stocked trout."
All wetlands are associated with on-site channels. The larger wetland complexes occur in
the flood plain of Toxnway Creek. Hydrology is groundwater and surface water from
intermittent channels slowed down by the low slope gradient along Toxnway Creek. There is
no dominant over-story within the wetland. The dominant mid-story, scrub-shrub stratum
consists of tag alder (A/nusserru/ata), and dog hobble (Leucothoe racemosa) with an
herbaceous Inyer of sedges (Carexspp.) and ferns (Osmunda cinnamomea, etc.). These
wetlands drain to Toxnway Creek (Class C; Tr) in the Savannah River Basin. Other on-site
wetlands are seeps located nt the tops of channels; they are groundwater seeps that may or

may not support vegetation, primarily sphagnum moss (Sphagnum spp.) and sedges (Carex
spp.). These seeps flow into unnamed tributaries on site.
Project Induced Growth
The project is not likely to induce adjacent development primarily because there are no
services, utilities, or roads being constructed by McKeough Land Company, Inc. that will be
available to adjacent landowners or the general public. Any induced commercial growth will
be accommodated by Rosman and Brevard but there is no commercial development directly
associated with site development.
The members of this new community are likely to shop and dine nt the local restaurants and
retail stores in the Brevard-Rosman area. However, because these residents are likely to
be seasonal, it is not likely to create n demand for additional retail or commercial ventures.
The majority of the members at Round Mountain Falls will be baby-boomers who do not have
school aged children. Therefore, no schools or other related supporting development will
occur due to Round Mountain Falls.
Summary
McKeough Land Company, Inc. proposes to develop this project in accordance with likely
conditions in the 401 Water Quality Certification and the 404 Permit authorizations. The
purpose of implementing these guidelines is to protect the downstream water quality in the
area of the project. Other development that occurs in the some watershed will likely be
restricted to similar conditions providing protection to surface waters. Because of the
projects close proximity to Brevard, Rosman, and the NC Highway 64 corridor, the applicant
does not believe that any potential effects on growth will occur due to the development of
Round Mountain Falls.
