The mitigation requirement for the Corps exceeded the amount required by NCDWR. The mitigation payment

Please find attached the documentation showing the compensatory mitigation for the Traditions Phases 213, 2C, 2D
project. Included are the Mitigation Credit Transfer Certificates, executed Transfer of Responsibility Form, and the
corresponding Forrest Creek UT -2 and Buffalo Branch stream credit ledgers showing the debit of credits for the project.

Instructions to Permittee: The Permittee must provide a copy of this form to the Mitigation Sponsor, either an approved
Mitigation Bank or the North Carolina Division of Mitigation Services (N[DMS), who will them sign the form umverify the
transfer of the mitigation responsibility. Once the Sponsor has signed this form, it is the Permnittee's responsibility to
ensure that to the U.S. Army Corps of Engineers (U8ACE) Project Manager identified on page two is in receipt of signed
copy ofthis form before conducting authorized impacts, unless otherwise specified below. If more than one mitigation
Sponsor will be used to provide the mitigation associated with the permit, or if the impacts and/or the mitigation will occur
in more than one 8 -digit Hydrologic Unit Code (MUC), multiple forms will be attached to the permit, and the separate forms
for each Sponsor and/or HUC must be provided to the appropriate mitigation Sponsors,
Instructions taSponsor: The Sponsor must verify that the mitigation requirements (credits) shown below are available at
the identified site. BYsigning below, the Sponsor is accepting full responsibility for the identified mitigation, regardless of
whether or not they have received payment from the Permittee. Once the form is signed, the Sponsor must update the
bunk ledger and provide a copy ofthe signed form and the updated bank ledger tothe Permittee, the VSACE Project
Manager, and the Wilmington District Mitigation Office (see contact information on page 2). The Sponsor must also comply
with all reporting requirements established in their authorizing instrument,

Conditions for Transfer of Compensatory Mitigation Credit:
* Once this document has been signed by the Mitigation Sponsor and the 05ACE is in receipt of the signed form, the
Permittee isnolonger responsible for providing the mitigation identified inthis form, though the Permittee remains
responsible for any other mitigation requirements stated inthe permit conditions.
m Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only
after the U3ACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has
accepted responsibility for providing the mitigation requirements listed herein. For authorized impacts conducted by
the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas may proceed upon
permit issuance; however, a copy of this form signed by the Sponsor must be provided to the USACE within 30 days of
permit issuance. NCDOT remains fully responsible for the mitigation until the USACE has received this form, confirming
that the Sponsor has accepted responsibility for providing the mitigation requirements listed herein.
» Signed copies of this document must be retained by the Permittee' Mitigation Sponsor, and in the WS4CE
administrative records for both the permit and the Bank/|LF Instrument. it is the Penmiuee/o responsibility toensure

The undersigned, EBX-Neuse I, LLC the Sponsor of the Neu -Con Wetland and Stream Umbrella
Mitigation Bank (Buffalo Branch Site) hereby certifies the following:
WS-TWF Development LLC has deposited monies with the Sponsor sufficient to
acquire 90.50 Stream Mitigation Credits from the Bank for use on its Traditions
Phases 2B, 2C, 2D project (USACE Action ID SAW -2013-01789), in Raleigh, NC,
in HUC 03020201 of the Neuse River Watershed.
2. The Traditions Phases 2B, 2C, 2D project requires a total of 230.00 Stream
Mitigation Credits as mitigation. Of this amount 90.5 Stream Mitigation Credits are
being provided by the Buffalo Branch Site in the Neu -Con Umbrella Bank. The
remaining credits are being provided by the Forrest Creek UT -2 Site.
The Sponsor has deducted 90.5 Stream Mitigation Credits from the Bank's credit
ledger in HUC 03020201 of the Neuse River Watershed.
A copy of the Bank's Credit ledgers reflecting the above transaction are attached to this Certificate.
