On December 5, 2016, the Division of Water Resources (Division) received your application dated
on December 12, 2016 requesting a 401 Water Quality Certification / Buffer Authorization from
the Division for the subject project. On January 4, 2017, the Division request additional
information that was received on February 1, 2017. The Division has determined that your
application with the additional information provided is incomplete and cannot be processed. The
application is on -hold until all of the following information is received:
Streams that are approximately shown on either the most recent USGS 7.5 -minute
topographic map or the most recently published county soil survey map are subject to
the buffer rules unless an on-site determination finds that a stream is not present or an
ephemeral channel is present. The soil survey maps included in the application show that
the proposed gravity and force main lines intercept four streams depicted on those
maps. Ponds connected by at least an intermittent stream to features depicted on the
maps are also subject to the Buffer Rule. Please contact the Raleigh Regional Office to
schedule an on-site determination for the four features shown on the soil survey and
crossed by the proposed utility lines using the request form that you can find at
https://deg.nc.gov/about/divisions/water-resources/water-resources-
permits/wastewater-branch/401-wetlands-buffer-permits/401-application-forms-help-
documents under Stream Determinations - Raleigh Regional Office form. Provide a copy
of the stream determination letter and a revised PCN and impact maps if there are
additional riparian buffer impacts. [15A NCAC 02B .0233(8)(b)(iv)]
2. Page 10 of 10 carries the signature of D. Lee Campbell. In order for D. Lee Campbell to
sign, the application package requires an agent authorization letter from the applicant. A

sample agent authorization letter can be found on the USACE website. [15A NCAC 02H
.0502(f)]
3. The Division does not consider the utility pipe or the permanent maintained easement to
be a permanent impact to wetlands, but understand that these impacts are reported
separately for the US Army Corps of Engineers. Both the temporary and permanent
impacts reported in the PCN application will be processed as temporary impacts for the
401 water quality certification.
4. Although the project does not require SEPA approval, it appears to be subject to NEPA
approval. Please provide a copy of a categorical exclusion or FONSI issued for the
project. [15A NCAC 01C .0107(a)]
Pursuant to Title 15A NCAC 02H .0502(e) / 15A NCAC 02B .0233, the applicant shall furnish all of
the above requested information for the proper consideration of the application. If all of the
requested information is not received in writing within 30 calendar days of receipt of this letter,
the Division will be unable to approve the application and it will be returned. The return of this
project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending two copies
of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Section 401 of the Clean Water
Act/Buffer Rules for this activity and any work done within waters of the state may be a violation
of North Carolina General Statutes and Administrative Code.
