Below is what was described in the October 2004 NPDES application.
The FGD system will also require a gypsum landfill, which is currently being permitted for the Marshall site.
The FGD landfill will be located west of the Marshall Ash Basin. The runoff from this landfill will be routed to
the ash basin. FGD residue material that is not suitable for beneficial use will be placed in the landfill. In
addition to this material, material will periodically be removed from the clarifier stage of the wastewater
treatment system and placed in the landfill. The landfill footprint contains approximately 20.64 acres. The
FGD residue will be conveyed to the landfill site by truck, where the material will be spread and, compacted.
The landfill will begin receiving FGD residue in the fall of 2006. The volumetric capacity of the landfill is 2.19
million yd3. Duke is presently investigating beneficial uses for the FGD residue (gypsum). If these options
are determined to be viable, the FGD residue meeting the material, requirements for the beneficial uses will
not be disposed in the landfill.

On October 27, 2004 Duke filed an application to renew the subject NPDES permit. In the application the
supplemental information included on page 12 of 26 a description of the gypsum landfill that will be installed
due to the Flue Gas Desulfurization (FGD) project. As described the rainfall run-off from this landfill will be
directed to the ash basin for further treatment prior to discharging to the receiving waters. Plans are now
being made to line the landfill. The rainfall run-off and landfill leachate will still be sent to the ash basin.
Since this run-off was covered in the October 2004 application and a permit was issued on April 25, 2005
Duke Power interprets that this activity is covered by the NPDES permit. Please let me know if you concur.
