Enclosed is a Pre-Construction Notification (PCN) for the sewer & water lines that will service the
proposed project known as Highland Park Subdivision, off Guess Rd., accessed by Terry Rd, Durham,
Durham County, North Carolina. A vicinity map can be found on the cover page of the plans submitted. This
PCN is an application for the Section 401 Water Quality Certification that accompanies NWP 12 (GC3699).
This project is being undertaken by Highland Park Properties, LLC (400 Riverwood Dr., Clayton, NC
27520), hereafter referred to as the applicant. The applicant proposes to build 289 single family homes, with
appropriate infrastructure, for speculative sale. This permit application is for the sewer & water lines that
will service this proposed development.
The applicant's purpose is to construct a marketable phase by phase single family subdivision within
the constraints of topography, area, cost, environmental impacts & regulations. This PCN is for the sewer
& water infrastructure to service this proposed development. The developer has received a NWP 12 for this
phase of the project. That permit is enclosed.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

9.Describe the existing conditions on the site and general land use in the vicinity of the project at
the time of this application: Existing conditions where the sewer path goes are currently forested
or meadow areas mostly in someone's backyard, so some are maintained & some are left natural.
This line traverses the back zone of many developed lots but a few are currently undeveloped. The
water line mostly traverses suburban lawns & road right of ways. The existing condition in the
vicinity of the proposed project is mostly suburban subdivisions, old & new.
10. Describe the overall project in detail, including the type of equipment to be used: The
Highland Park Subdivision, off Terry Rd., will be a single-family residential development consisting
of residential buildings, driveways, roads, utilities, a park, and a large greenspace surrounding the
central stream. This permit is for the sewer & water to supply Highland Park & will have sediment
& erosion controls in place before construction begins. Off-Site sewer & water lines have been
approved by City of Durham. No grading will be done for sewer & water, only ditching, probably by
ditch witch or backhoe. Grade will be restored to original contours. The stream crossings will
require a temporary block of the channel about ten feet from the ditch and three feet for the ditch for
a total temporary impact of about 13' per H2O crossing & 13.75' for sewer crossings. These utilities
will be installed using backhoes, bobcats and ditch witches, and the appropriate pipe laying
equipment & using the latest BMPs. All pipes will be laid with the center of the pipe under the
stream. All general conditions of each permit will be adhered to.
11. Explain the purpose of the proposed work: To provide sewer & water for Highland Park
Subdivision which will produce single family homes for sale in a new subdivision near Durham & 1-
85.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules. This project applied for & received Corps approval on 10125106. Because the
new Nationwide Permits were issued in 2007 its expiration date was 03118107. In late 2007, work had
not yet begun so the project reapplied for the new Nationwide Permit 12 and was approved (Action ID
2006-409331 (copy enclosed). No work in the impact zones has been done. This is not an after the fact
permit, nor is the project currently in violation of any 404 or 401 Section regulations.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No future permits are anticipated once DWQ certifications are obtained.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,

permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet. Wetland map submitted
as Attachment G.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. Avoidance & Minimization can
be found in Attachment D.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stnngide.html.

I. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Wetland & stream mitigation is not expected. All stream crossings are temporary & they
total 105.5 LF, which is under the 150' threshold for permanent impacts. Wetland impacts
are less than one acre. Although the criteria used by the Corps are different from those used
by DWQ, in this case the Corps required no compensatory mitigation (ID 2006-40933,
enclosed). However, if mitigation is required, the developer proposes to purchase that
mitigation from the NC Ecosystem Enhancement Program (NCEEP). For buffer impacts, the
acceptance letter from NCEEP for the permanent sewer impacts is enclosed. Although all
water impacts are temporary, application has been made to NCEEP for those impacts in
Zone I & Zone 2 as well. The acceptance letter for those impacts is due shortly & I will
.forward it to you as soon as it is available.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP
website at http://h2o.enr.state.nc.us/v<mp/index.htm. If use of the NCEEP is proposed, please
check the appropriate box on page five and provide the following information: The following

required state and local buffers associated with the project. The applicant must also provide
justification for these impacts in Section VII above. All proposed impacts must be listed herein,
and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a
map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ
Regional Office may be included as appropriate. Photographs may also be included at the

Highland Park Subdivision is a self-contained road system not conducive to spreading out from the
center. In addition, most land around this development has already been developed. Further up Terry
Rd to the north., outside the project boundaries, is already built out in low-density homes. To the north
on Guess Rd there is substantial development & just east of the site (bordering Guess Rd). is fully
developed; to the south of the site is an established subdivision; and across Guess Rd there is a
subdivision. All the lots in-between the site & Guess Rd are small privately owned lots. This area of
Guess Rd. is almost completely built out. To the west of the site only one property is currently
agricultural, although two other properties are large lots with just one house on them. However, ending
the western road with a cul-de-sac rather than stubbing the road for further development deters the road
access to this western area from the southwest of this project. In the northwest of this project, the natural
park that has no road access through it blocks access further west. Also, all additional requirements put
on the sewer & water lines for this project by City of Durham are to service existing neighborhoods in
this area.

ATTACHMENT C: Description of Impacts
Sewer lines A & B both start where Guess Rd crosses Crooked Creek and go north through the back
area of numerous lots that front Guess Rd. The cross Bramble Dr. and further north cross Feature A, Crooked
Creek. The sewer line will cross Crooked Creek once and its unnamed western tributary (Feature B) once.
Originally the proposed plan called for only one sewer crossing of Crooked Creek north of Feature B.
However, City of Durham rejected that plan because the' adjacent neighborhood on the west side of Crooked
Creek and the south side of Feature B has failing its septic fields & the City of Durham needed a future sewer
hookup in that area to fix this problem. Thus City of Durham required this contractor to construct the sewer
line in such a way that this neighborhood can later hook into it. Thus City of Durham required the sewer line to
cross Crooked Creek further south into the target area and then cross Feature B to return to the path needed to
service the Highland Park Subdivision proposed development, which is known as Sewer line B. The extension
of the sewer line north to Terry Rd. (labeled Sewer line A) was also required by City of Durham as a hookup for
other neighborhoods. These impacts are calculated in the PCN.
Each of these sewer line stream impacts will be temporary and about 13.75' wide at the stream crossing.
Stream flow will be dammed during a period of low flow; a trench will be dug & pipe installed in it; then the
trench will be filled and the stream banks returned to their original state & the dam removed. Latest BMPs will
be used & the midpoint of the sewer pipe will be directly in center of creek. Original contours will be restored.
The sewer line will impact three of the five wetlands in its general path: Wetlands D, E & B (see
wetland map & plans). These three wetland impacts by the proposed sewer lines are what remain after avoiding
& minimizing total offsite impacts (see below). Because of City of Durham requires that the full 30' easement
be kept cleared & cut (Phone conversation with Mr. John Reeves, Construction Engineer, Department of Public
Works, City of Durham, 02/21/08, 1:30pm), wetland impacts within the permanent sewer easement & buffer
zones impacts within the permanent sewer easement are permanent impacts. All impacts in the temporary
sewer easements are temporary, as are the stream crossings. These impacts are calculated in the PCN.
The water line impacts to buffers & streams are completely temporary. These impacts will be 13' wide
at the stream crossings. The same procedures will be used installing the water line crossings as are used to
install the sewer crossings (see above). The lead engineer had put these water lines in the road right of way,
below fill but above the culvert and out of the stream which was viable from the engineering standpoint.
However, City of Durham required the engineers to move them to a threshold distance (15 feet) away from the
culverts, thus putting the water line impacts back into the streams. These impacts are calculated in the PCN
ATTACHMENT D: Avoidance & Minimization
The original sewer line path had impacts in Wetlands A, B, C, & D, but not in Wetland E. With the
changes required by City of Durham (see above) the sewer line might have impacted all five wetlands present in
this area. However, the engineers avoided both Wetland A & Wetland C with a revision of the sewer path. The
engineers also wanted to avoid a second stream crossing for the sewer line, having originally laid out a plan that
would cross only Crooked Creek only once. However, they were required by City of Durham to design the
sewer line with two stream crossings to address another Durham neighborhood's problems (see above).
The current design has minimized the sewer impacts to wetlands & buffers to a great extent, given the
City of Durham's requirement that all 30 feet of the permanent sewer easement be kept cut, rather than a 10'
wide maintenance path originally proposed in this design. The sewer crossing of Crooked Creek is exactly 90
degrees, thus minimizing its buffer impacts. The impacts of these crossings have been minimized by restricting
the width of impact to 13.74' and by doing the work during a low flow period. See PCN for actual figures.
Water line impacts on wetlands were completely avoided. Water line impacts on streams were
originally avoided by placing these lines in the road right of way below ground level but above the culverts
because sufficient depth of fill existed. However City of Durham required that the water lines be placed at a
minimum of 15' distance away from all culverts, thus requiring a stream crossing at each road crossing. These
six essential crossings were minimized to a 13' width of temporary impact at the stream crossings & less than
that width along the rest of the line.
A sediment & erosion control plan will be in place during construction (permit copy enclosed). Pre-
impact contours will be restored.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
