I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 3 http://www.saw.usace.army.mil/Portals/59/docs/regulatory/regdocs/NWP2012/NWP3_3-23.pdf. Please submit the requested information below (via e-mail is fine) ASAP, as the current Nationwide Permits expire on March 18, 2017: 1) 0.29 acre of hand clearing is proposed in wetlands related to relocation of an existing power line utility. Since NCDOT has also proposed discharges of dredged or fill material (0.02 acre fill and 0.01 acre excavation) for this project requiring Corps authorization, any losses of aquatic resource function indirectly associated with this project are also subject to our evaluation with respect to avoidance, minimization, and compensatory mitigation. The Corps Wilmington District considers permanent conversion of forested wetlands to herbaceous wetlands to be a permanent loss of wetland function. Typically, applicants propose 1:1 mitigation for such impacts, added to any other permanent impacts which are usually proposed at a 2:1 ratio. In this case, NCDOT proposes permanent fill/excavation in �0.03 acre of riparian, non-riverine wetlands, and hand clearing (permanent conversion) of up to 0.29 acre of forested wetlands. Please respond to this request for additional information with a compensatory mitigation plan for this project, for both the permanent fill/excavation and the portion of hand clearing that involves the clearing and permanent maintenance of forested wetlands within the utility line easement, including any portion of these wetlands that will be cleared and maintained in an herbaceous state. An NCDMS acceptance letter should also be included with your response as appropriate. Please let me know if you have any questions. -Dave Bailey David E.
