The Corps af Engineers believes that there may be jurisdictional waters of the United States on th� subj�ct site, and the permit applicant or other affected party who requested this pr�liminary JD is hereby advised af his or her optifln to request and abtain an approved jurisdictional deiermination (JD} for that site. Neverthefess, the parmit applicant ar other person who requssted #his preliminary JD has declined to exercise tf�e aption to abtain an approved JD in this instance and at ihis time. 2. I� any circumstance where a permit applicant obtains an indivi�ual permit, or a Nationwide General Permit (NWP) ar other general permit verification requiring "pre-construction notification" {PCN), or requests verification for a non-reporting NWP or other generaf permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is hereby made aware of the following: (1) the permit applicant has elected ta seek a permit authorization based on a prefiminary JD, which does not make an afficial determinatian of jurisdictional waters; (2) that the applicant has the option to request an approved JD before accepting the terms and conditions of the permit authorizatian, and that basing a p�rmit aut�orization on an approved JD could possibly result in less compensatory mitigation being required or diffe�ent special conditions; (3) thai the appiicant Y�as the right to request an individual pe�mit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) that t�e applicant can accept a permit authorization and thereby agree to comply with all the terms and conditians of that permit, including whatever mitigation requirements the Corps has det�rmined to be necessary; (5} that undertaking any activity in reliance upon the subject permit authorization without requesting an approved ,�D canstitutes the applicant's acceptance of th� use of th� prefiminary JD, but that either form of JD will foe processed as saon as is practicable; (6) accepting a permit authorizakion (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form af Corps permit authorization based on a prefiminary JD canstitutes agreement that all wetiands and other water bodies on the site affacted in any way by t�at activity are jurisdictianal waters of the United States, and precludes any challenge to such jurisdiction in any administrative or judicial compliance or enfo�cement action, or in any administrati�e appeal or in any Federal court; and (7} whether the applicant elects to us� either an approved JD or a preliminary JD, that JD will be processed as soon as is practicabte. Further, an ap�roved JD, a proffered individual Permit {and all terms and conditions contained therein), or individual perrnii denial can be administratively app�aled pursuant io 33 C.F.R. Part 331, and that in any administrative appeal, jurisdicti�nal issues can be raised (see 33 C.F.R. 331.5{a)(2}). If, during that administra,tive appeal, it becomes necessary ta make an official determination wY�ether CWA jurisdiction exists over a site, or to provide an ofificial delineation of jurisdictional waters on the site, the Corps will provide an apProved JD ta accamplish that result, as soon as is practicabfe. 3 This preliminary JD finds that there °may be" waters of the United States on the subject project sit�, and identifies all aquatic features on the site khat could be affected by the proposed activity, based on the following infarmation: IMPORTANT NOTE: The iniormation recorded on this form has not necessarilv been veri�ed bv the Corps and should nat be relied upon for later iurisdictional determinations.
