The purpose of this meeting (Concurrence Points: 2A Revised, 3 and 4A) is to present relevant information to the Merger Process Team to reach concurrence on an additional alternate to carry forward, the least environmentally damaging practicable alternative (LEDPA) and reach concurrence on impact avoidance and minimization efforts on the project. The proposed project is located along NC 88 between NC 196 and Jefferson in Ashe County. The project proposes to widen existing two-lane NC 88 to a multilane facility. An Envirorunental Assessment was approved and distributed on the subject project in August 2008. An information packet is enclosed, including: Meeting Agenda, Vicinity Map, Project Location Map, Natural Resources Impact Maps, Half -Size Preliminary design plans showing jurisdictional areas and impacts, information on culvert and bridging alternatives, avoidance and minimization descriptions, and Concurrence Forms 2A Revised, 3 and 4A. Purpose of the Meeting • Revisit CP 2A to introduce a new alternative to Merger Team to carry forward, reach consensus on LEDPA and review Avoidance and Minimization measures for the subject project. 2. Project Description • Project begins at NC 194 and ends at US 221 Business (See Figures 1 and 2). • Total project length is approximately 1.6 miles. 3. NEPA and Merger Process Status Concurrence Point 1 -Purpose and Need o Concurrence meeting held and team member concurrence reached December 12, 2001. o Purpose and need of the project is to improve safety on NC 88 and improve a link between NC 194 and the existing multi-lane section in the Town of Jefferson. Concurrence Point 2 -Alternatives to be Studied in Detail o Concurrence meeting held and concurrence reached by team members on December 12, 2001. o Concurrence reached on eight design alternates to carry forward including No-Build. Concurrence Point 2A -Alternatives to Carry Forward and Bridging Decisions o First Concurrence meeting held on May 18, 2004. ^ Merger Process Team added another design alternate which brought the total number of design alternates to nine. o Second Concurrence meeting held on March 15, 2005. ^ The Merger Team eliminated several alternates and concurrence was reached to carry forward the following alternates: Alternate #1 No-Build /routine maintenance continues Alternate #2 3-lane shoulder section with best-fit widening (entire project length) Alternate #3 3-lane shoulder-section with best-fit widening (rural portion) & 3-lane curb and gutter section with best-fit widening (urban portion) Alternate #4 3-lane shoulder-section with best-fit widening (rural portion) & 5-lane curb and gutter section with best-fit widening (urban portion) (Rural portion from NC 194 to Lawson Lane, urban portion from Lawson Lane to US 221 Business) U-3812 NC 88 Improvement Study CONCURRENCE POINT 2A REVISED -ADDITIONAL ALTERNATIVE TO CARRY FORWARD CONCURRENCE POINT 3 -LEAST ENVIRONMENTALLY DAMAGING PRACTIBLE ALTERNATIVE (LEDPA) & CONCURRENCE POINT 4A -AVOIDANCE AND MINIMIZATION Concurrence Meeting Agenda (Cont.) Page 2 of 5 Concurrence was also reached by the Merger Team on the bridging and major stream crossings. ^ Agreed to carry forward the proposed culverts at the three major stream crossings as shown in Attachment 2 (original CP 2A Form). The bridging option at the Little Buffalo Creek crossing was removed from consideration. • SHPO Effects Concurrence -Joseph Benjamin Neal House o An Assessment of Effects Meetings held on December 20, 2005 and on June 27, 2006. o Concurrence was reached at the June meeting and an additional design alternate (Design Option 10), that was presented at this meeting, had the least qualitative impacts to the Neal property. o The Merger Process Team was notified of this new alternate via letter dated July 6, 2006. • Environmental Assessment (EA) o Signed August 2007, alternate recommended by NCDOT was Design Option 10. o In the EA, Design Option 10 was renamed to Build Alternate 4. In order to keep continuity, Alternate #2, Alternate #3 and Alternate #4 from CP 2A were also renamed to Build Alternate 1, Build Alternate 2 and Build Alternate 3, respectively. 4. Current Project Schedule • Environmental Assessment: Completed August 2007 • FONSI: July 2008 • Right of Way Acquisition: State Fiscal Year 2009 (Draft TIP 2010) • Construction: State Fiscal Year 2011 (Draft TIP 2012) 5. Concurrence Point 2A Revised -Additional Alternative to Carry Forward • Formal presentation of Build Alternate 4 (Design Alternate 10) to Merger Team o During studies on the original build alternatives from CP 2A, it was determined that they would improve traffic safety, but were not warranted from a capacity standpoint and would generate potentially negative impacts to the human and natural environments. Therefore, NCDOT subsequently added and studied Build Alternate 4, which addresses the purpose and need for the project, while substantially reducing impacts to the human and natural environments (see Table 1 Summary of Impacts). o Build Alternate 4 is NCDOT's recommended alternative and includes the following improvements to NC 88: • Realignment of the intersection of NC 88 and NC 194 (Best Fit Alignment) • Realignment of the S-curve between Locust Grove Dr. and Lawson Lane (Best Fit Alignment) • Center turn lane between Lawson Lane and US 221 Business with Best Fit Widening • Upgrading the facility to current standards with 12-foot lanes • Pedestrian crossing for McFarland Publishing Company • Resurfacing the entire length of the project U-3812 NC 88 Improvement Study CONCURRENCE POINT 2A REVISED -ADDITIONAL ALTERNATIVE TO CARRY FORWARD CONCURRENCE POINT 3 -LEAST ENVIRONMENTALLY DAMAGING PRACTIBLE ALTERNATIVE (LEDPA) & CONCURRENCE POINT 4A -AVOIDANCE AND MINIMIZATION Concurrence Meeting Agenda (Cont.) Page 3 of 5 o Bridging Decisions from CP 2A have changed in that Build Alternate 4 no longer requires extending the culvert at Crossing #2 (see Table 2 Bridges and Major Stream Crossings Summary). • Concurrence CP 2A Revised Form Signing 6. Concurrence Point CP 3: Best Fit Alternate/LEDPA Many avoidance and minimization issues were identified and addressed as the various alternatives moved though the merger process. The cumulative effect of the changes made has been a significant reduction of impacts to the human and natural environments. Some of the avoidance and minimization measures that have occurred in arriving at NCDOT's recommended alternative (Build Alternate 4), which also appears to be the best alternate for LEDPA, include: o Reduction in overall typical sections from the CP 2A meeting: from a 3-lane shoulder section (rural portion) and up to a 5-lane curb and gutter section (urban portion) to a 2-lane shoulder section in the rural portion and 3-lane curb and gutter section in the urban portion. o No impacts at Little Buffalo Creek crossing (Crossing #2) with Build Alternate 4 verses impacts requiring extensions of the existing culvert for the other three Build Alternates. o Improvements are limited to existing location along NC 88, except where realigning intersection at NC 194 and S-curve. In these two areas, widening transitions incorporate Best-Fit Alignment to minimize impacts. Alignment Review o See Attachment 6 -Preliminary Design Sheets for Build Alternate 4 • Impacts Summary o See Table 1 - Summary of Impacts for Build Alternates 1, 2, 3 and 4 o See Attachment 5 -Natural Resources Impacts ~ Environmental Assessment Comments Review o EPA ^ NCDOT should consider the highest quality sediment and erosion control measures including the "Experimental/Mountain" Best Management Practices (BMP). ^ The updated Traffic Noise Analysis (using TNM 2.5) per Green Sheet commitment should also be included in the FONSI. o North Carolina Wildlife Resources Commission ^ Due to the current impairment listing of the Little Buffalo Creek and Naked Creek, along with the downstream resources from these streams, the highest sediment and erosion control measures should be employed and strictly maintained. ^ A plan to address the acidic nature of the soils in the area and prevent acidic runoff from entering aquatic habitats will be needed for the construction of this project. ^ How the water quality and sensitive natural resources downstream will be affected by potential induced development from the Preferred Alternate, was not addressed in the EA and should be addressed in the FONSI. U-3812 NC 88 Improvement Study CONCURRENCE POINT 2A REVISED -ADDITIONAL ALTERNATIVE TO CARRY FORWARD CONCURRENCE POINT 3 -LEAST ENVIRONMENTALLY DAMAGING PRACTIBLE ALTERNATIVE (LEDPA) & CONCURRENCE POINT 4A -AVOIDANCE AND MINIMIZATION Concurrence Meeting Agenda (Cont.) Page 4 of 5 Public Hearing/Public Comments Review o NCDOT Combined Public Hearing- A combined public hearing was held November 29, 2007. Approximately 41 citizens and town officials attended the hearing. The majority of the citizens in attendance, including the Town officials prefer Build Alternate 4. Major concerns and comments are generally summarized below: ^ Comments in support of Build Alternate 4 included: it has fewer relocatees and has the proposed curb and gutter. ^ One comment preferred Build Alternates 1, 2, and 3, but Build Alternate 4 would be supported if a climbing lane was added from Dogget Road to the crest (approximately Station 55+00). ^ Concerns were expressed regarding the NC 88 and US 221 Business intersection including: improving the sight distance, truck turning radius, flooding during large storms and not extending the project east of this intersection. ^ See Attachment 3 for Post Hearing Summary and Public comments review. o ACOE Public Notice ^ The 404 Permit Application was submitted to the ACOE on November 9, 2007. The ACOE Public Notice was posted on November 15, 2007 and comments were accepted through December 17, 2007. ^ One written comment was received from E.T. Weaver. This was the same written comment received from Mr. Weaver during Combined Public Hearing Summary (see Attachment 4). • Concurrence CP 3 Form Signing 7. Concurrence Point 4A: Avoidance and Minimization • See Avoidance and Minimization measures incorporated into the LEDPA • The main avoidance and minimization that has occurred on the LEDPA has been the reduction of side slopes by using 2:1 slopes throughout the project, especially in locations adjacent to jurisdictional areas. According to AASHTO and the projected truck and traffic counts, a climbing lane should be considered from approximate station 29+00 to approximate station 55+00 on the eastbound lane. Preliminary studies indicate a 25-mph speed reduction is expected for a typical heavy truck. The estimated additional natural resource impacts are as follows: Perennial streams: 130 LF Intermittent streams: 105 LF Montane oak hickory forest: 2.93 AC Christmas tree farm: 0.07 AC Based on preliminary designs, the construction cost for the climbing lane is estimated to be an additional $1,500,000. Additional right of way costs were not estimated; however, 5 to 6 additional relocatees are anticipated. If the climbing lane is added, the merger team must review the plans and the additional impacts. Because of the additional relocatees and natural environment impacts, Division 11 does not recommend a climbing lane. Also, McFarland Publishing Company has indicated that they would relocate if any widening is proposed beyond that shown for Build Alternate 4. Since preliminary studies indicate the Level of Service (LOS) will not improve significantly with this climbing lane, Roadway Design is also in agreement that this lane is not justified. To whom it concerns, I have owned and operated a busines(s) at this location since 1973. I employ an average of seven people. Thru the years I have observed several issues which I think are important to this project and they are: 1. Sight distance and safety at the intersection of 88 and 221 Business. 2. Trucks cannot properly make a turn from eastbound 88 onto 221 Business southbound. Vehicles in the left northbound lane of 221 Business are continually being forced to back-up to allow oncoming trucks to make the turn. The same is true of trucks making a left turn onto 88 westbound from 221 Business. 3. Flooding caused by the tiles under NC 88 not being adequately large enough to handle the creek flow. My building has been flooded three times since 1973, at considerable cost, due to waters overflowing the tiles and running across NC 88 into my building. 4. Traffic conjestion and safety hazards on NC 88 when the manufacturing plants change shifts. 5. Need for improved roads and access to stimulate the local economy and attract new industry. NC 88 road rp oiect should address the above issues. Page 1 of 2 In the future, it will be difficult for business and industry to expand in this area without better roads that address both traffic flow and access to additional real estate for commercial use. The following is an explanation of how I view my property and how my property fits (or does not fit) into this project: This location of this property is nearly perfect for my business. However, parking is barely adequate and loading and freight handling are only possible adjacent to our building parallel to NC 88. Access in and out of our lot would be compromised with increased conjestion. THESE BUSINESSES SIMPLY CANNOT AFFORD TO LOSE ANY PARKING ACCESS, OR FREIGHT HANDLING SPACE ~ Any encroachment on my property that limits the current use would eventually be devastating, perhaps slowly, but nevertheless, devastating. The only alternative would be to relocate. Reducing use of or access to this property would eventually cause serious harm to the businesses: therefore, any of the plans currently proposed would be detrimental. I question whether the minimal plan # 4, the Safety Improvements Alternate, will benefit commercial and industrial expansion and be of any real economic benefit to the area. I question the possibility that any project would not harm my businesses. Combining these two questions leads me to believe that the best benefit to the community, the economy, and my future success would be to adopt plan build alternate 1, 2, or 3, and preferably the one that most benefits our economy, and to relocate my business so I can remain in business. Additional Alternative to Carry Forward: The Merger Process Team met on April 22, 2008 to discuss a new alternative to carry forward: Design Option 10 (Build Alternate 4 in the EA document). Formal presentation of this new alternate to the Merger Process Team was required, because it was developed after concurrence at the original 2A meeting. Build Alternate 4 was added after further studies of the other alternates indicated that it appeared to address the purpose and need for the project, while substantially reducing the impacts to the human and natural environments.
