O From: Beam, Patricia Sent: Monday, March 06, 2017 1:52 PM To: Kichefski, Steven L SAW (Steven.L.Kichefski@usace.army.mil) <Steven.L.Kichefski@usace.army.mil>; Hood, Donna <donna.hood@ncdenr.gov> Subject: Bridge #177 Replacement, SR 1837 (Hoyles Creek Road), Gaston County The North Carolina Department of Transportation (NCDOT) proposes to replace the existing 121-foot, 3- span timber and steel bridge on SR 1837 with a 130-ft 3 span concrete bridge on same location. There will be 8 feet of temporary impacts under the bridge to facilitate the removal of the existing piles. Thirty-four feet of Class II riprap will be utilized under the bridge for bank stabilization. The scope of bridge work will impact permanently impact 34 feet of Hoyles Creek for riprap bank stabilization impacts, which has been designated as a WS-IV watershed by the Division of Water Resources. A threatened/endangered species survey was conducted for bog turtle (Glyptemys muhlenbergii), dwarf flowered heartleaf (Hexastylis naniflora), Schweinitz's sunflower (Helianthus schweinitziiJ and for Northern Long-Eared Bat (Myotis septentrionalisJ on October 27, 2015. According to the Natural Heritage Program database, the nearest reported bog turtle occurrence is approximately 2.7 miles south of the project area.. T/SA species do not require Section 7 consultation with the USFWS; however, there is no suitable habitat is present within the study area and no impact on the species is anticipated. The closest dwarf flowered heartleaf population is located approximately 4.5 miles north. There is no suitable habitat within the project area and no impact on the species is anticipated. Per NHP, the nearest known occurrence for Schwienitz's sunflower is approximately 5.5 miles to the southeast. Potentially suitable habitat was found within the study area along the right-of-way associated with Hoyle's Creek Road. Additionally, the mapped soil series is Pacolet and Cecil and are listed or similar to the included list of soils supporting Schweinitz's sunflower. Plant by plant surveys were conducted on October 27, 2015 and again on October 28, 2016, no specimens of Schweinitz's sunflower were observed within the project area and no impact is anticipated. A bat (NLEB) habitat assessment for Bridge #177 was done and no evidence of bat habitation was found (see attached form). No suitable roosting trees were observed adjacent to the project. The Natural Heritage Program records document the nearest Northern Long-Eared Bat location approximately 29 miles northwest of the proposed project area. The closest listed underground mine, per NHP database is the J. E. Gates Property, 6 miles east of the project. There are currently no known hibernaculum or maternity roost trees in Division 12 counties for NLEB; therefore, it is a"May Affect; Not Likely to Adversely Affect" for Myotis. The bridge replacement and any minor tree clearing associated with this DOT project would be exempted from incidental take under the 4(d) Rule streamlined consultation form. Per guidance from USFWS personnel, concurrence is granted by citing the following website and a 30 day response period is waived. (http://www.fws.�ov/asheville/htmis/prolect review/NLEB in WNC.html). I have attached a signed copy of is the NLEB streamlined consultation form. i The project area is not located within %z mile of any critical watershed area, nor is SR 1837 a rural or urban arterial; therefore, hazardous spill basins are not required. Attached is the hazardous spill basin checklist. No wetlands or high quality waters will be impacted by the bridge replacement project. There are no sites listed on the National Register of Historic Places located in the vicinity of the project and a cultural resources review of the area has been conducted (Internal Tracking No 14--05-0015). We intend to utilize a NW 3, with no formal notification for the construction of the project. I have attached are plan sheets of proposed activities, photos and applicable documentation.
