JAY ZIMMERMAN Director DWR# 2017-0132 Town of Wilson's Mills Johnston County 100 Railroad Street Wilson's Mills, NC 27593 Subject: REQUEST FOR ADDITIONAL INFORMATION Town of Wilson's Mills Sewer Improvements Project, Wilson's Mills, NC Dear Town of Wilson's Mills: On February 3, 2017, the Division of Water Resources — Water Quality Programs (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. Please indicate if all impacts on Appendix 3, Buffer Impacts Exhibit, C-1.05 are located within Zone 2. The Table of Uses states that, "Impacts other than perpendicular crossings in Zone 2 only is allowable and impacts other than perpendicular crossings in Zone 1 is allowable with mitigation." Please comment on mitigation requirements, and submit map revision and/or PCN buffer impact table and/or mitigation calculation revisions, as appropriate. 2. Please indicate if all impacts on Appendix 3, Buffer Impacts Exhibit, C-4.02 are located within Zone 2. The Table of Uses states that, "Impacts other than perpendicular crossings in Zone 2 only is allowable and impacts other than perpendicular crossings in Zone 1 is allowable with mitigation." Please comment on mitigation requirements, and submit map revision and/or PCN buffer impact table and/or mitigation calculation revisions, as appropriate. 3. A total of 0.738 acres of wetland impacts is proposed. This amount includes the 20' and 30' permanent utility easements. General Certification 3884, Condition 17 allows for only a 15' permanent easement. Any exception from this condition requires a specific request and justification by the applicant for review by DWR. 4. The 15A NCAC 02B .0233 riparian buffer rule must be adhered to. In accordance with 15A NCAC 02B .0233(3), "The Rule shall apply to 50 -foot wide riparian buffers directly adjacent to surface waters in the Neuse River Basin. For the purpose of this Rule, a surface water shall be present if the feature is approximately shown on either the most recent version of the soil survey map, or the most recent version of the 1:24,000 scale quadrangle topographic map." It appears that there are features located on both maps that are not shown on your Construction Drawings or Impact Maps. 15A NCAC 02B .0233(3)(a) states that "When a landowner or other affected party believes - �Nothing Compares State of North Carolina I Environmental Quality 450 West Hanes Mill Road, Suite 300 1 Winston-Salem, North Carolina 27105 336-776-9800 that the maps have inaccurately depicted surface waters, he or she shall consult with the Division and upon request, the Division shall make onsite determinations." Please contact the Raleigh Regional Office for an onsite determination as necessary. Upon receipt of an onsite determination for this project, please provide updated drawing and application materials (including Table of Impacts in the PCN form) that properly show the impacts to the streams and wetlands, if delineations differ from initial determinations. 5. An official letter from Resource Environmental Solutions is required with the buffer mitigation credits. Pursuant to Title 15A NCAC 02H 0502 (c), the applicant shall furnish all the above requested information for the proper consideration of the application. If all the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending one copy of all the above requested information to my attention at the address below. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
