The project shall be constructed in accordance with your �pplication received February l3; 2017. After reviewing
your application, we have decided that these impacts are covered by General Water Quality Certitication Number
3886. This certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers. This approval
is also valid for the Neuse Riparian Buffer Rules (15A NCAC 2B.0233). In addition, you should acquire any other
federal, state or local permits before you proceed with your project including (but not ]imited to) Sediment and
Erosio=; Control, Non-Dischzrge end �fJater Suppl� Watershed regulations. This approval wili tlXalPO'NiGh t}te
accorr.panying 404 permii.
This appreval is valid solely for the purpose and desi;n described in your application (unless modifiad below).
Should your project change, you must notify the NCDWR and submit a new application. If the property is sold, the
new owner must be given a copy of this Certification a�d approval letter, and is thereby responsible for complying
4vith all the conditions. If total aetland fills fer th;s project (ncw or in the future) exceed one acre, or of total
impacts to streams (now or in the fiiture) exceed I50 iinear feet, compensa[ory mitigation may be required as
descrioed in i 5A NCAC 2t{ .0�06 ({Q (6j and (7). Additional buffer impacts may reaui�e compensatory mitigation
as described in i 5A NCAC 2B.0233. . For this approval to remain valid, you must adhere to the conditions listed in
the certification and any additional eonditions listed below.
Conditions of Certificafion:
1. All stormwater runoff shall be directed as sheetflow through stream buffers at non-erosive velocities, unless
otherwise approved by this certification. [ I SA NCAC 2B.0233]
2. All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the
preconstruction contours and revegetated. Maintained buffers shall be permanently revegetated with non-woody
species by the end of the growing season following completion of construction. For the purpose of this condition,
maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular NCD07'
maintenance activities including mowing. The area with non-maintained buffers shall be permanently revegetated with
❑ative woody soecies before the next growing season following complr,tion of constructinn. �] 59 NCAC 2B.0233]
3. Pursuant to ;5A NCAC 2BA233(6). sediment and erosion control devices shall not be placed in Zone I of any
;�,'euse Buffer without prior apprcval by the NCDV✓R. At this time, the NCDNP.Iias approved ro sxd;ment and
erosiun control devices in Zoue l, outside uf ilie approved project impacts, anywhere on this project. Moreover,
sediment and erosion control devices shall Se allowed in Zone 2 of the buffers provided that 7.one 1 is not
compromised and that discharge is released as diffuse flow.
4. Unless otherwise approved in this certification, placement of culverts and other strucwres in open waters and
streams, shall Ue placed beiow the elevation ef the sh eamUed by one F�ut for all cuiverts with a d;ameter greater than
48 inches, and 20 percent of the culvert diamete� fer culverts havin� a diameter less .han 48 inches; to a:low ]ow flow
passage of �aater and aquatic life. Design and placemcnt of culverts and othar structures including tsrn�,orary erosion
control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or
banks, adjacent to or upstream and down stream of the above struchires. The applicant is required to provide evidence
that the equilibrium is being maintained if requested iu �vriting by the NCD WR. If this condition is un�ble to be met
due to bedrock or other limiting T'eamres er.countered during construction, please contact the NCllWR f'or guidance on
how to proceed and to determine whPther or no[ a permit modification will be requ'ved. [ I SA NCAC 02H.0506(b)(2)]
5. If multiple pipes or barrels are required, they shall bz ciesigned to mimic natural stream cross section as closely as
possible including pipes or Uarrels at flood plain elevation and;or sills where appropriate. Widening the stream
channel should be avoided. Stream chanr.el �widening at the inle± or oudet end of structures typica!ly decreases wa?er
velocity causing sediment depositien that requires increased maintenaoce and disrupts aquatic life passage. [i 5A

8. The stream channel shall be excavated no deeper than the natural bed materia] of the stream, to the maximum extent
practicabie. Efforts must be made to minimize impacts to the stream oanks, as well as to vegetation responsible for
maintaining the sheam bank stability. Any applicable riparian buffer impact far access to stream channel shall be
temporary and be revegetated with native riparian species. [ISA NCAC 02HA506(b)(2)]
9. If concrete is used during construction, a dry work area shall be maintained to prevent direct contact between
curing concrete and sheam water. Water that inadvertently contacts uncured concrete shall not be discharged to
surface waters due to the potentiai for elevated pH �md possibis aquatic life an�3 fish kills. j15A rICAC 02B.0^_001
10. During the cerstruction of the project, no staging of equipmen: of any kind is pennitted in wacers of the U.S., or
proiected riparian huffers. [ I SA NCAC 03H.0506(b){2)]

12. 7'he use of rip-rap above the Normal High Water Mark shall be minimized. Any rip-rap placed for stream
stabilization shall be placed in stream chaimelc in such a man�er that it does noT impede aquatic life passage. [15A

14. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BPdP measures from
the most current version of NCDO'C Construction and Maintenance Activities manual such as sandbags, rock berms,
coff rdams and other diversion structures shall be used to prevent excavation in flowing water. [15A NCAC
02H.0506(b)(3) and (c)(3)]
16. Heavy equipment shall be operated from the banks rather than in the stream channel in order to minimize
sedimentation and reduce the introduction of other pollutants into the stream. [15A NCAC 02H.0506(b)(3)]

24. The Permittee shall report any violations of this certification to the Division of Water Resources within 24 hours of
discovery. (15A NCAC 02B.0�06(b)(2)]
25. Upon completion or the project (including any impacts at associated bortow or waste sites), the NCDO'I' Division
Engineer (or whomever is the authorized agent if a non-NCDOT project) shall complete and rewm the enclosed
"Certification of Completion Form" to notify the NCDWR when all work included in the 401 Certification has been

locatad in wetlands or su-eams, wmpensarory �riitigation wiil be required since that is a direct impact from road

28. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design,
installation and eperation and maintenance of such Best Management Practices in order to protect surface waters
standards [ t5A NCAC 02H.0506(b)(3) and (c)(3)]:

be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all conshuction
sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
