Buncombe County
The Division of Water Resources (DWR) has performed a review of a 401 Water Quality Certification application dated
January 11, 2017 and received by DWR on January 13, 2017 for the above referenced project. The DWR has determined
that your application is incomplete and cannot be processed. The application is on -hold until the following information
is received:
1. Attachment A of Water Quality Certification 3890 (GC 3890) states, "All projects, regardless of project area,
amount of built -upon area or amount of jurisdictional impact, shall meet the following stormwater design
requirements...". See provided link to GC 3890 for the full requirements. Your application inaccurately states
that a stormwater management plan (SMP) is not required. Buncombe County is a certified local program
delegated to review SMPs. Please provide documentation of Buncombe County's approval of a SMP for this
project by providing EITHER:
a. A valid approval letter and one copy of the approved SMP, or
b. One set of stormwater plan details and calculations stamped as "Approved" by Buncombe County.
2. Avoidance and Minimization: This Office believes that the proposed impacts labelled S1 and S2 on Figure 3.1 can
be moved or reconfigured to the north side of the confluence of the two tributaries to minimize the overall
impacts to a single crossing. Please revise the plans to minimize the impacts or provide a detailed explanation of
why this plan for the activity cannot be practically accomplished, reduced or reconfigured to better minimize
disturbance to the unnamed tributary to Hominy Creek.
Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper
consideration of the application. If all of the requested information is not received within 45 calendar days of receipt of
this email, the DWR will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
