Tlie new structure will be a 20' W (span) � 6.5' H x 76' L aluminum bos culvert with 1.5' H sills and 5.5' W s 0.5' D notches at the ends and midpoint to promote bedload retention and fish passage. The road will be closed and an off-site detour will be used during construction. Enclosed are a PCN application, preliminary jurisdiction form, Division of Mitigation Services Acceptance Letter, plan sheets sho�ving the impact site locations, a USGS quad map, photograpl�s, and otlier pedinent project infonnation. In Jackson County, Carolina northern flying squirrel (G(nucomys sabrinus colornit�s), gray bat (Myofrs grisescens}, Indiana bat (Myotis sodn/is), Appalachian elktoe (Alns�nidonln rm�enelimm), spruce-fir moss spider (iLlicrolre.rarn mailivngn), swamp piuk (Helonins bid/ntn), small whorled pogonia (Isoh•in me�leoloides), rock gnome lichen (G�mmodernta /inem•e), and no�thern long- eared bat (Atyotis septenh�ionalis, NLEB) are Imown from cun•ent records and are federally-listed as either threatened or endangered. Appalacliian elktoe are fouud in some �vell-osygenated streams witli modeiate to fast flowing water and stable, mixed substrates of silt, sand, gravel, and/or cobble. Streams that suppo�t this mussel are typically much larger and �varmer than Long Branch or Cullowhee Creek, wl�ich is downsheam of Long Branch. This project is a small bridge replacement, so construction work will not extend far from the existing right-of-way into areas �vhere caves may occur. There are no caves or mines visible near the bridge and the nearest underground mine is over 1.7 miles away. Blasting or pile driving is not anticipated �vith this project. Therefore, gray bats and hibernating Indiana bats and NLEB sl�ould not be affected by the project. When not hibernating, Indiana bats and NLEB usually roost on struchires, under the shaggy bark of live trees such as white oaks, sycamores, and hickories, or in cavities and under the loose peeling bark of dead trees. The bridge was surveyed on June 2, 2015 and tliere were no roosting bats or any evidence of bat usage (i.e. staining or guano). The stn�cture is poorly suited as a bat roost because it is only a few feet above the �vater surface and very cool underneath. Moreover, tlie bridge is not situated in an area where NLEB hibernacula or maternity roost trees are an identified concern ("red HUC) and it is over 4.5 miles from the nearest "red HUC". The constn�ction tivork should not require any h�ee removaL For these reasons, we recommend a "may affect, not likely to adversely affecP' determination for bats. There are no wetlands habitats near the bridge, so swamp pink is absent. Small whorled pagonia most often occurs in open, dry, deciduous woods with acid soil, though l�abitats can include slopes along streams and mesic forest with white pine and rhododendron. Land use adjacent to the bridge consists of a maintained roadway, drives, apaRments, la�vn, and thick scrub vegetation on tlie stream bauks. The habitats appear unsuitable for pagonia plants and plants were not observed during a brief swvey of the area on June 2, 2015. The Carolina northern flying squin�el, rock gnome lichen, and spruce-fir moss spider are found in spruce-fir forests and other isolated high elevation locations in western No�th Carolina. Ho�vever, �nck gnome lichen is an esception because it can occasionally be found at Io�ver elevations in deep river gorges with high Iwmidity or on some vertical rock faces that are periodically �vet. The bridge site has an elevation of only 2,100 feet and tliere are no damp rock faces nearby. The project is limited in scope. Erosion and sedimentatiou control measm�es will be used to minimize adverse effects of the work on aquatic liabitats. Habitats for listed species appear Iacking at the project site and none of the species known fi�om Jackson County were observed during field visits. For these reasons and those discussed above, we recommend that a determination of "no effecY' on listed species, with exception to bats as noted above. This project was reviewed by NCDOT's Human Environment Unit in 2011 and it was detennined that suiveys were not necessary for historic structures or archeological resources (see attached fonns). NCDOT best managemeut practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will revie�v aIl erosion control measures daily and maintain and/or replace devices quickly. Impacts to Waters of the United States Long Brancli (DWQ Class: C) is shown on the USGS topographic map as a perennial stream. It has a well-defned cl�annel approsimately 7 feet in width with a substrate of saud, gravel, cobble, and bedrock. Long Branch flows to Cullowliee Creek, �vhich tlien flows to the Tuckasegee River. Jackson 55 Replacement Page 3 February 24, 2017 The River meets the definition of a Traditional Navigable Water (ThIW). For these reasons, we believe Long Branch is a Relatively Peimanent Water (RPV� and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to impact waters of the United States in the Little Tennessee River Basin (CU 06010203). No previously recorded archaeological sites are contained within the presently defined APE or immediately adjacent to the APE. No existing National Register of Hisroric Plnces (NRHP), State Study Listed (SL), Locally Designated (LD), Determined Eligible (DE), or Surveyed Site (SS) properties are contained within or proximal to the project study area. Topographic maps, soil survey maps (CwA, BrC, SaC), aerial phorographs (Google, NCDOT), historic maps (NC Maps website), archaeological/historical reference materials, and the Google street view map application were inspected/utilized by the cultural resource specialist to gauge archaeological site potential within the APE and to assess the level of residential, hydrological, agricultural, and other erosive disturbances that may have formerly impacted any potential resources contained within the project construction footprint. Most of these sites were discovered through CRM driven archaeological survey in association with construction and improvements to Hwy107. Many of these sites are situated in identical topographic and pedeological environs as the current APE. Therefore, on merits of topography and known resources in the immediate area, die Bridge No. 55 location would hold a moderate ro high potential for containing some truces of archaeologically discernable past humun activity. The NRCS soil types mapped within lhe project APE include primarily (BrC) Braddock-Urban land complex 2% to I S% slopes and (CwA) Cullowhee fine sandy loam 0% to 2% slopes, a somewhat poorly drained, occassionally flooded soil consisting of at least 35% rock fragments. The Google street view map applicntion and aerial phorographs revealed myriad disturbances and impac[s effecting the currently defined APE. Moreover, the angle of the creek to the existing bridge structure automatically negates any site potential in hvo of the project quadrants as the APE consists entirely of creek/creekbed and maintained/disturbed right-of-way. The remaining hvo quadrants are chTracterized by paved and/or graded driveways/parking areas/roads, a house, and residentially altered/landscaped ground surfaces. The Corps of Engineers believes that there may be jurisdictional waters of the United States on the subject site, and the permit applicant or other affected party who requested this preliminary JD is hereby advised of his or her option to request and obtain an approved jurisdictional determination (JD) for that site. Nevertheless, the permit applicant or other person who requested this preliminary JD has declined to exercise the option to obtain an approved JD in this instance and at this time. 2. Further, an approved JD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R.
