Dear Mr. Thompson:
On June 10, 2008, the Division of Water Quality (DWQ) received your application dated June 9,
2008, to fill or otherwise impact 138 linear feet of perennial stream, and 6,825 square feet of
Zone 1 Neuse River basin protected riparian buffers and 4,158 square feet of Zone 2 Neuse River
basin protected riparian buffers to construct the proposed facility expansion at the site. On June
30, 2008, the DWQ received additional information from you, however, the DWQ has
determined that your application remains incomplete and/or provided inaccurate information as
discussed below.
The application package failed to include Required Items 1 and 2 from the level spreader
supplement form. From the information provided, it is difficult to determine the location
of the level spreader on the site. Also, the stormwater drainage system for the project is
not shown, and therefore the DWQ cannot determine if the roadway drainage is being
directed to the wet detention ponds or if it is being discharged through the riparian buffer
(which would require the use of a level spreader).
2. The proposed wet detention ponds must be designed to meet state requirements
regardless of whether the stormwater review is being conducted by the Town or Garner
or the DWQ. Please insure that the proposed BMPs include provisions for pretreatment,
SA to DA ratios, vegetated shelves and other required design elements listed in the DWQ
BMP Manual. Please show the locations of the inlet structures for these wet detention
ponds on the plan sheets.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
