The following restates your questions/comments and is then followed by our response. Additional Information Requested on June 17, 2008 Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from this site must be discharged through a correctly designed level spreader. Level spreader design requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual (http://h2o.enr.state.nc.us/su/bmp_forms.htm). Please provide one Level Spreader Supplement Form for each proposed level spreader, including the Required Items checklist and all items listed therein. We apologize for neglecting to include this information in our original submittal. Please see the attached revised plan sheets that depict the appropriate level spreaders as well as the Level Spreader Supplement forms for each one. 2. Please provide a depiction of a proposed BMP (state the type of BMP you plan to use) on the site plan that is correctly sized based on the water quality volume. This plan sheet depicts a pre cast stormfilter produced by Contech. The associated section views and details for the stormfilter are also included on plan sheet C-13. The constraints on the subject site (i.e. property line set backs, Resource Conservation Areas and Thoroughfare Buffers) limit the applicant's ability to design a site that meets minimum zoning requirements (i.e. building square footage, parking spaces, etc.) for the Town of Apex and set aside enough property to build a stormwater wet pond and/or a stormwater wetland. Therefore, the applicant is proposing to use the above mentioned pre cast stormfilter which meets the 85% TSS removal requirement. The applicant will also be utilizing the Nitrogen Buy Down program administered through the EEP to satisfy the 30% Nitrogen reduction requirement.
